HomeMy WebLinkAboutSUB201900149 Review Comments Final Plat 2019-11-07County of Albemarle Department of Community Development 401 McIntire Road, Charlottesville, VA, 22902 434-296-5832 Memorandum To: William White From: Christopher Perez, Senior Planner Division: Planning Date: 11-7-19 Subject: SUB201900149 Dorrier Drive - BLA The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [14-302(B)5] Zoning Classification. Add the Entrance Corridor (EC) to the zoning overlay. 2. [14-302(A)10] Right of Further Division of Proposed Lots. Note #16 is incorrect. I offer the following revised note: "Tax Map/Parcel 62-31A is retaining I development right and may not be further divided. Tax Map/Parcel 62-24B is retaining 1 development right and may not be further divided. 3. [14-309 & 14-3101 Soil evaluations; Health Director Approval of Wells and Septic Systems. Prior to final subdivision plat approval each lot shall have a primary and reserve drainfield location and individual well approved by the Health Department. The drainfield exhibit was forwarded to the Health Department for their review/approval. See attached review comments from the Health Department. 4. [14-316] Attached is VDOT's review and approval of the request. [18-6.1, 18-6.4(E)] To ensure the Boundary Line Adjustment (BLA) requested under SUB201900149 would decrease the total nonconformities of the Property and may be pursued under Albemarle County Code 18-6.1 staff requested the Zoning Administrator conduct an official determination of the parcels. It was determined that due to the favorability of decreasing the total number of nonconformities, and the favorability of reducing the potential of an additional nonconformity, the proposed BLA may be permitted under 18-6.4(E), provided it meets all other County requirements. We are notifying the owner of the Letter of Determination (LOD) that was requested in order to be able to review the subdivision application. Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which may be found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14- 229(B) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer. DO NOT CLICK on links or open attachments unless you are sure the content is safe. Chris, I am reviewing the proposed boundary line adjustment between TM 62-31A & 62-24B. A search of our records did not reveal any existing septic permits for either of the dwellings. The plat included with the proposal mentions an approximate drainfield location for TM 62-24B but a reserve area will need to be delineated. The plat also depicts an "expected drainfield location" on TM 62-31A but it's not clear what that means. The existing drainfield that serves 401+ Dorrier Drive will need to be located and an adequate reserve area delineated. I cannot approve the proposed boundary line adjustment based on the information supplied. The applicant and surveyor is welcome to contact me if they have any questions, thanks. Travis T. If further information is desired please contact Willis C. Bedsaul at (434) 422-9866. A VDOT Land Use Permit will be required prior to any work within the right-of-way.
