Mr. Higgins,
On behalf of Route 240 Holdings, LLC, Daily South, LLC, Foothills Crossing Inc.,
and Route 240 LLC (collectively, the "Owners"), the owner of that certain real
property located in Albemarle County, Virginia, situated on Tax Map Parcel Nos. 056-
00-00-057CO, 056A2-01-00-06200, 05600-00-00-057B2, 056KO-00-00-OOOA2, a
portion of 056A2-01-00-06100 (the "Rezoned Property") and 05600-00-00-057DO,
05600-00-00-057111 (the `By Right Property, together with the Rezoned Property, the
"Property"), we request an official zoning confirmation letter and bulk regulation
compliance letter.
We would appreciate it if your office could provide a letter in substantially the form
attached hereto confirming the items described therein, to the extent possible, for the
Property. Additionally, I have enclosed a check to Albemarle County in the amount of
$199.00, and a completed Albemarle County Zoning Compliance Request Form.

The properties which are currently owned Route 240 Holdings, LLC, Daily South, LLC,
Foothills Crossing Inc., and Route 240 LLC (collectively, the "Owners") and designated in the
County's real estate tax records as Parcel ID Nos. 056-00-00-057CO, 056A2-01-00-06200,
05600-00-00-057B2, 056KO-00-00-OOOA2, a portion of 056A2-01-00-06100 (the "Rezoned
Property") and 05600-00-00-057DO, 05600-00-00-057B1 (the "By Right Property, together with
the Rezoned Property, the "Property"). We are pleased to advise you that:
1. The Property is currently zoned Residential R-6 (Chapter 18, Section 16 of Albemarle
County's Zoning Ordinance).
2. The Rezoned Property was rezoned to Residential R-6 as per ZMA 2016-05, approved
February 8, 2017 and subject to proffers dated as of February 6, 2017. The proffers
permit up to 180 dwelling units to be built on the Rezoned Property.
3. The By Right Property is zoned Residential R-6 by right, i.e. not subject to any proffers.
The zoning of the By Right Property permits a maximum of 131 dwelling units as per the
permitted density of 6 residential dwelling units per acre and the By Right Property being
approximately 21.92 acres.
4. The Property's maximum of 311 dwelling units is permitted as without the necessity of
obtaining any additional conditional or special use permit, variance, special exception or

other authorization or approval.
5. The Owner intends to develop the Property per the approved plans, those pending review,
and according to the Property's R-6 Residential zone. The ability of the Owner to
develop the Property is limited only by applicable use regulations, site plan regulations,
the aforementioned approved proffers and water protection ordinance regulations.
6. The Property is not subject to a special exception, special use permit or variance
application.
7. There are no known violations, exceptions, variances or nonconforming uses on the
subject property.

On February 8, 2017, the Board of took action on your Zoning Map Amendment application
request to to rezone Tax Map Parcels 056000000057CO, 056000000057132, and 056K0000000OA2
from RI -Residential to R6-Residential; parcel 056A2010006200 from R2-Residential to R6-
Residential; and a portion of parcel 056A2010006100 from LI-Light Industrial to R6-Residential
for a total of approximately 38 acres, in the White Hall District. The Zoning Map Amendment
permit was approved by the Board's adoption of the attached resolution and proffers.

AN ORDINANCE TO REZONE 32.54 ACRES FROM RI -RESIDENTIAL,
2.13 ACRES FROM R2-RESIDENTIAL, AND 3.24 ACRES FROM LI-LIGHT INDUSTRY,
TO R6-RESIDENTIAL FOR TAX MAP PARCEL NUMBERS 056004)0-00-057CO,
05600-00-00-057B2, 056KO-00-00-00OA2, 056A2-01-00-06200, AND 056A2-01-00-06100
WHEREAS, the application to rezone 32.54 acres from RI -Residential, 2.13 acres from R2-Residential, and
3.24 acres from LI-Light Industry, to R6-Residential for Tax Map Parcel Numbers 05600-00-00-057CO, 05600-00-00-
057B2, 056KO-00-00-00OA2, 056A2-01-00-06200, and 056A2-01-00-06100 is identified as ZMA 2016-00005
Foothills Daily Property C ZMA 2016-05"); and
WHEREAS, staff recommended approval of ZMA 20I6-05 provided that revisions were made to the proffers
and the rezoning application plan; and
WHEREAS, the Planning Commission held a duly noticed public hearing on ZMA 2016-05 on September
13, 2016, and recommended approval, conditioned on the applicant making the staff -recommended revisions, and
those revisions have since been made; and
WffEREAS, on February 1, 2017, the Albemarle County Board of Supervisors held a duly noticed public
bearing on ZMA 2016-05; and
WHEREAS, on February 8, 2017, the Albemarle County Board of Supervisors considered ZMA 20I6-05 for
action that included an amendment to Proffer 8 that did not materially affect the overall proposal.
BE IT ORDAINED by the Board of Supervisors of the County of Albemarle, Virginia, that upon
consideration of the staff report prepared for ZMA 2016-05 and its attachments, including the proffers dated
January 3, 2017 and the rezoning application plan entitled "Foothills Crossing Zoning Map Amendment Application
Plan' dated February 16, 2016 and last revised on January 3, 2017, the information presented at the public bearing, the
material and relevant factors in Virginia Code § 15.2-2284, the intent of the R6-Residential district stated in County
Code § 18-16.1, and for the purposes of public necessity, convenience, general welfare and good zoning practices, the
Board hereby approves ZMA 2016-05 with the proffers dated February 6, 2017 and the concept plan dated February
16, 2016 and last revised on January 3, 2017.
