(The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] First Review Comments: 1. 132.5.2 (s)] Please add the application number, SDP201900045, to the project title on Sheet C-001. State that this is minor site plan amendment #1 in the title. Rev. 1: Comment addressed. 2. [32.5.2 (s)] In the signature panel on Sheet C-001, remove the Health Department and add Albemarle County Service Authority. Rev. 1: Comment addressed. 3. 132.5.2 (a)] Remove reference to SP201300027 in the Special Use Permit and Zoning Overlay notes on Sheet C-001. Rev. 1: Comment addressed. 4. 132.5.2 (s)] Please revise the project narrative on Sheet C-001 so that it explains all proposed revisions in Phase 1. This includes the revisions to the drive -through lane design, the revisions to the location of the paved asphalt vehicular and pedestrian travel way down to Moore's Creek, easement vacations/revisions, lighting changes, landscaping changes, etc. Rev. 1: Please revise the oroiect narrative so that it clearly states that this minor amendment onlv aertains to chances to phase 1 of SDP201700012 and all site improvements in phases 2 and 3 will be shown on a future site plan amendment to be reviewed and approved by the County. Rev. 2: Comment addressed. 132.5.2 (a)] Please provide the parcel boundary dimensions, and add a note to Sheet C-001 stating the instrument number of most recent plat of record. Rev. 1: The instrument referenced in the note is the deed of dedication for certain easements. The actual plat of record is recorded in DB 5013, pages 259-264. Please revise the instrument number in the note on Sheet C-001. Rev. 2: Comment addressed. [32.5.2 (a)] Revise the Zoning Overlay note on Sheet 1 so that it states that "portions of the property lie within the Preserved Steep Slopes Overlay District." Rev. 1: Comment addressed. 7. [32.5.2 (a) and ZMA201200007] The realignment of the 10' paved vehicle and pedestrian travel way down to Moore's Creek is within an existing 15' public access easement recorded on a plat in DB 5013, pg. 259-264 with a deed of easement in DB 5013, pg.265-274. The revised alignment of the travel goes outside of that easement. Per the approved proffer #5C of ZMA201200007, the existing easement will need to be vacated, and a new easement platted with an associated deed of dedication that dedicates the revised easement to Albemarle County for public use. a. Please submit an easement plat application for review and approval. Rev. 1: An easement plat, SUB201900169 was submitted to the Countv for review and approval and is in review as of October 29. 2019. Once this plat is reviewed, approved, and recorded and the minor amendment is revised to reflect the recorded plat, this comment will be addressed. Rev. 2: SUB201900169 was denied by Albemarle County on November 22, 2019 due to a high level of errors and missing information. Per the disapproval letter sent by staff on November 22, 2019, a new easement plat application and fee must be submitted, reviewed, approved, and recorded and then this comment will be addressed. b. Once approved and recorded, add labels to all applicable sheets showing the new easement boundaries and reference the instrument of the recorded plat and deed of dedication. Rev. 1: Comment stands. Rev. 2: Comment stands. 8. 132.5.2 (a)] On Sheet C-001, please add the Steep Slopes note as stated on Sheet 1 of SDP201700012. Rev. 1: Comment addressed. [32.5.2 (n)] On sheet C-201, please identify all existing and proposed improvements. The location and dimensions of all existing and proposed improvements including buildings (maximum footprint and height) and other structures; walkways; fences; walls; trash containers; outdoor lighting; landscaped areas and open space; recreational areas and facilities; parking lots and other paved areas; loading and service areas; signs; and the proposed paving material types for all walks, parking lots and driveways. If details or exhibits are provided on other sheets, state the sheet number in the label. Rev. 1: Comment not fully addressed. The callouts for the proffered travelway and the primitive trail connection do not reference the exhibits/details provided for these items on Sheet C-302. Please revise sheet C-201 so that it references those details. Rev. 2: Comment partially addressed. A callout has been added for the proffered travelway, but it says details 7 and 8 on Sheet C-302 pertain to this feature. Isn't detail #2 on Sheet C-302 the construction detail for the 10' travelway? If so, please revise the labels on Sheet C-201. Also, no callouts were added that identify which detail pertains to the primitive trail connection. Please add this information. 10. [32.5.2 (b)] Please add a note to the Site Data table on Sheet C-001 stating the maximum building height permitted, and the proposed building height in accordance with Section 21.4 of the Zoning Ordinance. Rev. 1: Comment addressed. a. Maximum building height permitted: sixty-five (65) feet. The minimum stepback requirements for any story that begins above forty (40) feet in height or for each story above the third story, whichever is less, in height shall be as provided in section 4.20. Rev. 1: Comment addressed. It. 132.6.2 (g)] Please provide a construction detail for the proffered 10' paved vehicle and pedestrian travel way down to Moore's Creek on Sheet C-301 or C-302. Rev. 1: Comment not fully addressed. The legend for the Pavement Detail on Sheet C-302 does not include the symbology used for the proffered travel way. Please revise. Also, reference the sheet and detail number in the callout for this feature on Sheet C-201. Rev. 2: Comment addressed. 12. [32.6.2 (g)] Please provide a construction detail for the proffered primitive trail connection from 5' Street to the 10' paved vehicle and pedestrian travelway on Sheet C-301 or C-302. Rev. 1: Comment partially addressed. Add a label for this feature to sheet C-201 and reference the sheet number and detail provided for this feature. Rev. 2: Comment stands. The label added to Sheet C-201 identifies details 7 and 8 on Sheet C-302. However, it appears that detail 2 on Sheet C-302 is the correct detail. Please verify and revise the callout as necessary. 