The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County Code.] [14-302(A)(4-5), 14-302(A)(15)] Easements. a. Conservation easement. As part of staff s review of this BLA, staff has identified a conservation easement on the subject property that has implications for this plat and previous plats and site plans. Please see the attached recorded instrument (DB 2544 PG 243-251). Are you aware of this plat? b. Public Slope easement. Please expand on the purpose of this easement (DB 4077 PG 311). It appears this was recorded without County review and was a VDOT plat. c. Other easements. Refer to DB 2607 PG 572-575 for other easements to which the property may be subject. d. Generally. i. Note and demonstrate all easement areas on the plat. ii. Provide a deed book and page number for the recorded easements. iii. Identify the owner of the easement. 2. [14-302(B)(5), ZMA200100015] Proffers. Based on internal discussions, the existing special lot and proposed changes may be inconsistent with Proffer #4. County staff would like to schedule a meeting with the developer/applicant, County Parks & Recreation staff, and Zoning staff, to further discuss, in particular, what constitutes "reasonable provision for access" to the Rivanna Greenway System. 3. [14-302(B)(5)] Zoning. a. One of the parcels is also within the Entrance Corridor Overlay District. Revise the zoning notes accordingly. b. State that the property is subject to proffers associated with ZMA200100015. 4. [14-302(A)(1)] Title. It looks like there may have been a clerical error in the naming of this plat. Was the title supposed to be "...Tax Map 78, Parcel 20M5 and Tax Map 78, Parcel 20M6..."? 5. [ 14-302(A)(2)] Vicinity map. Review and revise the vicinity map to ensure parcels are correctly identified. For example, the parcel north of the site is 78-20M4, not 78-20M. 6. [14-302(A)(7)] Lot lines. The location of departing and surrounding parcel lot lines are not accurately reflected on this plat map. Revise the plat to demonstrate the accurate lot lines for parcels TMP 78-20M1, TMP 78-20M2 (as this parcel is related to the conservation easement mentioned above), TMP 78-20J, and TMP 78-20F (if desired). 7. [14-426, 14-427] Special Lot. a. Note on the plat that TMP 78-20M5 is a Special Lot. b. Provide a note on the plat, similar to that provided on DB 5224 PG 200, that states "The revised TMP 78-30M, being 4.215ac, is a Special Lot established solely for use as Open Space, and is reserved for..." (refer to note on previous plat from 2019). 8. [14-303(A)] Dedication statement. The special lot is not being created by this plat. Revise the dedication statement. 9. [14-302(B)(10)] Stream buffers. Confirm whether stream buffer areas are present on TMP 78-20M6. If so, refer to 14- 302(B)(10). 10. [14-302(B)(1)] General information. For the resubmission, include a date of revision on the plat. In accordance with the provisions of Z.O. 14-229 of the County Code, if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this letter, the application shall be deemed to have been voluntarily withdrawn by the applicant.
