Sorry about that. In regard to the 50' right-of-way, VDOT sent me an email saying that it is a public right-of-way. The deed refers to it as a "nonexclusive right of ingress and egress." Is the plan to have Parcels A and B use that right-of-way as a shared driveway to serve future dwelling units on either parcel? Or will they enter directly onto Jones Mill Road (State Route 811)? I communicated this to the applicant and they said that it is neither a public road nor a private street, just a private easement. I checked the deed for it which says it is a "nonexclusive right of ingress and egress." The applicant wanted me to verify with VDOT whether it is a public road or not. Gwen lacy with Roger Ray & Associates forwarded me an email from you that granted approval for entrances onto the public streets for the lots. I've attached the email above. I was looking into the existing 50' right-of-way (DB 1779, page 367) that runs along the proposed lot line between Parcel A and Parcel B. I can't figure out whether that is a private street or a public ROW. It is currently used by TMP 40-50A to the west of the proposed subdivision as an access way to State Route 811, Jones Mill Road. In your letter, you mentioned that both Parcel A and B could utilize that existing 50' right-of-way to access either parcel if necessary. My question is: if a single family home gets built on both Parcel A and Parcel B and they want to use that 50' ROW instead of a direct entrance onto Jones Mill Road, are there any VDOT regulations that would require the 50' ROW to be upgraded to a higher standard since three lots would be using that ROW? Any help you can give me will be much appreciated! Gwen lacy with Roger Ray & Associates forwarded me an email from you that granted approval for entrances onto the public streets for the lots. I've attached the email above. I was looking into the existing 50' right-of-way (DB 1779, page 367) that runs along the proposed lot line between Parcel A and Parcel B. I can't figure out whether that is a private street or a public ROW. It is currently used by TMP 40-50A to the west of the proposed subdivision as an access way to State Route 811, Jones Mill Road. In your letter, you mentioned that both Parcel A and B could utilize that existing 50' right-of-way to access either parcel if necessary. My question is: if a single family home gets built on both Parcel A and Parcel B and they want to use that 50' ROW instead of a direct entrance onto Jones Mill Road, are there any VDOT regulations that would require the 50' ROW to be upgraded to a higher standard since three lots would be using that ROW? Any help you can give me will be much appreciated!
