The basis for this determination follows. The Albemarle County Real Estate Assessment records indicate Parcel ID 05100-00-00-019AO contains 21 acres and zero (0) dwellings, Parcel ID 05100-00-00-019BO contains 1.21 acres and zero (0) dwellings, and Parcel ID 05100-00-00-020A0 contains 33.19 acres and zero (0) dwellings. The property is zoned RA, Rural Areas. The most recent deed for Parcel ID 05100-00-00-019A0, recorded prior to December 10, 1980, the date of adoption of the Zoning Ordinance, is recorded in Deed Book 544, page 472 and is dated February 25, 1974. The most recent deed for Parcel ID 05100-00-00-019130, recorded prior to December 10, 1980, the date of adoption of the Zoning Ordinance, is recorded in Deed Book 544, page 472 and is dated January 1, 1974. The most recent deed for Parcel ID 05100- 00-00-020A0, recorded prior to December 10, 1980, the date of adoption of the Zoning Ordinance, is recorded in Deed Book 517, page 10 and is dated August 25, 1972. (DB 544, pg 477 the "Plat") The parcels conveyed herein are portions of the same property ...in DB 1458, pg 482. 2493 / 294 6/10/2003 N Parcel One 21 5 All those certain tracts or parcels of land.... containing 71.30 acres, more or less, and 130.76 acres, more or less, shown as Parcel B and Tract IV, respectively, on a plat... in Deed Book 544, page 477... being the same property... in DB 1774, pg 408. The information in the Deed and Albemarle's Real Estate assessment records indicate that Parcel ID 05100-00-00- 019A0 is 21 acres. It is unclear whether or not that is a more accurate total than the 22 acres described in DB 439, pg 159. Based on these deeds; Parcel ID 05100-00-00-019AO is determined to be one (1) parcel of record, comprised of the following: Approximately 21 acres+/-, containing five (5) development rights. The said real estate is a part of the real estate that was conveyed ...in DB 431, pg 607. Reference is made to the plat mentioned above and to this deed for a more particular description of the said tract or parcel of land. This deed creates Parcel B. The plat shows the boundaries of Parcel B and that it contains 71.30 acres. Can't quite make out where the County lines are, but the description implies that it is partly in Albemarle. 544 / 472 1/25/1974 N Second: The parcel marked "Parcel 'B' 71.30 Ac." Adjoining 1.21 Parcel First, and being the same land as conveyed... in DB 507, pg 434. Plat shows Parcel B as being mostly in Lousia County, but it appears there is a sliver of this parcel (TMP 51- 19B) that is within Albemarle County. Based on the deeds above, the descriptions, and the plats, on the date of the adoption of the ordinance, December 10, 1980, Parcel ID 05100-00-00-019BO appears to be one parcel of record. Based on these deeds; Parcel ID 05100-00-00-020A0 is determined to be one (1) parcel of record, comprised of the following: Approximately 33.19 acres+/-, containing five (5) development rights. The parcels are entitled to the noted development rights if all other applicable regulations can be met. These development rights may only be utilized within the bounds of the original parcel with which they are associated. These development rights are theoretical in nature but do represent the maximum number of lots contain less than twenty one acres allowed to be created by right. If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of this notice, in accordance with Virginia Code § 15.2-2311. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal may be taken only by filing an appeal application with the Zoning Administrator and the Board of Zoning Appeals, in accordance with Albemarle County Code § 18-34.3, along with a fee of $258. Additionally, a separate fee is required for the cost of providing notice and advertising of the appeal for a public hearing. Applications for Appeal of the Zoning Administrator's Determination are available at the Department of Community Development located at 401 McIntire Road, Charlottesville, Virginia 22902 or online at www.albemarle.org/cdapps. This form applies to the appeal of a decision of the zoning administrator or any other administrative officer pertaining to the Zoning Ordinance.
