FURTHER, pursuant to the consideration described herein, Grantor does hereby GRANT and CONVEY unto Grantee, its successors and assigns, a perpetual easement and right of way on, above, and underground for storm and surface water drainage, including pipes, ditches, culverts, swales and other suitable facilities for the disposition of storm and surface water drainage (collectively, the "Private Drainage Easements") as more particularly bounded and designated as "10' PRIVATE DRAINAGE EASEMENT" on the Plat. The Private Drainage Easements shall include the right to cut such trees, brush and shrubbery, dig or grade such soil and take such other similar action as reasonably necessary. Any physical damage to the Property resulting from the use of the Private Drainage Easements shall be promptly repaired at the expense of the party causing such damage. In consideration of the premises and the sum of One Dollar($1.00), cash in hand paid, receipt of which is hereby acknowledged, Trustee, as authorized to act by Lender, as shown by its execution herein, does hereby consent to and subordinate the lien of the Deed of Trust to the Private Drainage Easements granted herein.
