I hereby withdrawal my recommendation of approval for SUB201700155.The following comment shall now be
addressed by the applicant:
• Sheet 17 of 19 depicts a proposed 20' storm water easement near the eastern property corner of TMP#093A1-
00-00-00200 which conflicts with the existing ACSA Landscaping Easement.The ACSA landscaping easement has
previously been granted and can be referenced in Deed Book 4597 Pages 747-756. Revise the proposed storm
water easement to eliminate the conflict.

Project Name: SUB2017-155 Rivanna Village—(Phases 1:Blocks A,B,C,Dl,E,and Fl)-Final Plat
Dear Mr. Blair:
The above development is permitted by ZMA2013-12 and it governed by the applicable Code of
Development(COD),Proffers,and Application Plan.The above referenced plat is being considered for
approval by this office;however,prior to approval an instrument evidencing maintenance of certain
improvements as required by Section 14-317 is required. They have provided the attached document in a
supplemental declaration of Covenants,Restrictions and Easements(C&R) document to cover
architectural review committee(COD 4.2),private alleys, stormwater management facilities,private
drainage easements,wall maintenance easement, and any other improvements that are to be maintained by
the HOA in perpetuity.
In addition to reviewing the attached C&R doc,please provide legal guidance on proffer#6 as to when the
trails and park improvements shall be constructed in relation to when the public dedication of the open
space to the County for public use shall take place.
