Chip Giessler, Pastor Aldersgate Methodist Church 1500 East Rio Road Charlottesville VA 22902 RE: Aldersgate Preschool Dear Chip: Aldersgate Methodist Church wishes to offer a preschool program in your existing facility. In order to do so, a question has come up as to whether the available space meets the requirements of the Virginia Construction Code for this use. At your request, I have reviewed the facility in December 2019. This letter is written to communicate my findings. For the record, it is my understanding that your program will provide morning educational programming for a small group of (up to ten ) preschool children, all over the age of two and a half. The space contemplated for this activity is located on the lower level of your Sunday School area, and is space currently housing a Sunday School program. Classes will be offered each day for up to three hours, but lunch will not be served. In my opinion, Section 305.2 is the applicable governing section of the Virginia Construction Code. According to the code, the preschool could be deemed a "day care" facility, rather than a school. The applicable sections of the code, as follows: Section 305.2 This deems the use to be educational (Use Group E), provided that the children are over the age of 2 % and the services provided are less than 24 hours per day may apply. If the children are less than 2 %, Use Group 1-4 may apply. Section 305.2.1 Stipulates that educational spaces within a church shall be the same use as the church, provided the education functions are provided at the same time as religious services. Since the space in question is untilzed on Sundays as part of Sunday worship but will function during weekdays as a preschool, it is possible that it would need to meet the requriemetns of both Use Group E and Use Group A-3. �� �,i • Section 305.2.2 - If the number of children being educated are five or fewer, the space would need to meet the primary occupancy of the building (A-3). Based on my research, it appears that the space probably was intended to meet Use Group A-3 and would only become Use Group E if more than five children are being educated on weekdays, (which is assumed). Generally speaking, Use Group A-3 has more stringent requirements than Use Group E. Given that the children attending will all be over age 2 %Z , Use Group 1-4 should not apply. Since the program contemplated will only occur for three hours per day and it will not involve providing meals, in my opinion, approval from the local health department would not apply. Reviewing the space for general conformance with the current Virginia Construction Code, I find: • It appears that the existing space is sprinklered and appears to have been designed to the governing code at the time of its last renovation. • The intended space is adequately sized for the anticipated use and intended occupancy. Under table 1004.1.2 of the VCC education activities require 20 square feet per person. The space proposed for the preschool is 354 square feet. • The door from the classroom to the corridor is thee feet wide, rated (with label in place and legible) and has an operating closer. The hardware has lever type handles that appear to be ADA compliant. The doors from the corridor to the exterior are three feet wide and adequate for the occupancy load. • There are clear marked egress signs in two directions that are clearly visible at the classroom door and the exit path leads directly to the exterior of the building . • There is a fire extinguisher near the classroom. • There are ADA complaint toilets on the same level as the proposed classroom. • Water fountains are located near the classroom. • There are horn strobes in every room (including the room that will be used for preschool) and in the toilets. • The proposed room has generous natural light and ventilates to the exterior via a sliding door. GAP Aldersgate Preschool January 2, 2020 Page 3 While my field survey of the proposed space was not exhaustive, in my opinion, it meets the use group and construction requirements outlined in the Virginia Construction Code for the proposed use.
