Good Morning Dustin,
I wanted to pass along my review comments for SUB2019-109, easement for Timberwood Square (I just
sent them to Will White, the contact at Roudabush). I checked with my supervisor, and we do need all
private easements for the commercial uses/parcels done before final site plan approval. The townhouse
easements can wait until the subdivision plat stage, but they should all be done together (except SWM
can be done now, since it's for the whole site).
Looking at the final site plan, I saw a private waterline and shared parking for the commercial uses — not
sure if there are any other private easements I missed, but those need to be done before the site plan is
approved. They can also be done with this plat. If you want to do the overall shared parking/access
easement at the subdivision stage, that is fine, but we do need the shared parking agreement for the
commercial uses/parcels before final site plan approval.
1. Note 12 lists "SO" instead of "SP"
2. Note 13: Please label the setbacks as "Commercial per 18-4.20" and "Residential per 18-4.19".
3. Clarification question: The final site plan SDP2018-87 shows a shared access easement and
parking easement for both the commercial lots and the townhomes. This easement plat appears
to show that easement on Sheet 3. Please clarify if this easement is for stormwater
management access only or for the shared access/parking easement.
a. Easements for the townhomes can be completed at the subdivision plat stage. However,
if the shared parking/access easement for the townhomes is being done now, then the
other easements should be done as well (drainage, landscaping, etc.), and the HOA
documents should be completed.
b. SWM easements can be completed separately now, since they are for the whole site,
and are needed for final site plan approval.
4. All private/non-ACSA easements for the commercial uses need to be completed before final site
plan approval. Looking at SDP2018-87, I see a proposed private waterline easement and a
proposed access/parking easement. If not already completed, a shared parking agreement is
needed for the commercial uses prior to site plan approval. All required deeds/agreements are
needed. These need to be completed prior to final site plan approval because no subdivision
plat is needed for the commercial uses.
To summarize:
1. All private/non-ACSA easements for the commercial uses on TMP's 46B4-7A, 7B, and 7C need to
be completed prior to final site plan approval. All deeds/agreements are required. Those
easements can be done with this plat.
2. The easements for the townhomes should be done at the same time. They can either be
completed all together now, with HOA/maintenance/agreement/deeds included, or completed
during the subdivision plat stage.

review as well.

With plat at point of approval, Engineering needs deed bk.-pg. reference for Maintenance Agreement for
the on -site BMP practice (biofilter). I understand Bob is working with Ana on the Maintenance
Agreement. Ana will let us know when the Agreement is approved, at which point Engineering records
the Maintenance Agreement, then formats the deed (which includes ref. to Agreement bk.-pg.), then sends
deed and .PDF of plat to the county attorney's office (CAO) for review /comment prior to distributing
deed to Applicant for notarized signature/s. CAO does not review plats /deeds until all CDD staff -level
review comments are addressed. They have been. A few steps to go —thanks for your patience.

There is no objection from Planning either. It seems like an unnecessarily large area is shown for the
SWM access easement, but if that is the preference for the application, then that is fine.
A separate easement plat will be needed for the other easements, and all easements for the commercial
portion will need to be approved before the site plan can be signed. The easements for the residential
portion can be done with the final plat.

Thank you. A couple of questions regarding the proposed agreement;
1) The agreement does not seem to anticipate that once the project is complete, common areas are
conveyed to the HOA and bonds are released, the HOA would assume the responsibility for
maintenance of the Stormwater facilities
2) This project is unusual in that the pond being used for stormwater storage is existing and owned by
the Forest Lakes HOA. In my discussions with John he indicated that the county would be looking to the
HOA for maintenance of the pond and my client would be responsible for construction and
maintenance of the facilities on Timberwood Square.
If my understanding of these issues is correct I would propose that the language in the agreement be
modified accordingly. If you agree, please direct me on how you would like to make the changes. Our
project attorney with county attorney review?

method c =0.4, 190 Ac. DA. We need it. If not in the H&H report (it may be), please provide .PDF of

hydrograph/s of 1988 post -developed, c =0.4, 190 Ac. watershed, Engineering will update the reports. It
is essential to be able to compare 2019 post with 1988 post. I simply cannot locate it.

