HomeMy WebLinkAboutSDP200400020 Executive SummaryCOUNTY OF ALBEMARLE EXECUTIVE SUMMARY AGENDA TITLE: SDP 04 -020 Old Dominion Equine Site Plan Waiver Request SUBJECT /PROPOSAL /REQUEST: Request for a site plan waiver to allow an equine veterinary practice on 1.704 acres zoned RA - Rural Areas and EC Entrance Corridor. The property, described as Tax Map 50 Parcels 20C and 20D, is located on Gordonsville Road [Route 231 ] at the intersection of St. John Road [Route 640], in the Rivanna Magisterial District. The Comprehensive Plan designates this property as Rural Areas in Rural Area 2, (Attachment A). Redevelopment of the site includes removal of the existing asphalt and entrances on Gordonsville Road associated with the former Cash's Corner Store and constructing a new entrance on St. John Road, (Attachment B). The submittal of this request is a follow up from a recently approved Special Use Permit. This proposal warrants the need for a site plan. In accord with Section 32.2.2 of the Zoning Ordinance, the applicant is requesting that the Planning Commission waive the drawing of certain aspects of the required site plan. DISCUSSION: Section 32.2.2 of the Zoning Ordinance states: "The forgoing notwithstanding, after notice in accordance with Section 32.4.2.5, the Commission may waive the drawing of a site development plan in a particular case upon finding that the requirement of such plan would not forward the purposes of this ordinance or otherwise serve the public interest; provided that no such waiver shall be made until the Commission has considered the recommendation of the agent." In this particular case requirement of a site plan would not forward the purposes of the ordinance or otherwise serve the public interest. That being said, the applicant has submitted a plan, (see Attachment B), which shows improvements in accord with the conceptual plan submitted with SP 2003 -082 Old Dominion Equine Associates approved by the Board of Supervisors on 4/14/04. The plan meets most of the site plan contents requirement and has allowed staff to adequately review and comment on the details of the proposal. The submitted plan also meets most of those conditions imposed by SP 03 -082, (Attachment Q. Those conditions imposed by SP 03 -082 still outstanding appear below as conditions of approval of this waiver. They include ARB approval of landscaping measures and platting of the sight distance easement required by VDOT. The Site Review Committee has reviewed this request and has not identified any unfavorable conditions that would arise from the approval of the site plan waiver. Therefore staff recommends approval of the site plan waiver request with all conditions specified below. RECOMMENDATION AND CONDITIONS OF APPROVAL: Staff recommends approval of the request for a site plan waiver with the following conditions: 1. Prior to the commencement of any construction activity, an erosion and sediment control plan and a stormwater management plan must be reviewed and approved by the Engineering Department. [17 -201D & 17- 203,303] 2. County approval and recordation of a plat which combines Tax Map 50, Parcels 20C and 20D into one parcel and which creates the VDOT required sight distance easement. 3. Reference the special use permit number (SP 03 -082) and note the conditions of the special use permit on the plan. 4. Plan approval is subject to the issuance of a Certificate of Appropriateness from the Architectural Review Board. [30.6] 5. Approval of a Landscape Plan which meets the requirements of Section 32.7.9 of the Zoning Ordinance or approval of a Landscape Plan Waiver per section 32.7.9.3. [32.6.3] 6. Provide a soils report to be forwarded to the Health Department for their approval of all drainfield locations. If Health Department approval has already been granted, provide a copy of the letter of approval to Planning Department staff.
