This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer submits a final plat for all or a portion of the site within one (1) year after the date of this letter as provided in the Section 14-226 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final plat. The final plat will not be considered to have been officially submitted until the following items are received: 1. A final plat that satisfies all of the requirements of section 14-303, 14-304 through 14-318, and 14-400 through 14-441 of the Code, and the conditions attached to this letter. 2. Applicable fee outlined in the application. Please submit 13 copies of the final plat, 4 if a digital submittal, to the Community Development Department. The assigned Lead Reviewer will then distribute the plat to all reviewing agencies (for ACSA, please submit 3 copies of the plat directly to them, as stated in their comments). Once you receive the first set of comments on the final plat, please work with each reviewer individually to satisfy their requirements. [14-306] Private Street. The proposed private street must be designed to meet the County's standards for all streets and private streets (see Sec. 14-410 and Sec. 14-412). The County has received a private street request as well as a request for variation or exception to the curb and gutter requirements of Sec. 14-410. These materials will be reviewed by staff. 2. [14-302(B)(5), SP200400028] Zoning information. a. Include in the Zoning notes on the Cover Sheet that the property is subject to multiple zoning overlay districts — Entrance Corridor and Managed Steep Slopes. b. Depict on the plat map, areas of the property that are designated managed steep slopes. c. List the two approved special use permits for this property - SP200100046 and SP200400028 AND include the proffers associated with the most recent SP200400028 (see attached action letter). d. Also note the concept plan notes taken from the plans entitled "Snows Storage Yard" revision date of 7/23/04 by David Wyant, P.E., associated with SP200400028. Those being: i. All buildings covered with light gray siding. ii. Light on side of entrance door to back buildings. iii. All fences visible from Avon St shall be 8' high wood fence. iv. All mechanical equipment and dumpsters will be in screened lots. v. No stored items greater than 8' in height will be allowed in the front 8 lots or the southernmost lot in the back row. vi. Two loading areas provided as by code and for use of tenants in loading and unloading supplies, equipment, etc. vii. 2 inch depression around all drainage drop inlets. 3. [SP200400028] Landscaping. This site has been developed in accordance with an approved site plan - SDP200400057 - which amended the concept plan associated with the approved special use permit. Provide an exhibit that demonstrates that the existing landscaping provided onsite is in alignment with the approved site plan so that newly created parcels will not be in violation of the site plan upon approval of the final plat. 4. [Comment] Parking. Provide an exhibit that demonstrates that parking requirements for each building/structure are met within each proposed lot. [ 14-302(B)(8), 18-4.20(b)] Yards. a. The front setbacks for the property are: i. 50ft building setback, as prescribed by the concept plan for SP200400028. ii. 1 Oft from exterior edge of the sidewalk if the sidewalk is outside of the right-of-way; for off-street parking or loading spaces b. Amend the second line in the side and rear setback notes to reflect Sec. 4.20, whereas: "If the abutting lot is zoned commercial or industrial, any primary structure shall be constructed and separated in accordance with the current edition of the Building Code. " c. Under the Stepback notes, review and revise for possible spelling errors. 6. [14-302(A)(4, 5, and 15)] Public and private easements. a. Are easements shown on the plat existing or proposed? If existing, include a deed book and page number reference as well as the name of the easement holder. If proposed, label accordingly. b. Is there a deed book instrument for the current accessway being provided to the subject property through TMP 90-35Y? If so, include the deed book reference on the plat. c. Indicate the extent of the proposed 30ft private street. This may be a matter of labeling existing linework. 7. [14-302(A)(3)] Existing street. Provide the width measurement of Avon St Ext. 8. [Comment] Sheet name. Revise the title for Sheet C3, as this application is not for a site plan. 9. [14-302(B)(1)] Sheets. Note the total number of sheets provided within the plat on the cover sheet. 10. [ 14-302(A)(7)] Departing lot lines. Show the departing lot lines of abutting properties, particularly along Avon St Ext. 11. [ 14-303] Contents of a final plat. Once the preliminary plat is approved, a final plat meeting all of the requirements of a final subdivision plat will need to be submitted for review/approval. 12. [Comment] Signatures. Since access to the proposed lots be provided by TMP 90-35Y, owner notarized signatures of the owner(s) of TMP 90-35Y will need to be provided on final plat for this subdivision. 13. [Comment] Instrument evidencing maintenance. Before a final plat can be approved, an instrument evidencing maintenance of the private street will be required. An approved and bonded (if improvements are required) road plan will be required, along with a request for a private road. The road plans will need to show the adequacy of the existing road and any necessary improvements. 2. An approved and bonded VSMP plan if any road improvements are needed disturbing over 10,000sf. 3. Include a turnaround in the private road easement and show the offsite road easement from the property line to the VDOT ROW. ISO fire flow calculations must be provided. 6. A knox box will be required on each building.
