Additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [Conditions of Variation Approved 7-17-191 The final site plan shall comply with the following conditions: 1. The final site plan must provide a shared use path, at least 10 feet wide, along the entire expanse of the eastern boundary of the lease area. The path must: a. Connect to the required sidewalk along the southern egress for the site. b. Include a 6' wide landscape strip between the shared use path and the mall "ring road" travelway, planted with street trees meeting the requirements of Section 32.7.9.5. Final: Comment not addressed. The 10' wide shared use path width shall be measured from the back of the curb to the edge of the shared use path. Currently the shared use path is only 9.5' wide with a'/2' curb. Revise the shared use path to be 10' wide. Additionally, the 6' wide landscape strip shall be measured from the back of the curb to the edge of the landscape strip. Currently the landscape strip is only 5.5' wide with a'/2' curb. Revise the landscape strip to be 6' wide. Also, parking spaces abutting the 10' shared use path shall not be permitted a 2' overhang into the shared use path. For the 14 parking spaces affected provide bumper blocks to prevent parked vehicles from overhanding into the shared use path. 2. If VDOT does not approve a connection of the northernmost proposed shared use path to the existing sidewalk on Rte. 29, then the applicant must provide in place of the required sidewalk along the southern egress of the site either a 10' wide shared use path and a 6' wide landscape strip OR a 10' wide sidewalk and a 6' wide landscape strip for the duration of the southern egress road. In either case the landscape strip must abut the road and be provided the required street trees pursuant to Section 32.7.9.5 to buffer pedestrians. The total width of these improvements shall be 16' wide. Final: Comment not addressed. VDOT has not received the required information from the applicant to review/approve a connection of the northernmost proposed shared use path to the existing sidewalk on Rte. 29. 2. [33.44, 32.7.2.3(a), 32.7.2.3(b), 32.7.2.3(c)] Provide a 5' wide sidewalk along the southern egress road south of the site. Ensure it connects to the existing sidewalk along Rte. 29 and the required shared use path discussed above. The pedestrian connection shall meet ADA standards. Final: The use of a 5' sidewalk in this location is contingent on condition 1.2 of the variation being satisfied. VDOT has not received the required information from the applicant to review/approve a connection of the northernmost proposed shared use path to the existing sidewalk on Rte. 29. 3. [33.44, 32.7.2.3(b), 32.7.2.3(c)] The 8' wide shared use path along the northern boundary of the lease area shall be revised to be 10' wide. Final: The 10' wide shared use path width shall be measured from the back of the curb to the edge of the shared use path. Currently a portion of the shared use path, nearest the striping, is only 9.5' wide with a'h' curb. Revise the shared use path to be 10' wide. 4. [32.7.9.5(e)] Provide a single row of 12" tall evergreen shrubs along the perimeter of the parking area adjacent to Rte. 29 and the southern egress road where there is currently a large opening being produced by the uneven spacing of the street trees. Final: Comment not fully addressed. There are three parking spaces abutting Route 29 which are not screened. Either continue the evergreen shrubs to fill this area or provide another large shade tree in this area. 5. [32.5.1(c), 32.6.2(a), 32.6.2(g), 32.7.5.1, 4.1] Offsite storm sewer and sanitary sewer easements are required on TMP 06100-00-00-13000. This property is not owned by the same owner as the subject property. All required off -site easements must be approved and recorded prior to final site plan approval. Recordation information of this action shall be provided on the final site plan. Final: Comment not addressed. Submit easement plat and applications for County review. 6. [32.6, 32.4.3.2, 32.4.3.3, 32.4.3.6, 32.4.3.2] The final site plan shall not be approved until all SRC reviewers have approved the plan. Their comments are referenced below and attached. Final: Comment still relevant. 7. [32.6, 32.6.1, 32.6.21 The final site plan shall meet all the requirements of section 32.6 of Chapter 18 of the Code. Final: Comment still relevant, I offer the following review comments. 8. [32.6, 4.121 The plan depicts 43 shopping center parking spaces; however, the calculations on sheet C2.1 work out to 38 spaces remaining for shopping center if 85 spaces are provided the restaurant use out of the total 123 parking spaces. Revise general note P on page C2.1 to match the parking being allocated in the plan. I offer the following suggested calculation: 71 spaces required for the restaurant use x 1.2 = 85 spaces provided for the restaurant use + 38 provided for the shopping center use Total = 123 parking spaces 9. [32.5.2(a)] Sheet C1.2 is missing from the site plan, revise to include it. Additionally, please provide a total number of sheets. 10. [32.5.2(a)] Provide the source of the topography. 11. [32.5.2(k)] Provide flow arrows in all storm drainage pipes. 12. [32.5.2(1)] Depict, label, and dimension all utility easements, including gas. 13. [32.6.2(d), 32.6.2(g)] a. Depict and clearly label all existing and proposed utility easements as required, both onsite and offsite. b. Provide water line profiles and depict all utility crossings on water and sewer profiles. Depict and label existing water and sewer facilities to which proposed water and sewer piping to be connected; include sizes. c. Clearly label all facilities and easements to be dedicated to public use. d. Provide a statement identifying all water and sewer facilities and easements that are to be dedicated to the Albemarle County Service Authority. 14. [32.6.2(e)] Depict all symbols and abbreviations used on the plan. 15. [32.6.2(i), 4.12.181 Dimension and label the proposed loading area onsite. Minimum loading space size is 12' wide, 25' long, and 14 'h clearance. 16. [36.6.2(k), 4.17] Lighting. ARB has extensive required lighting plan changes. Revise the lighting plan to meet all ARB review comments. 17. [36.6.2(k), 4.171 Lighting. For all fixture types provide cut sheet labels coordinated with lighting schedule and plan. 18. [36.6.2(k), 4.171 Lighting. Provide total lumens for all proposed light fixtures. 