In order for the amended site plan to be approved the following revisions are required: [ZMA 2018-2 Proffer #1] See zoning comments, on both the LOR and the easement plat, about the location of the trail and the trail easement. Please note that the proffer states: • that the "Owner shall dedicate a non-exclusive easement on and across the pedestrian path for public use." and that • "The property owner shall maintain the path improvements...." Based upon the zoning comment, and the wording of the proffer, the order for approvals will be as follows: a) The LOR is approved showing the proposed trail improvements but not easement. I know we had previously specified the easement should be included but zoning has now specified the order and I apologize for not having it accurately outlined this for you previously. b) The trail is built to meet all of the requirements specified in the proffer. c) The trail is surveyed, and its exact location and width is determined and verified. d) The easement plat is revised to show the exact location of the 6' easement over the as built location of the trail. A maintenance agreement is drafted and approved with the owner of the parcel maintaining the trail. The easement plat is approved and then both the plat and the maintenance agreement are recorded. e) The CO for the building can be issued. Rev. 1: Comment still valid. Continue to address comment. 3. [Comment] Revise item #1 in the "Letter of Revision Narrative" to specify that additional square footage was added to the basement and the parking calculation was changed. Ensure this note specifies all included changes to the site plan. Rev. 1: Comment not vet fully addressed. All improvements previously shown in the LOR appear to be added to the "Letter of Revision Narrative". However, an additional change has been added to the LOR since the last submission and it is not listed in the narrative. Address the following: a) Include in the "Letter of Revision Narrative" the addition of the walkway and stairs from the church parking lot up to the Rivanna Ridge parking lot. b) Include the proposed off -site easement, both graphically and through labeling, in the LOR. c) Submit an easement plat to the planning reviewer, for County review, that shows the proposed construction and maintenance easement that is required for the off - site improvement. d) Submit a draft deed of construction and maintenance easement to the planning reviewer for County review. e) Ensure that the owner(s) of Rivanna Ridge are one of the parties of the deed and will be signing the deed or sign the plat. f) Both the deed and the easement plat must be approved by the County, signed and notarized, recorded, and the receipt for the recordation submitted to the planning reviewer prior to the LOR approval. [ZMA 2018-2 Proffer #1] Include proposed grading sheet in the LOR and ensure the proposed grading for the expansion of the trail is shown. There appears to be locations along the existing path where the current trail barely fits between the existing drainage ditches and either the existing grading or the grading already proposed with the approved site plan. Therefore, adjustments to the grading will likely be required in order to expand the trail to a full 6' as specified in the proffer and could impact existing steep slopes. Rev. 1: Comment not yet fully addressed. There is a portion of the grading that has been revised for the LOR that is not vet clouded. Address the following: a) Cloud the revised proposed grading for the trail that is adjacent to the 6' retaining wall. b) Ensure that all clouds for the revised LOR grading show up on each of the sheet in which they are shown. There are clouds shown on sheet 5 that are not shown on sheet 6 even though that area of the plan is shown. c) Cloud the revised grading for the added walkway and stairs from the church parking lot up to the Rivanna Ridge parking lot. d) Ensure all components of the previously approved final site plan are included in both of the LOR grading sheets. Show the hatch for the all of the managed slopes areas, on both grading sheets, and add labels to specify what the hatch is representing. 8. [Comment] Show the clouding for all changes on all layout sheets. Cloud the proposed 6' trail, since the width of the trail is being expanded with this LOR. Also, once the grading sheets are added to the LOR, cloud all areas of proposed grading that are added or revised for the expansion of the trail (along the full length of the parcel). Rev. 1: Comment not vet fully addressed. See comment #6 above about changes that have not yet be clouded. Cloud all changes from what was approved in final site plan, includina (but not limited to) the walkwav and stairs to the Rivanna Ridge parking lot that has added to the plan. 9. [Comment] Provide both landscaping sheets in this LOR and address any conflicts or impact to the existing and approved proposed landscaping. Because of the close proximity of the trail to the landscaping and existing preserved trees, and the limited area for expansion of the trail in a few locations, additional tree protection or the relocation of the proposed street trees and landscaping may be required. Rev. 1: Comment not yet fully addressed. Address the following: a) There are two "tree protection fencing" areas, for existing trees parallel to Rolkin Road, that are now no longer correct because of the impact to the revised trail width and/or location. Either revise the "tree protection fencing" area or replace the existing trees with proposed trees. If proposed trees are substituted, ensure that all landscape charts and calculations are updated accordingly. b) The last proposed tree, along Rolkin Road to the east, is now placed to close to the revised trail. Update the location of this proposed tree to have sufficient distance to the edge of the trail for tree health. Page 2 of 3 11. [Comment] The LOR submission has been reviewed by zoning and engineering. Attached please their comments. Rev. 1: Comment not yet fully addressed. See attached comments from other reviewers. 12. Rev. 1: [NEW COMMENT] There is a road drainage structure, to the east of the proposed entrance to Rolkin Road and about'/2 the distance towards the east end of the property, that appears to be impacted by the trail expansion. Revise the LOR to address this impact, revise the drainage structure, add notes and details, or revise the site plan such that the trail location no longer impacts the drainage structure. 13. Rev. 1: rNEW COMMENT] The addition of the walkwav and stairs onto the adioinin Rivanna Ridge property will require either a separate LOR to their site plan or this LOR must meet all of the LOR requirements to amend both site plans. Address the following: a) Clarify how you intend to amend the Rivanna Ridge site plan. b) Permission of the Rivanna Ridge owners is required. c) Additional information must be provided in Rivanna Ridge portion of the site, including linework and labeling for things such as (but not limited to): a. The closest corner of the Rivanna Ridge building. b. Linework and labels for the curb c. Linework and labels for the travel way. d. Linework for at least the closet edge of the parking spaces on the Rivanna Ridge property and labels specifying the parking. e. All existing landscaping within 50' of any portion of the proposed walkway and stairs. f. Linework and labels or any utilities, easements and/or infrastructure on the Rivanna Ridge property within 50' of any portion of the proposed walkway and stairs. 14. Rev. 1: [NEW COMMENT] There is an existing fire hydrant that is either adjacent to, or impacted by, the proposed walkway that was added to the Rivanna Ridge property on this LOR submission. The next submission of this LOR must be reviewed by Fire Rescue. Fire Rescue may have additional comments not included in this round of comments. In accord with the provisions of Section 32.4.3.5 of Chapter 18 of the Code if the developer fails to submit a revised final site plan to address all of the requirements within six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
