I was under the impression from our last meeting that a permanent easement was not needed for this project pecause it
is not the County's intention to maintain this property. However, if the owner (HOA) is not compliant in maintaining the

gives the County permission to complete inspections as well. What other reason would we need the easement for?

Thanks Andy. No, we do not have a plat delineating HOA property over which one would need maintenance access.
Could you confirm that these two things are required before we can start construction?
Step 1. Have permanent access easement platted on HOA property.
Step 2. Have HOA sign plat and the deed of dedication and easement that you sent? (The form may require
minor revisions — i.e. it says that the grantor is constructing the facility when in fact the grantee is constructing
it.)

Stavros,
The existing agreement gives the County the right. to install the proposed facilities initially, but not the right
to maintain diem indefinitely. Even though the owners' association is primarily responsible for maintenance of
die facilities, if the association fails to do so, the County currently lacks a legal right of entry onto Association
property to do so. I would not advise installing the facilities unless/until the County leas a permanent easement to
re-enter die property for future maintenance.
Attached is die form drat we typically use. Do we have a plat that delineates the association property over
which one would need access to maintain the facilities? Thanks.

Good morning Ryan,
Please see attached for the documents we need signed by the HOA in order to construct the stormwater retrofit at
Minor Hill. I believe these will be the only signatures we will need from the HOA. Will you please forward them to Jane
Foy for her signature?
Two things are attached:
1. Right of Entry Letter — This gives the County and our contractors permission to be on toe property to build the
retrofit. Originally I thought we would need easements, but our attorney fortunately allowed us to pursue
something much simpler. A temporary right of entry agreement will be a lower paperwork burden, will
automatically expire at the end of the project, and won't be permanently recorded in property records as an
easement would.
2. Stormwater Maintenance agreement —this form is required by County engineering reviewers for all stormwater
facilities in order to insure that they are maintained after construction is completed and the warranty period
ends. It is a standard form, but we have modified it slightly to reflect the fact that the County instead of the
Owner is constructing the facility.
Please note that the right of entry letter requires Jane's signature in addition to the signature of any witness, whereas
the maintenance agreement requires a notary. The County will be happy to provide a notary.
