Subject: SUB201900189 5'1i Street Commercial Development — Easement Plat
The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [General Comment] On Sheet 2, there is a callout stating "Boundary Lines hereby created" along the
property line between TMP 76-55A and 76M1-1 that appears to be a mistake. Please confirm that there
is no boundary line adjustment taking place, and remove the label if no BLA is occurring.
2. [14-302 (A)(5), 14-314] As required by Proffers #5 and #8 approved with ZMA2012-07, please submit
a revised deed of dedication and easement for the new public access easements. This will replace the deed
of dedication and easement for the 15' public access easement recorded in deed book 5013, pages 265-
274. The new deed should mention that it is replacing the previously recorded deed of dedication for the
revised 15' public access easement, and that the revised easement shown on this plat is dedicated to the
County for pedestrian and vehicle use.
a. A Word document of the original deed of dedication is attached. Please edit as necessary so that
it states that a portion of the existing easement is being vacated, and then a new revised easement
is shown on this plat. The revised deed of dedication will be sent to the County Attorney for
review.
3. [14-302 (A)(11)] In the property labels for TMP 76-55A, please state the recorded instrument number
for the most recently recorded plat. This plat was recorded in DB 5013 pages 259-264.
4. [14-302 (13)(5)] In the zoning note for TMP 76M1-1, please add that portions of the property are within
the FH Flood Hazard Overlay District.
5. [14-302 (13)(1)] Please add a date of last revision to the plat.
