I just wanted to touch base on SDP2018-86 Boyd Tavern Initial Site Plan.
After discussing it with others, including David Benish, despite the strange circumstances of the
previous submission, the Tier 3 Groundwater Assessment fee ($548) does need to be paid with this
initial site plan.
I apologize for the delay, but I did not want to specify that you had to pay it if it turned out not to be
necessary.
Also, previously I forgot to point out that the Fire Rescue fee ($100) had also not been paid.
So please have those payments made as soon as possible. I know the holidays may slow things down.
Please ensure that when the fees are paid that those specific fees and the project number are included
so that the intake staff knows how to process it.

Their original one was missing things, such as the dates for the signatures, and (because this project has a very litigious
circumstance) they needed to provide me one that has everything. The lawyers will tear it to pieces otherwise...

They originally paid the wrong type of "Initial Site Plan" fee.
There was no preapplication plan for this project.
They previously paid the lesser fee as if there had been a preapplication plan.
So, they should be paying the difference between the two different "Initial Site Plan" fees.

We received the submission for SDP201886 Boyd Tavern Market - Initial Site Plan. At this time its official submittal date
is 12/10/18 (today).
In the initial processing we found some issues that we would like to have resolved early this week in order to ensure
that the validity of the submission will not be questioned by any parties.
Attached I've marked up the application and checklist. Some of these items are likely just accidental omissions. Others
may be because of the previous initial site plan submission and possible assumptions being made as how a second initial
site plan should be submitted.
I've found the following issues that I would like to have resolved early this week in order to keep it on the 12/10/18
submittal date timeline.
• The wrong fee was paid for the initial site plan. There was no preapplication plan, and therefore the lesser
application fee is not correct.
• There must be a Tier 3 groundwater assessment draft submitted. If you wish us to utilize the one from the
previous initial site plan please let us know asap. Despite the previous submission of a groundwater assessment
at the previous initial site plan submission, a Tier 3 groundwater draft assessment must be part of this initial site
plan review in order to ensure no questions of validity of the submission can be raised.
• If a new (revised) Tier 3 groundwater assessment is submitted, instead of you choosing to utilize the previous
one (see above), the fee should be submitted asap. If you choose to have us utilize the previous Tier III
groundwater assessment I will have to get back with you about the fee. I need to get an official decision on how
to handle such a rare occurrence.
• While you are paying fees, you may as well pay the notification fee now instead of later. Otherwise it will be a
comment on the day of the SRC meeting. It has been determined that the default $21S is sufficient since there
are so few adjoining parcels.
• The application must have the signature, date, printed name, and phone number included on the
application. Again, this is to avoid the validity of the submission being questioned.

Maybe the updated application and checklist could be submitted at the same time as the additional fees are paid.
Hopefully this catches the items a third party may call into question later. If you think of anything I've missed please let
me know.
