The County of Albemarle Planning Division will approve the plat referenced above once the following comments
have been satisfactorily addressed (The following comments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.): [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise
specified.]
1. [14-302(A)(5)] After the new "Declaration of Restrictive Covenants" and the "Plat showing Vegetative
Preservation Easement ..." are recorded revise the plat to include the Deed Book and Page number in all of
the locations blanks have been provided.
2. [14-302(B)(5)] Zoning classification. Revise note 8 to specify the following:
a) That TMP 62-2C has preserved steep slopes.
b) That TMP 62A3-1 is subject to ZMA2004-7.
3. [COD] Revise the NMD setback information to address the following:
a) Variation #56 & 57 were never approved. Reference to variation #56, and Note #7 must be removed.
b) The most recent variation number, specified in the title above the setbacks on the coversheet, is no longer
correct since additional variations have been approved. Revise "Through Variation 58" to be "Through
Variation 60".
4. [14-303(H)] Monuments. Show on the plat the iron pins found (IPF). Although there are IPS shown it does
not appear that any found monumentation is labeled and specified in the BLA.
5. [14-303(I)] Bearing and distance ties. Show on plat a minimum of two permanent monuments on the
exterior boundary of the property.
6. [Comment] Because the BLA plat shows the proposed changes to the vegetative preservation easement
the following items must be completed prior to the BLA approval:
a) Address County Attorney's office comments on all legal documents.
b) A signed and notarized copy of the release of the declaration of Aquatic and Wetlands
Restrictions (exhibit A, step 1) is submitted to the plan reviewer, it is recorded, and then the
recordation receipt is provided to the planning reviewer.
c) A signed and notarized copy of the new Declaration of Restrictive Covenants (exhibit B, step 2A)
is submitted to the plan reviewer, it is recorded, and then the recordation receipt is provided to the
planning reviewer.
d) A signed and notarized copy of the plat showing the revised vegetative easements (exhibit C, step
2B) is provided to the plan reviewer, it is recorded, and then the recordation receipt is provided to
the planning reviewer.
e) A signed and notarized copy of the Deed of Boundary Adjustment (exhibit D, step 3A) is
submitted to the planning reviewer.
f) Two or more signed, notarized and sealed ORIGINAL BLA plats (exhibit E, step 3B) are submitted
to the County for last review. The County will keep one of the originals.
g) A signed and notarized ORIGINAL of the Deed of Dedication (exhibit F, step 4) to the County is
submitted.
h) The County does a last review and if approved signs the Deed of Dedication.
7. [Comment] Clarify why the Amended Final Compensatory Mitigation Plan is Step 5 (Exhibit G) on the
"Outline of Process" provided to the County with this review. If it is not "Step 5" specify at what stage of the
process it is approved and/or recorded (what step). If it is truly the last step of the process, after the BLA
has been recorded and ownership of the Greenway lot has been transferred to the County, then the parcel
lines and ownership appears to need revision.
8. [Comment] Comments from other reviewers are attached. Comments must be addressed before this BLA
will be approved.

applicant_ To my knowledge the revisions are currently pending the Army Corps and!or DEO review_
* On 11112119 the applicant provided the most recent version of the Oreenway Deed (Exhibit F)_ All requested revisions have
been made-
* The 'Release of the Declaration of Acquatic and Wetland Rstrictions" (Exhibit A) is good_ No additional comments_
* The County Attorne}/s office defers to Parks and Rec on whether the plat delineates all the deeded greenway_ Assuming it
does, I have no issues with the accompanying deed_

and find the area dedicated to future public recreation use both suitable and acceptable_
019-1 -05: (Planning) Mr_ Mahon stated (in person) that all of his comments were addressed by addressing the County
Attorneys office comments_
019-11-01: (Planning) In an email to C-A_ office the following Mr_ Mahon stated:
