any thoughts on potential encroachments along the propertyline, outside the
designated tree conservation area? (that's the initial portion of the common
propertyline starting at rt250)--- my thought is to graphically extend the
encroachment in this area to 75' -100' beyond the propertyline and reduce
it to 50' before entering the conservation area. i then suggest:
"The hatched area, labeled "Potential Encroachment Area", is proffered
for the purposes of accommodating future grading and/or construction
of as yet undefined infrastructure. Any encroachment shall be to the
minimum
extent necessary and shall be subject to approval by the Director of
Planning.
The maximum encroachment into the designated Tree Conservation Area shall be
fifty(50)feet from the common property boundary between Tax Map 78 parcel
13
and Tax Map 78 parcel 73A."

How about...

Instead of...
"Additional grading of this area and construction of infrastructure,
including a maximum 50' encroachment into the designated tree conservation
area, is allowed subject to approval by the Director of Planning."
If you agree to this rewrite, notice that I believe that you should hatch
the area under consideration on the plan and label it"Potential
Encroachment Area." This will hopefully make future interpretation crystal
clear to everyone.
