Perkins, Sr. & Connie — Family Subdivision The County of Albemarle Planning Division will grant or recommend approval of the Final Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] OLD COMMENT FROM SUB2018-82 [14-212 & 14-212(B)] Family division; conditions or approval. Provide the signed and notarized affidavit for the family relationship. This document will be reviewed and approved by the County Attorney's office before plat approval. SUB2018-82 Rev. 1: Comment not yet addressed. Please submit a signed and notarized Affidavit verifying family relationship of grantor to grantee. In discussion with the County Attorney's office, despite the strange circumstances of the land only being under current ownership for one year, 1) because there was an immediate family relationship between the current owner and the previous owner and 2) there is an immediate family relationship with the current owner and the grantee in the proposed division a family division will be allowed. The County Attorney's office state that despite this strange circumstance the Affidavit can be filled out as it usually would, specifying the current owner and the proposed grantee only, and that any reference to the previous owner is unnecessary. SUB2019-152 UPDATED COMMENT: An affidavit of family relationship was submitted for the first time with the new submittal of SUB2019-152. The affidavit submitted is not the form provided in the Family Division application packet and it does not include all of the wording provided in that form. Therefore, it requires review the County Attorney's office to ensure that it is sufficient to meet the affidavit requirements. The affidavit has been forwarded to their office for review and their comments or approval will be forwarded to you once they are available. Please note that this document (once it is approved by the County, signed, notarized and a copy of the notarized version is submitted to the planning reviewer) must be recorded at the time that the plat is recorded. 2. [14-212(B), (C), 14-106 & 14-412] Family subdivisions; conditions of approval; Private Street; Standards for Private Streets only. Signed and notarized copies of a deed of gift, a private street maintenance agreement, and a declaration of family division have been submitted.
