This was a boundary line adjustment to TMPs 46-19A1 and 46-19A2. The parcel boundaries and acreages shown on the current plat under review do not match the adjustments that were approved with SUB201900063. Please address the following: a. Property records from Albemarle County GIS do not indicate that the most recent subdivision approval for TMPs 46-19A1 and 46-19A2 was the two -lot division (SUB201800188) creating what is now known as TMP 46-19A2. This was recorded in DB 5150 pages 40-47. For purposes of this review, staff comments will assume that SUB201900063 was not recorded, and the parcel data/boundaries as shown in DB 5150, pp. 44-47 is correct. Rev. 1: Comment addressed. b. Was SUB201900063 ever recorded? If so, please send staff the deed book and page number of the recorded instrument. Rev. 1: Comment addressed. c. If SUB201900063 was recorded, the parcel boundaries of TMPs 46-19A1 and 46-19A2 shown on the existing boundary conditions (Sheets V2 and V3) should match the recorded instrument. Rev. 1: Comment addressed. d. If SUB201900063 was recorded, the recorded instrument number should be stated in the property labels of TMPs 46-19A1 and 46-19A2 on Sheets V2 and V3. Rev. 1: Please add DB 5169, page 235 to the nronertv label for TMP 46-19A2 on Sheet V3. Rev. 2: Comment addressed. e. If SUB201900063 was recorded, the acreages stated in the property labels of TMPs 46-19A1 and 46-19A2 should match the recorded instrument on Sheets V2 and V3. Rev. 1: Comment addressed. 2. [General Comment] Due to the number of plats and deeds that are being recorded with the Albemarle County Clerk's office, it is difficult to track what plats and deeds apply to each parcel. Please provide a note for each parcel that lists all recorded instruments (plats, deeds, etc.) for TMPs 46-18, 46-18A, 46-19A1, 46-19A2, and 46-19133. Rev. 1: Comment addressed. [14-303 (D)] Pending applicant response to comment #1, please revise the Area Summary on V1 so that existing and revised acreages are correct. a. Based on the most recently known recorded plat (DB 5150, pages 40-47), TMP 46-19A2 measures 10.615 acres. Rev. 1: Comment addressed. 4. [14-302 (A)(1)] This plat is a two -lot division proposing to create a 2.540 acre parcel in Block 3A of Brookhill. It is also dedicating land previously reserved for future dedication to public use for street right- of-ways, as well as creating easements to serve Block 3A. Please revise the plat title to something like "Brookhill Block 3A Two -Lot Division, Easement, and Dedication Plat." Rev. 1: Comment not fully addressed. Please add TMP 46-19133 to the title bar. Rev. 2: Comment addressed. [General Comment] Per previous conversations between Alan Taylor (Brookhill developer) and County staff, the developer has indicated that the road names of Stella Lane and Archer Avenue need to be switched. Staff informed the developer that this can be done so long as the names are shown on the plat dedicating the right-of-way to the County. Staff has noticed that the road names have not been switched on this plat. If Stella Lane right-of-way is dedicated, the names can't be switched at a later date. Please work with the developer to ensure that the road names shown on this plat reflect the names the developer wants. Rev. 1: Comment addressed. 6. [General Comment] On Sheet V3, please remove the words "Area Within TMP 46-19133 Revised: 2.242 AC" from the callout for the Stella Lane reserved right-of-way. Rev. 1: Comment addressed. 7. [14-302 (A)(1)] In order to clearly indicate was is shown on each sheet of this plat, please re -title Sheets V6 and V7 to "Existing and Proposed Easements." Rev. 1: Comment addressed. a. [14-302 (A)(4)] Please show and label all existing and proposed private easements. State the recorded instrument number in the label. Rev. 1: Comment addressed. a. Currently, some existing easements are shown on Sheets V2-V5, but not all. Please either show all existing easements across all drawings, or only show existing and proposed easements on Sheets V6-V7. The 30' private landscape buffer easement on TMPs 46-18 and 46-18A (as recorded on plat in DB 5121, pages 644-675 and deed of dedication recorded in DB 5121, pages 689-701) are not shown on Sheets V6 and V7. [14-302 (A)(4)] On all applicable drawings, please show the location of the existing private easement recorded in deed book 459, pages 3-4. [14-302 (A)(7)] On all applicable drawings where shown, please make the dashed departing lot lines darker so that they are clearly visible. Rev. 1: Comment addressed. 14. [14-302 (A)(15)] Please state the names and addresses of the easement holders for the existing 50' easement recorded in deed book 459, pages 3-4. Rev. 1: Comment addressed. [14-302 (A)(5) and 14-303 (L)] On all sheets, please show and label the land reserved for future dedication to public use upon demand by the County: a. [14-302 (A)(11)] The statements of title on Sheet VI make reference to recorded instruments for each parcel that are not the most recent recorded instruments. Please revise so that they make reference to the most recently recorded instrument for each parcel. Based on staff research the most recently recorded instruments for are listed below. Please provide documentation if there are more recently recorded instruments other than those mentioned below: a. TMP 46-18 = DB 5121, pages 689-701. Rev. 1: Comment not fully addressed. Staff appreciates the research and follow up on this comment. However, the comment response letter states that the most recent plat for this TMP is DB 4997, page 724. The plat recorded in DB 5121, page 644 is more recent and that plat reserved ROW along Polo Grounds Road. Also. if the deeds of dedication for various easements will be mentioned in the statements of title for other TMPs, this statement should include reference to applicable easements deeds as well. Rev. 2: Comment addressed. b. TMP 46-18A = DB 5121, pages 689-701. Rev. 1: Comment not fully addressed. Staff appreciates the research and follow up on this comment. However, the comment response letter states that the most recent plat for this TMP is DB 4997, page 724. The plat recorded in DB 5121, page 644 is more recent and that plat reserved ROW along Polo Grounds Road. Also, if the deeds of dedication for various easements will be mentioned in the statements of title for other TMPs, this statement should include reference to applicable easements deeds as well. [14-302 (B)(5)] The zoning classification note (Note 5) on Sheet V1 is missing information for several parcels affected by this plat, and the zoning information is incomplete for the parcel numbers currently referenced in the note. The base zoning district, all applicable overlay districts, rezonings, proffers, and special use permits that apply to TMPs 46-18, 46-18A, 46-19A1, 46-19A2, and 46-19133 must be stated on Sheet V 1. Individual notes for the zoning classification can be added for each parcel, or note 5 could be revised so that it clearly states the applicable zoning information for each parcel in separate lines/sentences. a. TMP 46-18 is zoned Neighborhood Model District (NMD) and is subject to the Code of Development of ZMA201500007, the proffers of ZMA201800011, and SP201500025. It lies within the EC -Entrance Corridor Overlay and the AIA- Airport Impact Area Overlay. Portions of TMP 46-18 lies within the Managed and Preserved Steep Slopes Overlay District.
