Subject: SUB-2019-175 Northside Drive Material Recovery Facility— Easement Plat
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat
referenced above once the following comments have been addressed: [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
[14-302 (A)(4) & 14-302 (A)(5)] Private easements; Public Easements. Address the
following:
a. The three submitted legal documents (Certificate of Plat, Deed of Easement &
Vacation of Easements) do not have signature pages for all the owners. There is
no signature page for Kerry Hall Allorto in any of the documents. Revise all legal
documents to include a signature page for the Kerry Hall Allorto.
b. These legal documents must be reviewed by the County, approved, a signed &
notarized copy submitted to the planning reviewer, and recorded with the
easement plat.
c. The recordation receipt for recordation of the plat and all three of these legal
documents must be provided to the planning reviewer prior to final site plan
approval.
[14-302 (A)(5) & 14-303 (L)] Public Easements; Public utility, drainage and sight
distance easements. Address the following in reference to the deed for sight distance
easement:
a. See comment #1 a) for comments in reference to the owner's signature pages on
all legal documents including the deed for the sight distance easement.
b. Please see the attached redline markup from the County Attorney's office with
additional revisions that need to be made to the Deed of Easement for Sight
Distance. This includes, but is not limited to, including a signature page for the
County.
c. The sight distance easement, and the Deed of Easement for the sight distance
easement, must be approved by VDOT prior to easement approval.
d. The revised Deed of Easement must be reviewed by the County, approved, a
signed & notarized copy submitted to the planning reviewer, and recorded with
the easement plat.
[COMMENT] See attached zoning comments. Please note that the site plan comment #8
e) ii., about providing an instrument that will assure continuation of the off -site parking, has
not yet been addressed and no easement for off -site parking has been shown on this
easement plat. If this site plan comment will be addressed by way of an easement, then
either add an off -site parking easement to this plat or submit a new plat (with a new
application and fee) that creates the easement. Ensure that all associated legal
agreements are submitted for review and approval.
4. [COMMENT] See the attach comment from most of the other reviewers. VDOT comments
are still pending and will be forwarded to you when they become available.
