Notes:
1. This boundary is based on a current field survey with lines established i.a.w. physical evidence and recorded deeds and plats.
Inconsistancies found in the research of common boundaries of adjoining tracts have been noted on this plat per DPOR Reg's
Sect. 18 VAC 10-20-370.
2. This parcel is in Flood Zone X (outside the 0.2% chance annual flood plain) per Flood Insurance Rate Map Community -Panel
51003CO475D for Albemarle County w/ Effective Date 2/4/2005.
3. Family Lot D is assigned 2 development rights and when further divided these rights shall not comprise more than 5.998 acres.
The residue of TM 94-27A is retaining 3 development rights and when further divided these rights shall not comprise more than
6.777 acres. The development rights used are within the limits of the 1980 boundary of their parcel of origin.
4. Corner monumentation is as noted.
5. These lots are zoned RA. Minimum lot size is 2 acres. Minimum road frontage is 250' on Rte. 759 & 150' on the 20' new private
street. The minimum building setbacks are 75' from the edge of the 50' right-of-way for Rte. 759, 25' from the edge of the 20'
new private street, 25' sides, and 35' rear. Accessory structures can be a minimum of 6' from side and rear tot lines per Sect.
4.11.2 (b) of the Albemarle County Zoning Ord. Lot width can not be less than 250' at the 75' setback from Rte. 759 & 150' in
a building area adjoining the 20' new private street.
6. The septic setback is 100' from all streams and the stream buffers shown hereon will be managed in accordance with the Alb.
Co. Water Protection Ordinance. The stream buffers shown hereon were inspected & modified by Alb. County on 5/4/2018.
7. Family Lot D & the residue of TM 94-27A each contain a building site that complies with Sect. 4.2.1 of the Alb. County Zoning
Ordinance.
8. Family Lot D & the residue of TM 94-27A are within the Mechunk Creek watershed & do not lie within a water supply protection
area or an agricultural -forestal district.
9. Under current policy public water and sewer will not be available to these lots.
10. Family Lot D & the residue of TM 94-27A are subject to a 20' easement for buried utilities to Va. Tel. & Tel. (Sprint - 6200
Sprint Pkwy., Overland Park KS 66251) in DB 550-203. These lots are also subject to an unrecorded 40' easement for overhead
utilities per CVEC (P.O. Box 247, Lovingston VA 22949). These lots are also subject to a 50' right of -way to the Commonwealth
Of Va. in DB 1024-41 for State Route 759 "being measured 25 feet either side of the center of the road" together with required
drainage ditches and any easement adjoining the right-of-way for relocation, construction, operation, and maintenance of a public
utility upon demand of a public utility company.
11. The proposed 20' new private street is of adequate width and horizontal and vertical alignment to accommodate a travelway
passable by ordinary passenger vehicles in all but temporary extreme weather conditions, together with area adequate for maint-
enance of the travelway, as required by section 14-412 of the Albemarle County Code. The proposed 20' new private street in this
subdivision may not meet the standards for acceptance into the secondary system of state highways and will not be maintained by
VDOT or the County of Albemarle. The proposed 20' new private street easement holders will be Michael W. Perkins, Sr., Connie
N. Perkins, & Michael W. Perkins, Jr. A Private Street Maintenance Agreement will be recorded simultaneously with this plat.
12. No lot shown on this family subdivision plat may be sold or conveyed to a person other than an eligible 'member of the immediate
family', as that term is defined in Chapter 14 of the Albemarle County Code, for a period of four (4) years after the date of record-
ation of this plat except as authorized by section 14-212(A) of the Albemarle County Code. If any lot created by the recordation
of this plat is conveyed back to the grantor during the four (4) year period, it shall be recombined with the parent lot within six (6)
months after such conveyance.
