County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any
VSMP permit by issuing a project approval or denial. This project is denied for reasons outlined, below.
The application may be resubmitted for approval if all comment items are satisfactorily addressed.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain
(1) a PPP, (2) an ESOP, (3) a SWMP, and (4) any TMDL measures necessary. Link to County template:

SWPPP —Provide I I" x 17" Exhibit. Recommend ESC Plan as template. Show solid/non-hazardous waste
dumpster; sanitary facilities (port -a John); solvent -paint storage; concrete wash -out; on -site fuel storage;
rain gauge. DEQ, during periodic inspections of active projects, instructs on importance of an Exhibit that
shows location of these features. All should drain to containment. For example, silt fence downstream of
port -a John. Concrete wash -out, dumpster draining to trapping device (lined, in case of concrete wash -out).
On -site fuel storage berm with 10ml liner, sized to hold fuel volume + 2 yr. storm event. .PDF samples

available. Exhibit is not intended as a detailed design, but to show containment and locations which may
change over time. Exhibit is a construction aid and resource protection/inspection management tool. (Rev.

C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP.
This plan is disapproved for reasons listed, below. The stormwater management plan content requirements
can be found in County Code section 17-403.
Amendment Narrative, sheet 1, states: "This Amendment proposes to pave a 0.32 Acre stabilized grass
parking area with asphalt. The original WPO Plan was approved in March 2005. The original site plan was
amended in 2007 for the expansion of the grasspave parking area (0.32 Acres) and an impervious
recreational area (0.12 Acres). Letter of revision #2 dated August 15, 2018 proposed to change the
recreational area to a 5000 sq. ft. picnic pavilion. The pavilion has since been constructed and is shown as
existing on this plan set. Since there have been no updates to the original WPO, this Amendment evaluates
the existing basin capacity and quality treatment as originally designed for the added impervious area based
on IIC criteria. Proposed changes include expanding the retention basin on the south of the property for
water quantity and quality, and adding curbing, pavement, and storm sewer to the existing grass parking
lot." [ emphasis added ] (Rev. 1) Note: Please restore text ref. to paving a 0.32 Ac. stabilized stone parking
surface. May include text at Project Description, sheet 5. This or similar text provides descriptive context.
After review, files indicate WPO200400050:
a. Is not an active permit, but rather is a completed project (details):
i. WPO plan bond (ESC and SWM plan bond) were released 7/18/2011.
ii. Project was complete; permit closed with bond release over eight years ago.
b. A VPDES permit does not exist; none is listed in DEQ SWCGP database as active, terminated, or
inactive.
c. Technical criteria IIB apply to request for new land disturbance.
d. Amendment to closed permit WPO200400050 is not an option.
e. WPO200400050 proposed land disturbance appears complete.
f. Note: Pavilion was recently constructed instead of impervious recreation area shown with
WPO200400050.
g. Engineering does not amend plans that are inactive, or for which WPO bond has been released.
3. Rather, a request to disturb any additional area/s at Kappa Sigma International Headquarters, or proposal to
transition from grasspave parking to asphalt parking, requires a new application, and is subject to
requirements listed at county code, chapter 17, and 9VAC25-870-65 (water quality) and -66 (water
quantity). File # WPO?"' 900046 is assigned to this project; it is anew WPO Plan.
4. Ref. requirements at county code: 17-401, -402, -403, -404, -405. (Rev. 1) Comment persists. Applicant
acknowledges.
5. Revise plan title: delete reference to Amendment. Include VSMP /WPO201900046 in title. Recommend
title plan: `Kappa Sigma International Headquarters VSMP /WPO201900046.' (Rev. 1) Addressed.
6. Ref. satellite image, below. Unless misreading imagery, proposed impervious area has been constructed
since at least 3/9/10. A stone or stone dust surface is visible in area WPO201900046 Application proposes
to transition from grasspave to asphalt pavement parking area (sheet 3).
7. Revise plan to include Existing Conditions sheet that accurately reflects structures, contours, land cover,
paved or stone parking surfaces, and existing SWM facility with labels and notes as needed to clearly
indicate existing conditions on date of VSMP /WPO application, consistent with satellite imagery.
Application is misleading since added impervious area appears to have been added in 2010; that is, not
proposed to be added. Please clarify. (Rev. 1) Addressed.
8. Note: $200 Amendment fee is insufficient. VSMP Application fee is required. Ref. table /fee schedule at
code 17-208. $290 is required; balance due 490. (Rev. 1) Addressed.

