The above property is the same which was conveyed to the Grantors herein by deed of HM Acquisition Group, LLC, dated August 27, 2009 and recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, just prior hereto. This conveyance is made subject to the deed of trust ("Deed of Trust") from HM Acquisition Group, LLC, a Virginia limited liability company, to Alexander Title Agency, Incorporated, Trustee, dated August 16, 2005 and recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, in Deed Book 3050, page 703. The Grantee does not assume the obligations secured by this deed of trust. This conveyance is subject to all easements, reservations, restrictions, conditions and other encumbrances contained in duly recorded deeds, plats and other instruments constituting constructive notice in the 91 chain of title to the above -described property which have not expired by a time limitation contained therein or have not otherwise become ineffective.
