I have not received word from Scott Collins about the proposal, other than that he was planning on submitting
the variation request and revised plan to proceed. I forwarded him all your concerns and requests when I
received them. If he chooses to address them is anyone's guess at this point. I'm currently in a holding pattern
till they resubmit and once they do then I'll get back into their proposal.

Hello Christopher,
I wanted to follow up with you to see if there has been any movement or developments on Avon Park 2? I have
not yet heard from them on the new type of trees being proposed along the property line or whether they would
be willing to honor our request to have trees near the property line(Avon Park 1 side and biscuit run property)
evaluated to see whether there is any root damage and need to be removed. Appreciate any insights you might
have that you can share or whether you have any documentation that they have passed you since our last
discussion.

Per conversations with Zoning and the legal team it appears a proffer amendment is not needed; rather, the
proposal can take place in a Variation/Special Exception if all the screening mentioned in those proffers is
locked down in a condition of the variation acted on by the BOS,thus satisfying the proffer(not changing the
proffer) and providing the required screening prior to any CO are issued. This condition should be suggested by
you in the revised variation request; regardless, it'll be required as a condition in order not to go through the
rezoning/proffer amendment.
I have a bunch of emails from the HOA president of Avon Park I that I need to respond to, I am planning on
getting that done tomorrow or Monday. Have you read through her questions/requests and thought about any of
them? I'll CC you to the response I send her. s

Scott,
I discussed it with Bart and Francis of Zoning today.They want me to get the County Attorney's opinion on whether or
not we can do it the way your suggesting (in the variation), or if a proffer amendment is needed.Thus I'm putting it on
legal this week and bringing it to their attention for further discussion. Stay tuned.

Thanks for the help with Avon Park II. As a follow-up from our discussions on Avon Park II,this is the email from our pre-
application meeting where we talked about the special exception, and specifically the variation with respect to the

landscaping. Also,we can definitely update the variation request stating that the landscaping would be installed prior to
the first CO, if that helps address any timing concerns with specific units.
