(SUB-2019-00169 Minor Amendment to 5` Street Commercial Easement Plat / TMP #76-55A and
76M1-1)
A review of the above -referenced plat (dated 11/22/2019) has been completed by Planning Division staff
in Albemarle County's Community Development Department (CDD). This review was completed using
the sections listed under Albemarle County Code Chapter 14 ("Subdivision Ordinance") Section § 14-207.
Pursuant to Subdivision Ordinance Sections § 14-207 and § 14-209, the application for the above -
referenced final plat is disapproved. As shown, the proposed easement plat (SUB-2019-00169, dated
10/18/2019) is not permissible due to insufficient information as required by the Zoning Ordinance;
additionally, other issues have been identified, as described in the attached review comment letter (dated
11 /22/2019).
Please also note that this decision may be appealed in accord with Albemarle County Code § 14-231.

Subject: SUB201900169 5'1i Street Commercial Development — Easement Plat
A review of the above -referenced final plat (dated 10/18/2019) and associated documents has been completed
by Planning Division staff in Albemarle County's Community Development Department (CDD). This review
was completed using the sections listed under Section § 14-207 of the Subdivision Ordinance. Staff has provided
references to Chapter 14 (Subdivision Ordinance) and/or Chapter 18 (Zoning Ordinance) of the County Code
preceding each comment. The County Code is kept up-to-date by the County Attorney's office and may be
found at www.albemarle.or count,, cam.
Pursuant to Subdivision Ordinance § 14-207 and § 14-209, the application for the above -referenced final plat
is disapproved. Please see the corresponding "Action Letter — Notice of Disapproval" (dated 11/22/2019).
1. [14-302 (A)(2)] Please provide a vicinity map. A map at a scale of one (1) inch equal to two thousand
(2,000) feet showing the property and its relationship with adjoining land and streets, its relationship
with landmarks in the area and.
2. [14-302 (A)(4) and 14-302 (A)(5)] The plat does not show many existing easements located on TMPs
76-55A and TMP 76M1-01. Please add language stating that there may be other easements on both
properties not shown on the plat, or show all existing easements and label by their type, whether they
are public or private, and state the recorded instrument numbers.
a. State the deed book and page number for any deeds that were recorded for existing easements.
[14-302 (A)(5), 14-314] As required by Proffers #5 and #8 approved with ZMA2012-07, please submit
a revised deed of dedication and easement for the new public access easements. This will replace the deed
of dedication and easement for the 15' public access easement recorded in deed book 5013, pages 265-
274. The new deed should mention that it is replacing the previously recorded deed of dedication for the
revised 15' public access easement, and that the revised easement shown on this plat is dedicated to the
County for pedestrian and vehicle use.
4. [14-302 (A)(11)] Please state all recorded instruments for TMPs 76-55A and TMP 76M1-01. The labels
on the drawings do not state the most recently recorded plats/deeds for either TMP.
5. [14-302 (A)(14)] Please state the acreage of the existing 15' public access easement that will be vacated,
and the new total acreage of the revised 15' public access easement that will be dedicated to public use.
6. [14-302 (A)(15)] Please identify all owners and certain interest holders in notes on the plat. This
includes the names and addresses of each owner of record and holders of any easements affecting the
property.
a. The easements can either be drawn and labeled with all pertinent information, or notes can be
provided stating the easement type, owner, and recorded instrument for all existing easements.
7. [14-302 (B)(5)] Please revise the Zoning note so that it states all applicable primary zoning districts,
overlay zoning districts, and proffers, special use permits for both TMP 76-55A and TMP 76M1-01.
a. TMP 76-55A is zoned HC Highway Commercial. The property is located within the AIA
Airport Impact Area Overlay Zoning District, the EC Entrance Corridor Overlay District, the
FH Flood Hazard Overlay District, and portions of the property are located within the Preserved
Steep Slopes Overlay District. The property is subject to the approved application plans and
proffers of ZMA201200007. The property is subject to the approved conditions of SP2007-63.
b. TMP 76M1-1 is zoned LI Light Industry. The property is located within the AIA Airport
Impact Area Overlay Zoning District, the EC Entrance Corridor Overlay District, and portions
of the property are located within the Managed and Preserved Steep Slopes Overlay Districts.
The property is subject to the approved application plans and proffers of ZMA201200007. The
property is subject to the approved conditions of SP2007-63.
8. [14-302 (B)(7)] Please add notes stating whether TMPs 76-55A and 76M1-01 are located within an
Albemarle County and/or City of Charlottesville water supply watershed or an agricultural -forestal
district.
9. [14-302 (B)(9)] Please show the location of any part of the property within the flood hazard overlay
district, as set forth in section 18-30.3. State the source used to determine the boundaries of the flood
hazard overlay district in a note.
10. [14-302 (B)(10)] Please show the location of stream buffers required by the water protection ordinance
and state the source used to determine the stream buffer location.
a. Add the following note: "The stream buffer(s) shown hereon shall be managed in accordance
with the Albemarle County Water Protection Ordinance."
11. [14-302 (B)(1)] Please add a date of last revision to the plat.
12. [14-303 (A)] Please state the TMP numbers in the statement to consent of division. Clearly describe
what the plat is doing (i.e. vacation of portion of existing public access easement and platting and
dedication of access easement to public use).
13. [14-303 (C)] Please provide the exterior boundary lines of the property with bearings in degrees,
minutes and seconds. Curvilinear data shall include radius, central angle, arc length, and tangent
distance. All dimensions shall conform to the standards set forth in this chapter.
14. [14-303 (E)] The lines and curve lines shown for the revised access easement do not indicate where
each measurement ends. Please clearly label start and end points for each line and curve measurement.
a. There are also some dimensions of the revised easement that are not currently measured. Please
provide this information.
15. [14-303 (H) and 14-4211 Provide a legend identify all permanent reference monuments identified on the
plat (i.e. IF = Iron Found, etc.).
16. [14-303 (L)] Show the location and dimensions of each public utility, drainage and sight distance
easement outside of a street right-of-way; for each existing easement, include a note stating the deed
book and page number.
17. [14-303 (0)] TMP 76M1-01 is not owned by FTV Investments LLC according to Albemarle County
GIS. A signature panel for FAAV Management LLC must be provided under the owner's consent to
division.
18. [14-207 and 14-2031 The application has been denied due to the deficiencies identified in this comment
letter. In order to proceed, a new easement plat and application fee will need to be submitted in
accordance with Sections 14-207 and 14-203. A revised plat addressing the comments contained in this
letter cannot be resubmitted and reviewed under this same application number, SUB201900169.
