THIS DEED, made this 6th day of April, 1993, by and between
FOREST LAKES ASSOCIATES, a Virginia general partnership, Grantor,
party of the first part, and FOREST LAKES COMMUNITY ASSOCIATION,
INC., a Virginia non -stock corporation, Grantee, party of the
second part, whose address is Post Office Box 8084,
Charlottesville, Virginia 22906,
W I T N E S E T H:
The Grantor, subject to the items and reservations set
forth, hereby grants and conveys with GENERAL WARRANTY and
ENGLISH COVENANTS OF TITLE unto the Grantee, as "Common Area" all
that area designated as "Parcel C" containing 7.056 acres, as
shown on a plat of Roudabush, Gale and Assoc., Inc., dated
February 16, 1993 entitled "Plat Showing Parcel C Containing
7.056 Acres To Be Deeded To Forest Lakes Homeowners Association"
hereto attached.
The Grantor reserves for itself, its successors and assigns
the joint use with the Grantee of the pump house, pump and other
equipment within the pump house and the use of the water in the
lake for irrigation purposes and reserves for itself, its
successors and assigns access to the pump house and the lake.
The cost of the maintenance, repair and replacement of the pump
house, pump and other associated equipment shall be shared
equally by the Grantor and the Grantee, their successors and
assigns. The Grantor's covenant of maintenance, repair and
replacement shall automatically cease at such time as the Grantor
sells and conveys the Swim and Tennis Club to another owner, but
the covenant of maintenance, repair, and replacement is a

covenant running with the land of the Swim and Tennis Club as
described and conveyed in any deed to a subsequent owner of the
Swim and Tennis Club.
The Grantor further reserves for itself, its successors and
assigns all the reservations and rights pertaining to Common
Areas as set forth in the Declaration of Covenants and
Restrictions of Forest Lakes dated October 4, 1988, of record in
the previously cited Clerk's Office in Deed Book 1018, beginning
at page 318, including but not limited to the right of ingress
and egress, the right to make improvements at its sole option and
the right to grant to others and reserve for itself such
easements and rights of way as may be necessary for the
development of Forest Lakes in its sole discretion. Grantor also
reserves the right to temporarily obstruct or remove the jogging
trail provided Grantor, within a reasonable time, restores it to
its prior existing condition.
This conveyance is made subject to existing easements,
restrictions, and reservations effecting the subject property.
The name of Frank A. Kessler, general Partner of Forest
Lakes Associates, has been signed hereto by Stephen N. Runkle, as
attorney in fact under Power of Attorney dated December 18, 1989,
recorded in the aforesaid Clerk's Office in Deed Book 1082, page