13. [32.5.2 (j)] Please show all existing easements and water, sewer, and drainage systems on the Sheet C-101. No easements are shown. State the easement type (public/private), the width, and recorded instrument number for the plat and deed of easement (if applicable). a. Easements that will be vacated prior to this minor amendment approval should state the deed book and page number of the vacation plat. Rev. 1: SUB201900169 is currently under review. Rev. 2: Comment not fully addressed. SUB201900169 was denied by Albemarle County on November 22, 2019 due to a high level of errors and missing information. Per the disapproval letter sent by staff on November 22, 2019, a new easement plat application and fee must be submitted, reviewed, approved, and recorded and then this comment will be addressed. Sheet C-101 will need to be revised once the vacation plat has been recorded. b. All new easements should be shown on Sheets C-206 and C-207. Rev. 1: Once SUB201900169 is reviewed approved, and recorded, please update sheets C-206 and C-207 to state the recorded instrument number for new and/or realigned easements. Rev. 2: Comment stands. Once the new easement plat is approved and recorded, Sheets C-206 and C-207 will need to be updated so that the correct deed book and page number are shown on the drawings. 14. [32.7.8 and 4.17] Several revisions are needed to the Lighting Plan (Sheet C-501). See ARB comments #7-8 for additional information. a. [4.17.4 (b) (1)] Provide additional footcandle measurements within the parcel, they are currently spaced too far apart. Revise the photometric plan to provide light levels all along the property line along 5t1i Street. Rev. 1: See ARB comment #3 for additional revisions needed to the lighting plan in order to make site lighting comply with Entrance Corridor footcandle maximums. Rev. 2: Comment addressed. b. Include the standard lighting note on the lighting plan: Each outdoor luminaire equipped with a lamp that emits 3, 000 or more initial lumens shall be a full cutoff luminaire and shall be arranged or shielded to reflect light away from adjoining residential districts and away from adjacent roads. The spillover of lighting from luminaires onto public roads and property in residential or rural areas zoning districts shall not exceed one-halffootcandle. Rev. 1: Comment addressed. c. Pole locations on Sheet C-501 do not match other drawings. Ensure pole locations are correct across all sheets where visible. Rev. 1: Comment not fully addressed. Pole locations differ from the previously gpproved final site plan. Since this property is in the entrance corridor, all site lighting should be shown on this plan. If this is not possible due to pole locations in phases 2 and 3 not yet being finalized, add a note stating that no lighting in phase 2 and 3 is proposed with this amendment. All phase 2 and 3 lighting will be shown on a future site plan amendment for phase 2. See ARB comment #2 for additional details. Rev. 2: Comment addressed. 15. [32.7.9] Sheet C-204 implies that all landscaping required for the overall site development is being provided with the minor amendment. However, the full extent of the property is not visible, and internal landscaping is going to be installed as part of the site plan for Phases 2 & 3 since hardscapes in those areas are not being installed/approved with this minor amendment. This plan should only show landscaping required for Phase 1, unless the intent is to provide all landscaping. Please clarify what the intent is. Additional comments may be forthcoming about revisions to the Plant Schedule and landscape plan drawing. Rev. 1: Comment not fully addressed. Per comment #3, it is staff s understanding that site revisions, including landscaping, in phases 2 and 3 will be submitted for review and approval on a future site plan amendment application. Please add a note to the landscape plans stating this. Rev. 2: Comment addressed. a. Per the approved Application Plan of ZMA201200007, all Phase 1 landscaping around the retaining wall must be installed with Phase 1. The landscape plan must be enlarged to show those items. Update the Plant Schedule on Sheet C-204 as necessary. Rev. 1: Please revise the landscape plan so that it includes the 4 serviceberry trees along the south perimeter of the site that were approved with the previous plan. Please see ARB comment #6 for additional details. Rev. 2: Comment addressed. b. If internal parking lot trees or other vegetation being used for overall canopy requirements will be provided with the future site plan amendment for Phases 2 and 3, state this on the plans and remove those future items from the Plant Schedule quantities and calculation. Rev. 1: The quantities of Allee Elm and Eastern Red Cedar do not match the drawings. Please revise the table as necessary. See ARB comment #5 for further information. Rev. 2: Comment addressed. 16. [32.7.9.5 (b)] Street trees must be provided 35' O.C. along 5" Street. See ARB comments for additional details, and revise Sheet C-204 as necessary. Rev. 1: Comment not fully addressed, see ARB comment #4 for additional details. Rev. 2: Comment addressed. 17. [32.7.7.9 (c)] Please add a note to the landscape plan that states "All landscaping and screening shall be maintained in a healthy condition by the current owner or property owners' association and replaced when necessary. Replacement material shall comply with the approved landscape plan." Rev. 1: Comment addressed. The following comments will need to be addressed before approval: 1. Show compliance with the approved WPO Plan (impervious areas, etc). Rev 1: Sheet C-504 is confusing. There is not 3.64 lb/yr of phosphorus removal available....it is what is required to be removed? The approved plan shows an overall CN. You can simply show that you aren't changing the approved overall curve number with this revision (which would mean the original WPO plan is still compliant). Perhaps providing a narrative on the plans explaining how this plan complies with WP0201600082 will be helpful. Rev. 2: Please clarify: There is a CN chart, but they have different total areas. They also reference DA A, B in one calculation and DA C in another. Also, what is the 0.97 phosphorus reduction required for? If this proposed development needs more phosphorus reduction, then the WPO must be amended. 2. [C-204] Trees and shrubs should not be installed over storm pipes. They should also be kept out of easements. Rev. 1: There is still landscaping that is too close the pipe. Rev. 2: Comment not addressed. Please look at STR26. 3. [C-206&207] The improvements are not shown. The plan needs to show that the easements encompass the utilities. Rev. 1: Comment addressed.
