HomeMy WebLinkAboutSDP201700009 Correspondence 2017-07-21 PROJECT MANAGEMENT SHIMP CIVIL ENGINEERING LAND PLANNING ENGINEERING July 21, 2017 Francis MacCall Albemarle County Department of Community Development 401 McIntire Rd Charlottesville, VA 22902 Regarding: Boyd Tavern Market SDP 2017-9 Dear Mr. MacCall, As requested in the initial siteplan approval letter for the Boyd Tavern Market project, additional information concerning the expected water usage has been provided to demonstrate that a special use permit is not required, As stated by Section 24.2.2 of the Albemarle County Zoning Ordinance, Boyd Tavern Market is allowed a maximum by-right water usage of 400 gallons per day per acre,equating to 1,312 gallons per day (gpd). To document that it will not exceed this limit,we have researched industry standard guidelines regarding water usage as well as data from other Tiger Fuel markets, namely the Market at Mill Creek and the Market at Bellair. None of the data or industry standard calculations suggests that Boyd Tavern Market will exceed the 1312 gpd water usage limit. The best available guidelines for estimating water usage come from the Virginia Department of Health and the EPA. These guidelines are developed to predict the maximum anticipated water usage in order to properly design onsite septic systems. The daily use estimates are naturally conservative as it is in the interest of VDH to ensure that septic systems are adequately designed to accommodate daily flows. State law requires that Licensed Professional Engineers make judgements as to which use classifications are appropriate to predict the required water/septic demands. Based on review of the applicable regulations and guidance documents we believe that the most accurate way to predict the required waste water treatment capacity and water usage is to treat the store as a mix of restaurant and convenience store,assigning a per seat and per employee standard calculation to determine the expected water usage. It is important to note that the Boyd Tavern Market does not offer full service dining and there is no washing of dishes/etc. associated with that use which significantly reduces water usage. The turnover per seat at the Market is potentially higher which may slightly increase usage, this combined with the more significant impact of the reduced consumption for dishwashing/etc. makes the restaurant/per seat requirement an appropriate, conservative means of estimating water usage. Please note that this mixture of classifications from a VDH/EPA standards is not meant to imply a different zoning classification than that shown on the site plan. The standards do not address every possible use and it falls upon appropriately licensed professionals to make determinations of the appropriate categories and techniques for calculating water and sewer treatment volumes. According to VDH 12-VAC5-590-690, Capacity of Waterworks. a restaurant uses 50 gpd per seat. Boyd Tavern Market will have 14 seats, equating to 700 gpd.To account for the employees, which were not listed on the VDH table, we used the USEPA Onsite Wastewater Treatment Systems Manual which estimates 10 gpd per employee of the convenience store Counting 20 employees, Boyd Tavern is estimated to have a total water usage of 900 gpd. Using this same methodology, Mill Creek is estimated to use 1,100 gpd(18 seats, 20 employees). The Bellair market,with 23 seats and 20 employees, is estimated to use 1,350 gpd. In addition to industry standard calculations, we have the benefit of comparing our estimates with actual water usage data from two similar stores which are already in operation. The data confirms that the expected,but conservative estimate,of usage for Boyd Tavern of 900 gpd is accurate. To examine the accuracy of the 900 gpd estimate for Boyd Tavern Market, we have reviewed the water usage data for the Mill Creek Market and the Market at Bellair.The data sets go back many years, however, water usage prior to 2013 is not representative of the expected use at Boyd Tavern due to older, less efficient fixtures. In particular,the efficiency of toilets has shown to greatly impact water use. Prior to 2013, Mill Creek and Bellair used toilets that consumed 5 gallons or more with each flush,compared to the newer 1.2 gallons per flush toilets. Promptly after replacing the toilets,water consumption at both locations decreased by half. Since the toilet replacements, water usage has stayed below 1,000 gpd for Mill Creek, versus the 1100 gpd predicted by the standard calculations, and has only surpassed 1,000 gpd six times at Bellair,with a maximum of 1,107 gpd, significantly under the 1350 gpd estimated. Additionally,the owner has informed us that a carpet company used to take water from the outdoor spigots at Mill Creek to fill their trucks with water until the market added padlocks to their