This is very troublesome to myself and my client. This delay is potentially costing my client money as well as her negotiating position. I relayed what you said to me on Monday regarding redrawing the subdivision line to exclude existing parking. My client does not prefer this alternative for a variety of reasons. You mentioned a Special Use Permit (SUP) would be required to proceed. Can you,until Patrick's comments eventually appear, further explain this option. In other words, is this the same SUP needed for her VETS office building, or an SUP for just the subdividing of that parcel? Further, if an SUP is required for just the subdivision, we'd like to know if a waiver application is possible as the pending ruling is causing a hardship to my client in terms of not being able to proceed with the purchase based on the stand-alone parking determination. That parcel was always intended to have another building. My client's pursuit should not suffer because the developer of that site went ahead and put in additional parking for the future building. I trust you understand our logic. Finally, I would like to know the recourse of what has happened here other than a reprimand of your Staff member. We were told comments would be received on 4/14/08. As of this writing(4/30/08), still no receipt of written comments, contacts from Patrick regarding our application being "pulled" from Site Review (I learned of this when meeting with Francis MacCall on another matter), or overall guidance. We find this behavior both unacceptable and generally unprofessional. With this said, we remain focused on moving forward and would appreciate being informed, in a timely manner, as to potential outcomes of my client's creative use of this parcel.
