County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is denied. The
rationale is given in the comments below. The application may be resubmitted for approval if all
of the items below are satisfactorily addressed. The VSMP application content requirements can
be found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. SWPPP was not provided with this submission. Provide two copies of a SWPPP. If overall
Brookhill SWPPP is to be used, provide updated registration statement and an overall sheet
showing disturbed area covered by the registration statement. Rev. 1: Clarify the construction
activity operator. When entered in the entity search, it is unclear which company this is:

5. Rev. 3: Please provide another copy of the SWPPP. Only 1 was provided.
B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. PPP was not provided with this submission. Provide two copies of a PPP and ensure it contains
everything as outlined in County Code section 17-404. If E&S plan is intended to be used for
PPP, ensure it shows all requirements and provide a note. Rev. 1:Comment addressed.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-403.
1. Professional seal must be signed and dated. Rev. 1: Comment still valid. Provide seal on
calculations packet as well. Rev. 2: Comment addressed.
2. Stormwater management must incorporate approved WPO Plans: WP0201700027,
WP0201700037 and WP0201800013. These plans have an approved pond, pond 10, on this site
as well as a proposed level spreader at the outfall. The grading and storm pipes from these
approved plans should be shown as existing conditions on this application. A narrative should be
provided to show how your plans revise/remove this pond and still meet requirements. The
drainage area that was sent to approved Pond 10 must be collected on this application. Pipes
shown as existing must match the approved plans. Rev. 1:Comment addressed.
3. The Overall Brookhill Stormwater Quality Compliance Table must be updated and provided with
this application. The land in this application was part of an already approved treatment train for
the Brookhill Development. A narrative must be provided to explain how this application will
comply with the overall, approved plan. Rev. 1: Please obtain the original excel spreadsheet, do
not provide strikethroughs. Also, add the credits purchased in the applicable locations. Rev. 2:
Comment addressed. However, please revise note 2 on Sheet 9. It shouldn't say THIS plan is
WP02018000018. Rev. 3: Please clarify that 1.53 lb/yr will be purchased. Sheet 9 says 1.53,
however, the calculations packet narrative/summary says 0.83.
4. Label the buffer as proposed greenway per the approved ZMA. Rev. 1:Sheets 1 and 2 still say
WPO stream buffer. Rev. 2: Comment addressed.
5. Provide approved FDP permit # and CLOMR. Rev. 1: Comment still valid. Rev. 2: Comment
not addressed. FDP is 201600004. Rev. 3: Comment addressed.
6. Show easements as shown on SUB201800187. If these are recorded, show the deed book and
page #. Plat is currently under review at County Attorney's office. Rev. 1: Comment still valid.

7. Per page 19 of the Code of Development, the Brookhill Historic buffer shall be natural and
undisturbed. Please revise grading to be outside of the 20ft historic buffer. Rev. 1:Comment

8. [Sheet 2]:Sheet 2 notes that SDP201700117 is under review. It is SUB201700117 and it is
approved. Rev. 1: Still labeled as SDP, not SUB. Rev. 2: Comment addressed.

10. [Calculations packet] In section 13.3.a, what is Q dev? Show that it is less than the calculation for

12. [Sheet 2] Please label the approved plan # and not just state "under different set of plans" Rev.

13. Graphic scale is not measuring correctly throughout the plans. Please revise. Note that grading
could not be accurately measured without a scale. It appears that certain areas are steeper than

14. Ensure this TMP is covered by the existing SWM maintenance agreement. Otherwise, a SWM
maintenance agreement will be necessary before plan approval. Rev. 1:Comment addressed.
15. Rev. 1: Provide map showing areas used for VRRM calculations. Note is very clear and
explains that more area is used for the quantity analysis and is different from the quality
analysis. However, there is no map outlining what areas were used for VRRM. Please note
that only the disturbed area must be included (any change in land cover), not necessarily
the whole parcel. Rev. 2: Comment addressed.
16. Rev 1: [Sheet 6] Please clarify the proposed impervious area summary tables. There are two
(A, B, C and overall) and they do not add up to each other. Rev. 2: Comment addressed.
17. Rev. 1: [Sheet 7] Show that everything in table 14.2 is met for a level 2 pond. This includes

D. Erosion and Sediment Control Plan (ESOP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESOP.
This plan is approved, and the reasons are provided in the comments below. The erosion control

maximum height of 6ft and provide details. Must also follow steep slopes overlay requirements

12. Tree protection fencing should be on the inside of the historic buffer, not outside of the property

13. [Sheets 4 & 51 Show outlet protection sizing and dimensions, not just OP symbol. Rev. 1:

on the plans, not just in the calculations packet. Rev. 2: Comment addressed.
14. Rev. 1: [Sheet 41 Notes say storm sewer to be modified and storm sewer to be re-routed, but
do not offer a plan # or any other information. Please clarify. Rev. 2: Comment addressed.
15. Rev. 1: [Sheet 4] Ensure grading for ST #1 will tie in to existing conditions if the approved
pond is not built. (Or add a note directing contractor what to do). Rev. 2: Comment

16. Rev. 2: As discussed in meeting, please remove notes stating that retaining walls will act as
sediment traps and provide interim phase for when sediment trap is removed. Rev. 3:

17. Rev. 2: Provide note or detail with specification about baffles. They must extend from the
bottom to 6" above the overflow. Rev. 3: Comment addressed.
The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond
estimate request form and fee to the Department of Community Development. One of the plan reviewers
will prepare estimates and check parcel and easement information based on the approved plans. The
County's Management Analyst will prepare bond agreement forms, which will need to be completed by
the owner and submitted along with cash, certificates or sureties for the amounts specified. The
agreements will need to be approved and signed by the County Attorney and County Engineer. This may
take 2-4 weeks to obtain all the correct signatures and forms.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves
the application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the
remainder of the application fee. The form identifies the contractor and responsible land disturber, and
the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction
conference will be scheduled with the County inspector. At the pre -construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.
