Dear Ms. Scroggins:
In response to your request for a Letter of Zoning Compliance for the above
referenced Property, please be advised of the following for TMP 06000-00-00-04005; University
Heights Apartments 221-249 Colonnade Drive, Charlottesville, VA Albemarle County
(the "Property")
The Property is zoned R-15, Residential under Chapter 18 of the Albemarle County Code
(the "Zoning Ordinance"), lies within the boundaries of Albemarle County, Virginia (the
"County"), and is located in the Entrance Corridor Overlay District (EC) and the Steep Slope
Overlay District. This is not a Planned Unit Development. The R-15 zoning district permits
the current use of the property for Multiple -family dwellings as a matter by right. The site
was developed prior to the requirement to have a site plan.
The properties surrounding University Heights Apartments are zoned as follows: North: HC,
Highway Commercial; South: R-15, Residential; East: City of Charlottesville; West: R-1,
Residential and PRD, Planned Residential Development.
There have been multiple determinations that the property is considered legally
nonconforming. Unfortunately these determinations do not state what the nonconformity is,
they only state that the site was developed prior to there being a Zoning Ordinance in
Albemarle County. That statement is true. The current use of the property is considered a
conforming use. It is determined that the nonconformity for this Property is the density.
The Property consists of 5.96 acres which would permit 89 dwelling units at 15 dwelling
units per acre. The Property appears to have 171 dwelling units, thus 82 more units than
the district permits. The number of units have been reduced from 174 units to 171 units or
29.19 du/ac to 28.69 du/ac.
• There is a variance associated with the University Heights Apartments for the subdivision
sign at the US Route 250W entrance. That variance is VA-1991-00022, approved
06/11 /1991, see attached.
• In the event of casualty or destruction, in whole or in part, the improvements on the
Property may be rebuilt to their current specifications, subject to the building code
requirements.

There are no records of an open zoning violation filed on the Property.
The Property is not subject to an approved site plan. Any change in or expansion of the
use that requires additional parking under Section 4.12 of the Zoning Ordinance; additional
ingress/egress or alteration of existing ingress/egress is required by the Virginia
Department of Transportation based on the intensification of the use; or additional
ingress/egress or the alteration of existing ingress/egress is proposed by the developer will
require approval of a site plan by Albemarle County Community Development according to
Section 32 of the Zoning Ordinance.

Dear Mr. Sobbott:
This letter is to inform you that on June 11, 1991, during the
meeting of the Albemarle County Board of Zoning Appeals, the Board
unanimously approved your request for VA-91-22, subject to the
following conditions:
1. The proposed curbed median area shall be completed
prior to relocating the existing sign.
2. Landscaping shall be provided as per site plan.
3. The height of sign shall be limited to eight (8)
feet.
4. Future replacement concerning color and composition shall
be reviewed by the Zoning Administrator and Architectural
Review Board.
5. Lighting shall be shielded as the applicant described using
external lighting with the lowest possible wattage (150
watts or less) which would come from the ground in the
planting area, which would be shielded and directed onto
the sign.
This variance approval allows relief from Section 3.0 of the
Albemarle County Zoning Ordinance to increase the height of
subdivision sign from 6 to 8 feet and to allow the subdivision
sign to be lighted.

We have been advised by the County Attorney that the Architectural
Review Board may consider illumination in their review of
aesthetics. They have not yet granted approval (a certificate of
appropriateness). I recommend that you submit a specific lighting
plan for their review.
