Main Street Suite 400 Charlottesville VA, 22902 Fax (434) 972-4126 RE: LZC201900034 - Parcel ID 06100-00-00-124CO (1.21 Acres) (the "Property"), Owner —, EAST RIO COURT LLC, 1101 30TH ST NW SUITE 210 WASHINGTON DC, 20007 Mrs. Long: In response to your request for a Letter of Zoning Compliance for the above -referenced Property, please be advised of the following: The Property is zoned PDMC, Planned Development Mixed Commercial ("PDMC") established with ZMA1996-00004 approved on July 17, 1996, and is subject to the approved proffers and applicable subsections of Section 25A of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The Property is subject to the Airport Impact Area ("AIX) Overlay District, Entrance Corridor ("EC") Overlay District, and the Steep Slopes Overlay District, as described in Section 30 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). • The permitted uses of the Property are provided in the approval letter for ZMA1996- 00004 (linked). Offices are permitted by -right within this PDMC district. • A television broadcast studio is permitted as a by -right office use on the Property. A Zoning Clearance will be required for the use. Any satellite dish structure on the Property used in conjunction with the operation of the television broadcast studio must be receive -only satellite dish structures for them to remain by -right accessory structures. A previously determination stated that, for satellite dish structures to remain by -right accessory structures, they may only receive signals that are then broadcast from within the television broadcast studio over existing cable or fiber-optic lines and not from any proposed satellite dish structures. Satellite dish structures that transmit signals require a special use permit to operate. • The Property is subject to site plan SDP1996-00100, approved 10/03/1996 and SDP1997-00091, approved 07/28/1997. The Property appears to be developed in accord with the approved site plan. Proposed changes to the site will require amendment of the site plan. • To the best of my knowledge, the Property is currently in compliance with all applicable requirements of the Zoning Ordinance. A review of our files found (i) no violations or November 8, 2019 LZC2019-00034 Page 2 alleged violations or regulations applicable to the Property, whether pending, contemplated or having already occurred, (ii) no applicable variances associated with the Property , (iii) no fees due or pending with respect to any matter before the County Community Development Department; and (iv) no pending application for rezoning of the Property, or for a special use permit or special exception or variance in connection with the Property. Further, no proceeding to challenge the zoning or other governmental approval or use of the Property is pending or, to the best of our knowledge, overtly threatened. The Property is now recognized as one or more separate parcels of land under the subdivision ordinance of the County of Albemarle, Virginia, and may be conveyed, leased, or mortgaged as one or more separate parcels and currently complies with such subdivision ordinance and other applicable subdivision laws. The Property is not subject to any conditions or special limitations imposed by the County of Albemarle, Virginia, in connection with any subdivision approval of the Property. • In the event of casualty, the Property may be rebuilt substantially in its current form (i.e., no loss of square footage, same building footprint) upon satisfaction of the following conditions and/or the limitations; site plan amendment if applicable, building permit approval and issuance, and compliance with both the approved proffers and Section 25A of the Zoning Ordinance. • Copies of any applicable records may be obtained via the noted links or from this office with a request through the department's Records Manager, Paul Bjornsen, at pbiornsen(a-)-albemarle.org once they have been approved or issued.