19. [36.6.2(k), 4.171 Lighting. Provide manufacturers cutsheets for all lighting fixtures. 20. [36.6.2(k), 4.171 Lighting. Revise the lighting plan to limit the spillover to 0.5 foot-candles at the property line along the Route 29 right-of-way. 21. [36.6.2(k), 4.171 Lighting. Replace all lighting that is non full cutoff fixtures over 3,000 lumens with full cutoff fixtures. Ground lighting is not permitted. 22. [36.6.2(k), 4.17] Lighting. Eliminate all light fixtures that are not needed for safety/security from the lighting plan, including but not limited to the LED cove lighting and ground -mounted lighting. 23. [Comment] Revise the cover sheet to remove reference to the Initial Site Plan and include the site plan application #: "SDP201900050". 24. [32.6.20), 32.7.9.5(d)] Landscaping. The plan depicts temporary construction easements along the property's Rte. 29 frontage which were granted to VDOT; however, within these easements are required plantings. VDOT shall approve the plantings in these easements. If VDOT approval is not received the planting islands shall be expanded and the required trees shall be planted outside the easement. 25. [32.6.2(j), 32.7.9.81 Tree Canopy. Revise the landscape schedule on sheet Ll.l to provide canopy SF counts for all plantings above 5' at 10-year maturity. These figured will enable staff to determine if the canopy calculations for the site are met. Canopy calculation information can be found in the County's Approved Plant Canopy List. 26. [32.6.2(j), 32.7.9.51 Street Trees. Add 1 large street tree to the frontage of the property to meet the minimum street tree calculations required. 27. [32.6.20), 32.7.9.6] Landscaping within Parking Area. The internal landscaping calculations are based on 184 parking spaces; however, the plan only provides 124 parking spaces. Revise the calculation to utilize the correct parking amount. 28. [32.5.2(a)] Special Exception. Provide the following note on the plan that references the special exception approval by the BOS: "SDP2018-66 Longhorn Steakhouse —Special Exception to Vary SDP1979-7 Application Plan, approved by the BOS on July 17, 2019 with the conditions". 29. [Albemarle County Engineering Policy, 32.6.2(a), 32.5.2(n)] Label the maximum height of all retaining walls. 30. [32.7.2.11 Vehicular Access to Site. VDOT approval is required prior to final site plan approval. 31. [32.6.2(a), 32.5.2(a)] A WPO plan must be approved prior to final site plan approval. 32. [32.6.2(a), 32.5.2(a), 4.201 Setbacks. Revise the setbacks on sheet C2.1 as follows: Front Minimum: 10 feet from the right-of-way Front Maximum: None because the lots abut a principle arterial highway. Side and Rear Minimum: Primary structure shall be separated in accordance with the current edition of the Building Code. Side and Rear Maximum: None Parking Setback: Front Minimum — 10' from the public street right-of-way 33. [32.6.2(h)] Provide a signature panel for signature by each member of the site review committee. The Board unanimously approved the request, pending staff administrative approval of the following conditions: 1. Revise the architectural elevations to show the previous larger size of the two shuttered windows on the south (right) elevation. 2. Provide renderings of the proposed pedestrian connection in the northwest comer of the site as seen from the EC. 3. Indicate on the site plan the material, manufacturer and color of the retaining wall material. Provide a sample for review. 4. Revise the guard rail detail for a more coordinated appearance with the railing at the retaining wall and with the overall development. 5. Correct all inconsistencies in the lighting information. Revise the lighting plans included in the site plan set as follows. a. Limit spillover to .5 fc at the property line along Rt. 29. b. Provide legible lighting cut sheets in the site plan. c. Provide cut sheet labels coordinated with lighting schedule and plan. d. Provide total lumens in the schedule for all fixtures with LED lamps. e. Provide lamp type and wattage in the schedule for all non -LED lamps. f. Provide complete catalog numbers in the schedule, coordinated with the cut sheets. g. Provide the proposed color temperature for each light fixture. Provide a consistent color temperature throughout the development. h. Specify the finish/color for all proposed exterior light fixtures in the luminaire schedule. i. Limit photometric diagrams to those specifically associated with the proposed fixtures and proposed options. Make the diagrams legible. j. Coordinate the lighting shown in the architectural plans with the lighting shown in the site plan. k. Eliminate all light fixtures that are not needed for safety/security from the architectural plans and the site lighting plan, including but not limited to the LED cove lighting and ground -mounted lighting. 6. Provide additional landscape area to ensure that proposed street trees along the EC frontage will not conflict with easements. Alternatively, provide documentation that the conflicting easements have been abandoned. 7. Add one large shade tree in the parking island near the southwest corner of the site or substitute a smaller tree along the frontage with a large shade tree at the south end of the frontage. 8. Revise the plant schedule to show that the planting size of the Entrance Corridor shade trees is 3Y2" caliper. 9. Shift the GD further away from the water line at the eastern entrance to the site and shift the FPAA further away from the sanitary line. 10. Consider an alternate species for the Ash trees. Please provide: 1. One full set of revised drawings addressing each of these conditions. Include updated ARB revision dates on each drawing. (Please note that PDF files on a flash drive are welcome in addition to the paper copy.) 2. A memo including detailed responses indicating how each condition has been satisfied. If changes other than those requested have been made, identify those changes in the memo also. Highlighting the changes in the drawing with "clouding" or by other means will facilitate review and approval. 3. The attached "Revised Application Submittal" form. This form must be returned with your revisions to ensure proper tracking and distribution. When staffs review of this information indicates that all conditions of approval have been met, a Certificate of Appropriateness may be issued.
