Dear Ms. Schlein:
Staff has reviewed your initial submittal for the special use permit, SP201900012, Field School of Charlottesville
amendmen. We have a number of questions and comments which we believe should be addressed before we can
recommend favorably on your SP request. We would be glad to meet with you to discuss these issues.
Review comments are provided below, organized by Department, Division, or agency. Our comments are provided below:
Planning — General Application Comments
1. Include the application file number that was given to this application, SP2019-00012, on the concept plan and in
the project narrative.
2. Include on the cover sheet of the narrative that a Water Protection Ordinance (WPO) stream buffer is located on
this site.
3. Include on the cover sheet of the narrative that this property is located within the Ivy Creek water supply
watershed.
4. Revise the additional zoning considerations note to remove "steep slopes." Retain only "critical slopes."
5. Revise the information on the cover sheet to clarify the proposed zoning, as the "special use — private middle
school" is already permitted by the existing special use permit, SP2015-00024, and this SP request is only
amending that existing permit.
6. Although the project proposal states that the general layout of the project is not changing, one of the reserve
drainfields depicted on the original concept plan is shown to be located within the 3.57 acres proposed to be
transferred to the neighbors. Because this property is not on public sewer and not in the jurisdictional area, septic
fields approved by the Virginia Department of Health are required. Demonstrate a new area where the drainfield
can be located.
7. In the project narrative, clarify the language regarding the provision of utilities and the availability of public water
and sewer. There are several instances in the project narrative where it is mentioned that a request for a
jurisdictional area expansion of public water is made with this application. Such a request was not submitted with
this application. However, it looks like this property is already located within the jurisdictional area for public
water. If so, remove this language from the narrative and clarify that there already exists the availability of public
water at this site. There are a few discrepancies regarding this language throughout the narrative.
8. In addition, it may help to more clearly identify which parts of the project narrative are new to SP2019-00012 and
which parts are looking back to the narrative for SP2015-00024.
9. In the narrative, clarify whether a critical slopes waiver has been approved for the proposed disturbance of critical
slopes, and provide the date it was approved if that is the case.
10. The location of the proposed picnic pavilion may not be feasible with the revised location of the tree buffer. On
the revised concept plan, the location of the pavilion is completely surrounded by protected environmental
features, where grading and construction would not be permitted to access the pavilion site. The tree buffer is to
the east and south, the stream buffer is to the west, and critical slopes not proposed to be disturbed are to the
north.
11. Where is the SP number in the heading of the traffic counts coming from? It is neither the number for this
application or the application proposed to be amended (SP2015-00024).
12. The narrative explains that there is little impact on the fire and police departments. Elaborate further, as a private
school would seem to have a large impact on such services.
13. Revise the zoning note on the cover sheet of the concept plan to include the Airport Impact Area.
14. On the concept plan, especially sheet C6, make the property line bolder all around the subject parcel, as it is
difficult to differentiate the property line from the many other elements on the plan, such as the setbacks, tree
buffers, and critical slope areas, making it hard for staff to accurately review the proposed new plan and the
revised elements being depicted.
15. On the concept plan, provide a legend for all of the shaded areas. For example, the area of shading at the
southwest corner of the 3.57 acre parcel is not identified in either a legend or a label, and it is unclear to staff what
is being depicted.
16. If outdoor lighting is proposed, a lighting plan that complies with section 4.17 of the Albemarle County Zoning
Ordinance will have to be submitted as a part of the site plan at that stage of development.
17. Conditions for this special use permit have not been written by staff at this time; however, they will be provided
for review by the applicant prior to the first public hearing. It is likely that, at a minimum, all existing conditions
from SP2015-00024 will continue with this proposed special use permit (although they may be modified to be
consistent with this new SP), except for those conditions that specifically reference the original concept plan.
Those conditions will be revised to reference the proposed new concept plan. The condition on the maximum
enrollment number will remain, as that condition is not proposed to be amended with this SP application.
18. Please be advised that site plans and VSMP plans will be required at the site development stage if this special use
permit is approved by the Board.
19. A boundary line adjustment plat will be required to transfer the proposed 3.57 acres from the Field School's
property to the neighboring property owners.
Comprehensive Plan
Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below. Comments on
conformity with the Comprehensive Plan are provided to the Planning Commission and Board of Supervisors as part of
the staff report.
The Comprehensive Plan identifies Tax Map Parcel (TMP) 06000-00-00-06800 as Rural Areas. A full review against the
Comprehensive Plan was not performed for this application because the private school use has already been approved.
The major revision of shifting the tree buffer maintains a more rural character for neighboring properties by screening the
school from other uses. However, the reduction in the size of the parcel that the school is sited on does cause the school
use to become more intensive related to its smaller parcel size, which may have greater impact on neighbors because of
less open space on the parcel relative to its overall size.
Neighborhood Model
This project is not located within the Development Areas and thus was not reviewed for consistency with the
Neighborhood Model Principles found in the Comprehensive Plan.

ACTION AFTER RECEIPT OF COMMENT LETTER
FIRST SET OF COMMENTS
Your project has been scheduled for a public hearing by the Planning Commission for February 18,
2020, which is 77 days from the date your application was accepted for review. State Code requires a
90-day review by the Planning Commission unless the applicant requests deferral. As you will read in
this comment letter, staff recommends changes to your project to help you achieve approval. Without
these changes, staff cannot recommend approval to the Planning Commission.
If you would like to address the comments, you must request deferral by January 17, 2020. If you
choose not to request deferral, staff will take your project to the Commission as originally submitted,
but without a recommendation of approval. Instructions for requesting a deferral are outlined below.
Please note that you can submit revisions even if you defer your application.
Please do one of the following on or before January 17, 2020:
(1) Request deferral to resubmit to address comments, pursuant to Section 33.52(A)(1).
Please understand that if a deferral request is made, the Planning Commission public
hearing date will be later than February 18, 2020.
(2) Request to proceed to a Planning Commission public hearing on February 18, 2020. All
advertising fees must be paid by January 24, 2020.
(3) Withdraw your application.
(1) Deferral Request and Resubmittal
To request deferral, you must submit a request in writing to defer action by the Planning Commission
and Board of Supervisors. The request may be made by email. You may request a deferral for up to 36
months from the date your application was accepted for review, which is December 3, 2022. However,
all outstanding information necessary for Commission action must be submitted by June 3, 2022,
according to the published schedule. (See Section 18-33.52 (A)(2) of the Albemarle County Code).

(2) Proceed to Planning Commission Public Hearing on February 18, 2020
At this time, you may request that your application proceed to public hearing with the Planning
Commission on February 18, 2020. With this option, staff will take your project to the Commission as
originally submitted, but without a recommendation of approval.
(3) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Resubmittals
As stated above, a deferral does not preclude you from resubmitting the application to address
changes based upon the comments. If you would like to resubmit after you defer, you may do so
following the resubmittal schedule. Be sure to include the resubmittal form on the last page of your
comment letter with vour submittal.
The application fee which you paid covers staff review of the initial submittal and one resubmittal.
Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.)
Failure to Respond
An application shall be deemed to be voluntarily withdrawn if the applicant requests deferral pursuant
to subsection 33.52(A), and fails to provide within 120 days before the end of the deferral period all of
the information required to allow the Board to act on the application. (See Section 18-33.53 (C) of the
Albemarle County Code).
Fee Payment
Fees paid in cash or by check must be paid at the Community Development Intake Counter. Make
checks payable to the County of Albemarle. Do not send checks directly to the Review Coordinator.