I've reviewed SUB2019-109, and have the following Planning comments:
1. Note 12 lists "SO" instead of "SP".
2. Note 13: Please label the setbacks as "Commercial per 18-4.20" and "Residential per 18-
4.19".
3. Clarification question: The final site plan SDP2018-87 shows a shared access easement
and parking easement for both the commercial lots and the townhomes. This easement
plat appears to show that easement on Sheet 3. Please clarify if this easement is for
stormwater management access only or for the shared access/parking easement.
a. Easements for the townhomes can be completed at the subdivision plat stage.
However, if the shared parking/access easement for the townhomes is being
done now, then the other easements should be done as well (drainage,
landscaping, etc.), and the HOA documents should be completed.
b. SWM easements can be completed separately now, since they are for the whole
site, and are needed for final site plan approval.
4. All private/non-ACSA easements for the commercial uses need to be completed before
final site plan approval. Looking at SDP2018-87, I see a proposed private waterline
easement and a proposed access/parking easement. If not already completed, a shared
parking agreement is needed for the commercial uses prior to site plan approval. All
required deeds/agreements are needed. These need to be completed prior to final site
plan approval because no subdivision plat is needed for the commercial uses.
To summarize:
1. All private/non-ACSA easements for the commercial uses on TMP's 46134-7A, 713, and 7C
need to be completed prior to final site plan approval. All deeds/agreements are
required. Those easements can be done with this plat.

a. Easements for the townhomes can be completed at the subdivision plat stage.
However, if the shared parking/access easement for the townhomes is being

site, and are needed for final site plan approval.

It's fine to have it somewhat piecemeal- I just want to clarify what the easement on Sheet 3 is for. Is it
access for SWM only, or also the shared parking/access for the commercial and townhomes? If this

With plat at point of approval, Engineering needs deed bk.-pg. reference for Maintenance Agreement for
the on -site BMP practice (biofilter). I understand Bob is working with Ana on the Maintenance
Agreement. Ana will let us know when the Agreement is approved, at which point Engineering records
the Maintenance Agreement, then formats the deed (which includes ref. to Agreement bk.-pg.), then sends
deed and .PDF of plat to the county attorney's office (CAO) for review /comment prior to distributing
deed to Applicant for notarized signature/s. CAO does not review plats /deeds until all CDD staff -level
review comments are addressed. They have been. A few steps to go —thanks for your patience.

There is no objection from Planning either. It seems like an unnecessarily large area is shown for the
SWM access easement, but if that is the preference for the application, then that is fine.
A separate easement plat will be needed for the other easements, and all easements for the commercial
portion will need to be approved before the site plan can be signed. The easements for the residential
portion can be done with the final plat.

With plat at point of approval, Engineering needs deed bk.-pg. reference for Maintenance Agreement for
the on -site BMP practice (biofilter). I understand Bob is working with Ana on the Maintenance
Agreement. Ana will let us know when the Agreement is approved, at which point Engineering records
the Maintenance Agreement, then formats the deed (which includes ref. to Agreement bk.-pg.), then sends
deed and .PDF of plat to the county attorney's office (CAO) for review /comment prior to distributing
deed to Applicant for notarized signature/s. CAO does not review plats /deeds until all CDD staff -level
review comments are addressed. They have been. A few steps to go —thanks for your patience.

There is no objection from Planning either. It seems like an unnecessarily large area is shown for the
SWM access easement, but if that is the preference for the application, then that is fine.
A separate easement plat will be needed for the other easements, and all easements for the commercial
portion will need to be approved before the site plan can be signed. The easements for the residential
portion can be done with the final plat.

There is no objection from Planning either. It seems like an unnecessarily large area is shown for the
SWM access easement, but if that is the preference for the application, then that is fine.
A separate easement plat will be needed for the other easements, and all easements for the commercial
portion will need to be approved before the site plan can be signed. The easements for the residential
portion can be done with the final plat.

