Ms. Haynes:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned Highway Commercial (HC). The permitted uses of the Property
are provided in Section 24 of Chapter 18 of the Albemarle County Code ("Zoning
Ordinance"). The Property is subject to the Entrance Corridor ("EC") Overlay District,
and the Steep Slopes Overlay District, as described in Section 30 of Chapter 18 of the
Albemarle County Code ("Zoning Ordinance").
• The existing use of the site as "an automobile dealership business, including the sale,
servicing and/or storage of motor vehicles" is a by right use in the Highway
Commercial zoning district.
• The Property is subject to Site Plan SDP2004-0084, approved on November 1, 2004.
Expansion of the facilities is permitted subject to approval of a new Site Plan
Amendment.
• The Property complies with all Albemarle County zoning regulations including setbacks,
parking and loading requirements.
• The Property is subject to Special Use Permit SP1994-00004, approved on April 14,
1994, for outdoor storage and display in the Entrance Corridor with conditions. All of
the conditions have been met. Special Use Permits run with the Property.
• There are no pending rezoning, special exception, special permit or variance
applications, nor are there any outstanding zoning enforcement actions or any violations
or complaints with regard to the Property.
• Copies of any applicable records may be obtained via the noted links or from this office
with a request through the department's Records Manager, Paul Bjornsen, at
pbjornsenalbemarle.org once they have been approved or issued.