spigots. This is a possible explanation for erratic water usage in the past. However, this is not a concern at Boyd Tavern as the outdoor spigots will be locked. The dashed line on Figure 1 marks the date that the new toilets were installed at Mill Creek. The toilets at Bellair were replaced several months later. According to the graph,there is a dramatic decrease in water usage for both markets near the end of 2013. Figure 2 below is from the same data as Figure 1,just dated after the toilets at Mill Creek were replaced. Bellair& Mill Creek Water Consumption 2013 Onward Figure 2 provides more detail about the water usage that can be expected at Boyd Tavern. Recognizing that the usage data varies slightly in different times of year we have computed a projected use graph using a weighted average of the percent actual usage of other stores vs. EPA/VDH projected usage and have applied the results to the expected maximum use for Boyd Tavern to produce a the following graph. Please see Figure 3 below, the maximum projected measured flow is 736 gpd versus an estimated peak of 900 gpd. This projected flow is 576 gpd below the maximum allowable usage of 1,312 gpd. Boyd Tavern Estimated Use We conclude that the methods selected accurately and conservatively predict water usage in this situation. When comparing the data between stores the County Engineer has also asked us to provide fixture count information to determine the degree in which the proposed Market and Boyd Tavern is consistent in form to the two sites we are comparing. We have compared the layout of the buildings and all water fixtures and provided drawings are attached to this letter. The Market at Mill Creek has a total of 48,5 water supply fixture units, the Market at Bellair has 41.25, and the Boyd Tavern Market has 45.75.The fixture units demonstrate that the markets are all comparable in nature. None of the evidence we have reviewed suggest that the water usage at Boyd Tavern will exceed the limit of 1,312 gpd. The consistent data from 2013 on provides no reason to believe that the use will have high variability. The subject stores are all open 7 days a week and engage in the same exact business on a daily basis. This is not a use that would be expected to use a different volume of water from one day to the next. In addition to demonstrating that the water usage will not exceed the 400 gallons/site acre/day the applicant is willing to sign a restrictive deed which will be recorded with the Albemarle County Clerk's Office stating that the plan will be implemented with the following safeguards: 1. The applicant shall install and maintain a meter on the well head to monitor water consumption. Results of daily water consumption shall be made available within forty-eight(48) hours of a request from the Zoning Administrator. 2. The applicant shall install and maintain a tamper-proof, flow restriction device limiting water flow to no more than 1,312 gpd 3. The applicant shall place a padlock on any outdoor water spigots to prevent unauthorized use of water. While we believe that this deed restriction is unnecessary based on the engineering review of the facts the applicant is willing to offer a binding deed which would grant the County legal rights to enforce items 1-3 above as long as the convenience store was in operation on the parcel.We believe this will alleviate concerns of the neighbors who are not familiar with the industry standard calculations or who have been looking at data from car washes or other non-applicable comparisons to obtain estimates of water usage. We respectfully request that this letter and its associated supporting documents be reviewed and a new siteplan approval letter or similar opinion of the agent be issued which states that a special use permit is not required for the proposed Boyd Tavern Market. The quality and variability of the source water. B. Possible future changes in the quality of the source. C. Water quality goals, including the growing desire of the public for better water. D. When removal of contaminants for which BAT has been specified is necessary, processes classified as BAT shall be employed. E. When treatment technique requirements have been established in lieu of MCLs, processes specified by such requirements shall be employed. F. POE or POU devices shall not be utilized for long-term compliance with PMCLs. Such devices may be considered for short term, interim use, as a condition of a variance or exemption issued by the commissioner. 12 VAC 5-590-690. Capacity of waterworks. The design capacity of the waterworks shall exceed the maximum daily water demand of the system. Waterworks shall normally be designed on the following basis of water consumption. If deviations are made, they shall be based on sound engineering knowledge substantiated in the designer's report and approved by the division. A.