I just spoke with Dustin. We need to replace page 1 of deed sent Friday with page 1 of deed sent today,
that's it. Please returned signed /notarized deed, county will execute, Planning will authorize plat, and
CDD will notify you that deed + plat are available for pickup /recordation. Once recorded (please do this
asap), county needs email /.PDF of circuit court receipt with deed bk.-pg. reference. Then, Engineering
can load data in DEQ database, then DEQ will send request for payment of state -portion of VPDES fee,
and once Engineering receives email receipt of payment of DEQ permit fee, you may request pre -

the on -site BMP practice (biofilter). I understand Bob is working with Ana on the Maintenance
Agreement. Ana will let us know when the Agreement is approved, at which point Engineering records
the Maintenance Agreement, then formats the deed (which includes ref. to Agreement bk.-pg.), then
sends deed and .PDF of plat to the county attorney's office (CAO) for review /comment prior to
distributing deed to Applicant for notarized signature/s. CAO does not review plats /deeds until all CDD

To summarize:

With plat at point of approval, Engineering needs deed bk.-pg. reference for Maintenance Agreement for
the on -site BMP practice (biofilter). I understand Bob is working with Ana on the Maintenance
Agreement. Ana will let us know when the Agreement is approved, at which point Engineering records
the Maintenance Agreement, then formats the deed (which includes ref. to Agreement bk.-pg.), then
sends deed and .PDF of plat to the county attorney's office (CAO) for review /comment prior to
distributing deed to Applicant for notarized signature/s. CAO does not review plats /deeds until all CDD

There is no objection from Planning either. It seems like an unnecessarily large area is shown for the
SWM access easement, but if that is the preference for the application, then that is fine.
A separate easement plat will be needed for the other easements, and all easements for the
commercial portion will need to be approved before the site plan can be signed. The easements for the
residential portion can be done with the final plat.

Good morning. The owner of the above project and their banker would like to meet
briefly with you to get an update on the project status. As you may know, we have
received VSMP approval and are waiting for the letters of credit to secure the
bonds necessary to proceed with our grading permit. The bank is new to the
development process and would like to hear from you first hand. If possible, I
would also suggest that Ana join us in order to provide direction for the letters of
credit. Please let me know if you are available next week.

I've reviewed SUB2019-109, and have the following Planning comments:
1. Note 12 lists "SO" instead of "SP".
2. Note 13: Please label the setbacks as "Commercial per 18-4.20" and "Residential per 18-4.19".
3. Clarification question: The final site plan SDP2018-87 shows a shared access easement and
parking easement for both the commercial lots and the townhomes. This easement plat appears
to show that easement on Sheet 3. Please clarify if this easement is for stormwater
management access only or for the shared access/parking easement.
a. Easements for the townhomes can be completed at the subdivision plat stage. However,
if the shared parking/access easement for the townhomes is being done now, then the
other easements should be done as well (drainage, landscaping, etc.), and the HOA
documents should be completed.
b. SWM easements can be completed separately now, since they are for the whole site,
and are needed for final site plan approval.
4. All private/non-ACSA easements for the commercial uses need to be completed before final site
plan approval. Looking at SDP2018-87, I see a proposed private waterline easement and a
proposed access/parking easement. If not already completed, a shared parking agreement is
needed for the commercial uses prior to site plan approval. All required deeds/agreements are

I wanted to pass along my review comments for SUB2019-109, easement for Timberwood Square (I just
sent them to Will White, the contact at Roudabush). I checked with my supervisor, and we do need all
private easements for the commercial uses/parcels done before final site plan approval. The townhouse
easements can wait until the subdivision plat stage, but they should all be done together (except SWM
can be done now, since it's for the whole site).
Looking at the final site plan, I saw a private waterline and shared parking for the commercial uses — not
sure if there are any other private easements I missed, but those need to be done before the site plan is
approved. They can also be done with this plat. If you want to do the overall shared parking/access
easement at the subdivision stage, that is fine, but we do need the shared parking agreement for the