9. In many respects, this appears to be an application for post -development plan approval and grading permit
for work performed /completed (5,000 sq.ft. pavilion), and proposed impervious parking. Although parking
area may not be asphalt pavement, it has not been grasspave since at least Mar 2010 (satellite photo image,
below).
10. Related to 7., ensure all elements of plan are comprehensive, clear, and accurate. For example:
a. Sheet 3:
i. Show pavilion roof leader lines, consistent with post -developed drainage area map. (Rev.
1) Not addressed. Comment persists.
ii. Also: item d., vi., below. (Rev. 1) Comment persists.
b. Sheet 4:
i. Revise LOD to exclude stone /stone dust area to be paved. Land disturbance unlikely in
this area. Area has been stoned since at least Mar, 2010. (Rev. 1) Addressed. Applicant
response: `Please see note referenced on plan.' Sheet 3 note explains /refences limits of
disturbance (0.95 Ac.).
ii. Revise CE to PCE (paved construction entrance). (Rev. 1) Addressed.
c. Sheet 5:
i. Provide SWM facility installation, maintenance and inspection information corresponding
with whichever VA DEQ Stormwater Design Specification is selected to replace retention
basin II, since criteria IIB applies to this project. (Rev. 1) Not addressed.

sheet 1. This is a design plan, not an As -built construction record drawing. A licensed
professional must submit As -built drawings to meet Construction Record Drawing (As -
built) for VSMP requirements. A contractor signature may or may not be sufficient. Last,
resubmittal of a design plan that does not include any "redline" markings is not the same
as a licensed practitioner's affirmative certification that As -built conditions match design.
d. Sheet 6:
i. Select a 9VAC25-870-65 practice; practices 1-15 available. Retention basin II is a IIC
criteria stormwater management facility; select, for example, extended detention pond or
bioretention basin, and furnish relevant design for that practice. Link:

Roofs without gutters discharge sheet flow, but roof gutters, like ground level gutters,
capture and concentrate roof runoff. At ground level, discharge is concentrated flow.

e. Sheet 7:
i. Remove storm pipe structures from LD-229 table, unless downstream of storm pipes
proposed with this VSMP plan. Label all structures in plan view that remain, once LD-
229 table is revised. (Rev. 1) Addressed. Applicant response: `The storm tables have
been revised as requested. The only system shown is that proposed with this project.
However, the entire storm system was analyzed (based on approved original plan) in
order to maintain acceptable velocity flows, capacity, and HGL computations.'
f. Sheet 8: Provide typ. details, including: (Rev. 1) Addressed.

Engineering did not, apparently, review LOR, which proposed 5000 sq.ft. pavilion in lieu of a 0.12 Ac.
impervious recreation area. Again, this application appears to seek approval for constructed elements, and
to place asphalt pavement on stoned parking surface. Please clarify. (Rev. 1) Not addressed. Comment
persists. Please provide copy of LOR approval /county Planning Div. correspondence.
12. Provide deed bk.-pg. reference to recorded Maintenance Agreement (Ex. SWM facility). (Rev. 1) Not
addressed /comment persists. Applicant response: `Upon initial research, a DB/PG for a SWM facility
/access easement cannot be located by RGA personnel. Would like to have county records confirm none
exist prior to creating a new plat. Engineering has reviewed on-line circuit court records, and can only
locate a Certificate of Plat (various easements) that appears to indicate possible SWM facility access (bk-
pg. 2940-530, but without easement for Ex. pond), requests Applicant overlay recorded plat with sheet 4.
In any event, a SWM facility easement sufficient to provide access to facility side -slopes, embankment,
outfall, etc., as well as a public drainage easement from SWM facility outfall to either a receiving stream
(Cow Branch) or property line is re uired. A SWM Maintenance Agreement is required. Query of circuit
court on-line database does not indicate a Maintenance Agreement exists for Ex. pond. Ref. image, below.

14. Provide VaRRM.xls site tab data. Drainage area ("A", "B") data is helpful, but overall site data, including
total phosphorus load reduction displayed on site tab is needed.
15. Part IIB criteria for listed best management practices are listed at the BMP Clearinghouse. Please select
appropriate BMP measure (Extended detention, for example) to meet on -site water quantity requirements.
It appears small DA and other design considerations, such as aquatic bench and side slopes no steeper than
5H:IV, may challenge design or prohibit a wet pond design in the proposed location, or in this setting.
Note Wet Pond VA DEQ Stormwater Design Specification 14 Feasibility guidance,.55, text image 1,
below. Compare proposed design with Table 14.2 Level 1 and Level 2 Wet Pond Design Guidance, which
requires an aquatic bench. Since DA < 5Ac. (once revised per item 13), this would be a pocket pond, if all
design criteria can be met. Please see text at DEQ Stormwater Design Specification 14, pg. 14, image 2,
below:

Contributing Drainage Area. A contributing drainage area of 10 to 25 acres is typically
recommended for wet ponds to maintain constant water elevations. Wet ponds can still function
with drainage areas less than 10 acres, but designers should be aware that these "pocket" ponds
will be prone to clogging, experience fluctuating water levels, and generate more nuisance
conditions. A water balance should be calculated to assess whether the wet pond will draw down
by more than 2 feet after a 30-day summer drought (see equations in Section 6.2).

