Dear Ms. Long:
Staff has reviewed your initial submittal for the above -referenced Special Use Permit for
outdoor safes/storage/display in the Entrance Corridor. Comments that are available at this
time are listed below. At this time, we recommend that Entrance Corridor and VDOT issues be
resolved prior to public hearing with the Planning Commission. We would be glad to meet with
you to discuss these issues.
Plannins
Boundary Line Adjustment (BLA): The plan shows that a boundary line adjustment is proposed
to accommodate parking. An approved BLA will be required prior to final site plan approval.
Comprehensive Plan: Initial comments on how your proposal generally relates to the
Comprehensive Plan are provided below. Comments on conformity with the Comprehensive
Plan are provided to the Planning Commission (PC) and Board of Supervisors as part of the staff
report. The following comments are provided in preparation for the PC review and may change
based on resubmittals and Board and Commission direction.
The Places 29 Master Plan shows this area as commercial mixed use in Neighborhood 1.
This designation includes as primary uses: community and regional retail, commercial
service, and auto commercial service and office. Secondary uses include: office, research
& development, flex, residential, open space, and institutional uses. The proposed use is
consistent with the designated primary uses.
The commercial mixed -use designation is intended to support the eventual conversion
of these areas to a more mixed -use type of development that would support adjacent
mixed -use centers. The proposal is clearly inconsistent with the relegated parking
principle of the Neighborhood Model. However, the proposal does not preclude the
eventual conversion of the property to a more mixed -use development.
The Comprehensive Plan (Chapter 2, Natural Resources and Cultural Assets) establishes
the goals for preserving the scenic resources that are essential to the County's
character, economic vitality and quality of life. The Entrance Corridor Overlay District is
intended to support that goal by maintaining the visual integrity of the County's
roadways. The Architectural Review Board (ARB) addresses potential adverse aesthetic
impacts in the Entrance Corridors by applying the County's Entrance Corridor Design
Guidelines during their review of development proposals. The ARB will review the
subject request for conformance with the Entrance Corridor Design Guidelines on
January 21, 2020.
A Community Meeting is required for this application. We understand that the meeting
has been tentatively set for the Rio 29 CAC meeting to be held on January 23, 2020.
Zoning
The following comments related to zoning matters have been provided by Francis MacCalk
1. If reference to the SP for outdoor display on the adjacent property is to remain on the
proposed concept plan, then a revised note should be added to clarify that the concept
plan for the previous SP applies and the areas shown on the proposed SP are illustrative
only and are not applicable to SP2019-00011.
Engineering and Water Resources
The following comments related to engineering and water resources have been provided by
Frank Pohl:
1. VSMP permitting will be required. Project will be considered redevelopment, which will
require additional quality reductions.
Fire/Rescue
Shawn Maddox has indicated that Fire/Rescue has no objections.
Building Official/inspections
The following comments have been provided by Michael Dellinger:
1. . Need to know how many total parking spaces will be provided so the total accessible
spaces can be provided. Accessibility will need to be provided to the remaining building.
2. Add the following note to the general notes page:
a. Building or structures built before January 1, 1985 must have an asbestos survey
performed in order to apply for a permit. Asbestos removal permits are required
if positive for such from Albemarle County and VDOLL Contact VDOLI for
additional requirements and permits for demolition projects.

Entrance Corridor
The ARB is scheduled to review this proposal on January 21, 2020. Staff comments on Entrance
Corridor impacts will be forwarded to you approximately one week prior to the ARB meeting
date. Because the primary purpose of the requirement for the Special Use Permit is to ensure
consistency with the purpose and intent of the Entrance Corridors, the ARB's recommendations
on the proposal are key to the review of this SP. It is recommended that the proposal not move
forward to the PC without a positive recommendation from the ARB.
VDOT
Comments from VDOT are expected sometime during the second week of January. Comments
will be forwarded as soon as they are received. Note that preliminary discussions suggested
that VDOT may require the closure of one of the entrances from Rt. 29. It is recommended that
all issues arising from VDOT comments be resolved prior to PC review.
Albemarle County Service Authority (ACSA)
The following comments from ACSA have been provided by Richard Nelson:
I. ACSA has no comments regarding SP-2019-11 Malloy Ford Outdoor Display. The
following items will need to be addressed prior to site plan approval: Dedication of ACSA
utilities for the Malloy Ford site.
VDH. Thomas Jefferson Health District
No comments have been received from VDH, Thomas Jefferson Health District.
SP Conditions
At this point in the review process, we anticipate that recommended conditions of approval for
the Special Use Permit will include those conditions recommended by'the ARB and VDOT. The
increase in non -relegated parking will likely be identified as a factor unfavorable.
Additional/alternate factors and conditions may be identified as review proceeds.
Action after Receipt of Comments
After you have read this letter, please take one of the actions identified on the "Action After
Receipt of Comment Letter" form, which is attached.
Resubmittal
If you choose to resubmit, please use the attached form and note the resubmittal date schedule
(attached). There is no fee for the first resubmittal. Additional notification fees will not be
required unless a deferral takes place and adjoining owners need to be notified of a new date.

ACTION AFTER RECEIPT OF COMMENT LETTER
RESUBMITTAL
Within 10 days, please do one of the following:
(1) Request a Planning Commission public hearing date be scheduled
(2) Request deferral, as required by Section 33.521, in these instances:
a. If this is a resubmittal after September 5, 2018 and/or you have not
deferred -to date.
(3) Resubmit in Response to Review Comments
(4) Withdraw your application

You may request that your application to be scheduled for public hearing with the Planning
Commission.
(2) Request Deferral
To request deferral, you must submit a request in writing to defer action by the Planning
Commission and Board of Supervisors. The request may be made by email. You may request a
deferral for up to 36 months from the date your application was accepted for review, which is
December 2, 2022. (This is based on the Board of Supervisors' September 5, 2018 action.)
However, all outstanding information necessary for Commission action must be submitted by
(120 days prior to the end of the deferral period), according to the published schedule. (See
Section 18-33.52 of the Albemarle County Code.)
(3) Resubmittal in Response to Review Comments
Make sure that the resubmittal is on or before a resubmittal date as published in the project
review schedule. The full resubmittal schedule may be found at www.albemarle.org in the
"forms" section at the Community Development page. Be sure to include the resubmittal form
on the last rage of your comment letter with your submittal.
The application fee which you paid covers staff review of the initial submittal and one
resubmittai. Each subsequent resubmittal requires an additional fee. (See attached Fee
Schedule.)
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond
An application shall be deemed to be voluntarily withdrawn if the applicant requests deferral
pursuant to subsection 33.52(A) and fails to provide within 90 days before the end of the
deferral period all of the information required to allow the Board to act on the application, or
fails to request a deferral as provided in subsection 33.52(B) or (C).
Fee Payment
Fees paid in cash or by check must be paid at the Community Development Intake
Counter. Make checks payable to the County of Albemarle. Do not send checks directly to the
Review Coordinator. Fees may also be paid by credit card using the secure online payment
system, accessed at

To be paid after staff review for public notice:
Moat applications for Special Use Permits and Zoning Map Amendment require at least one public hearing by the Planning Commtsslon
and one public bearing by the Board of Supervisors. Virginia State Code requites that notice for public hearings be made by publishing
a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for public notice
are required before a Zoning Map Amendment may be heard by the Board of Supervisors. The total fee for public notice will be
prorided to the applicant after the final cost Is determined and mast be pold before the application Is hoard by a public body.