• Pocket Ponds. Another issue relates to wet ponds with a small contributing drainage area that
are solely supplied by runoff and groundwater, and often have fluctuating water levels that
create nuisance conditions. There is virtually no research data on these "pocket ponds" that
are frequently installed on small commercial sites. Rather than mandating an arbitrary
minimum drainage area, it is recommended instead that these pocket ponds must meet the
minimum design geometry requirements for all ponds (i.e., a sediment forebay cell, aquatic
benches, maximum side -slopes no steeper than 511: IV, and a length -to -width ratio of 2:1 for
Level 1 designs or 3:1 for Level 2 designs). Designers should strictly adhere to the same
design requirements that apply to other wet ponds. This should greatly reduce the number of
small nuisance ponds with inadequate designs and insufficient functions (i.e., by reducing or
eliminating essential pond design elements), that are forced into sites that are too small.

18. Proposed higher pond /detention basin embankment (481') does not appear to tie to Ex. Elev. 481'. Revise
or provide linework that clarifies pond /basin volume is retained and cannot exit either side of the 481'
embankment.
19. Show /label roof leader lines and level spreaders (or similar) if roof runoff is to qualify as sheet flow.
20. Sheet 5: Delete ref. to Link Evans Road.

21. Show and label existing pipe INV IN /OUT in profile view of Str. 3. Consider and propose pipe depth
between Str. 3A and 3 that eliminates need to verify pipe deflection angle. It appears there is sufficient
depth of cover to raise pipe between Str. 3A and 3 to avoid any conflict with Ex. pipe elevations at Str. 3.
22. Provide existing and proposed plan and profile data for detention basin /wet pond. Ensure design meets all
BMP clearinghouse design criteria; for example: if Extended Detention pond, ref. Emergency Spillway at
VA DEQ Stormwater Design Specification No. 15, pg. 10 ("design to pass the 100-year design storm event
through ...vegetated or armored Emergency Spillway with at least one foot of freeboard to the settled top of
embankment."). Design must provide 1' freeboard for the 100-year design event.
23. Clarify Ex. headwall /weir plate modifications: `bore new 8" orifice and widen existing 4" orifice' are
insufficiently descriptive. Provide plan and profile for outfall structure. Provide adequate graphic and
textual information to guide construction and modification of existing headwall /weir plate.
D. Erosion and Sediment Control Plan (ESOP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESOP. This plan
is pending for reasons listed, above. Once revised plan submitted, ESCP comments are a possibility. The
erosion control plan content requirements can be found in County Code section 17-402. (Rev. 1) ESC Plan
is approved pending review of revised WPO plan. Subsequent ESC plan comments and request for revision
are a possibility, depending on revisions to plan in response to comments, above.
The VSMP permit application and all plans may be resubmitted for approval when all comments have been
addressed. For re -submittal, please provide 2 copies of the permit package with a completed application form.
Engineering plan review staff is available from 2-4 PM on Thursdays if you wish to meet to discuss this review.
Process
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate request
form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and
check parcel and easement information based on the approved plans. The County's Management Analyst will
prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash,
certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County
Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements may also need to be completed and recorded. The
County's Management Analyst or other staff will prepare the forms and check for ownership and signature
information. The completed forms will need to be submitted along with court recording fees (if an existing
Agreement is not recorded).
After bonding and agreements are complete, county staff will need to enter project information in a DEQ database
for state application processing, if LOD >1.0 Ac., which does not appear likely on this project. DEQ will review the
application information based on local VSMP authority approval. At this time, the DEQ portion of the application
fees will need to be paid directly to the state. For fastest processing, this is done electronically with the emails
provided on the application (SWPPP Registration Statement). DEQ should notify applicants with instructions on

how to pay fees. When DEQ approves the application, they will issue a permit coverage letter. This should be
copied to the county (preceding: if state VPDES permit is required /appears unlikely).
Easements must be recorded prior to VSMP approval; recordation is required to receive a Grading Permit.
After DEQ coverage is issued, the County can hold a pre -construction conference. Applicants will need to complete
the request using a pre -construction conference form, and pay the remainder of the application fee. The form
identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by
county staff, and upon approval, a pre -construction conference will be scheduled with the County inspector. At the
pre -construction conference, should everything proceed satisfactorily, a grading permit will be issued by the County
so that work may begin.
