Beshear Old Dominion Equine Associates 1524 Insurance Lane, Suite D Charlottesville, VA 22911 RE: SDP 04 -020: Old Dominion Equine Site Plan Waiver Dear Dr. Beshear: FAX (434) 972 -4012 The Albemarle County Planning Commission, on its May 11, 2004 consent agenda, unanimously approved the above -noted request for a site plan waiver. Please note that this approval is subject to the following conditions: 1. Prior to the commencement of any construction activity, an erosion and sediment control plan and a stormwater management plan must be reviewed and approved by the Engineering Department. [17- 201D & 17- 203,303] 2. County approval and recordation of a plat which combines Tax Map 50, Parcels 20C and 20D into one parcel and which creates the VDOT required sight distance easement. 3. Reference the special use permit number (SP 03 -082) and note the conditions of the special use permit on the plan. 4. Plan approval is subject to the issuance of a Certificate of Appropriateness from the Architectural Review Board. [30.6] 5. Approval of a Landscape Plan which meets the requirements of Section 32.7.9 of the Zoning Ordinance or approval of a Landscape Plan Waiver per section 32.7.9.3. [32.6.3] 6. Provide a soils report to be forwarded to the Health Department for their approval of all drainfield locations. If Health Department approval has already been granted, provide a copy of the letter of approval to Planning Department staff. Because of the nature of the proposed project I find that requiring a landscape plan would not forward the purposes of the Zoning Ordinance, or otherwise serve the public interest. Conditions of approval: 1. Conservation of all existing trees shown on the Concept Plan titled "Old Dominion Equine Associates, Albemarle County, Virginia; Tax Map 50, Parcels 20C & 201)" drawn by Tom Muncaster., dated 11/11/03 and further revised, heretofore referred to as "The Plan." 2. Provide a 20' -wide screening buffer. Within the screening buffer provide two (2) staggered rows of either 2' high Prunus Laurocerusus (`Schipkaensis'), planted 5 -feet on center, or 2' high Ilex x "Nellie R. Stevens ", planted 10' on center; or a combination of both, along the common eastern boundary shared by Tax Map 50, Parcels 20C & 20D and Tax Map 50, Parcel 20E. 3. The owner of the property shall be liable for the decline, death, or removal of any tree(s), located within the tree lines shown on The Plan. If any tree(s) shown on the plan, within this area, dies or is removed, the developer shall replace said tree(s) with an acceptable substitute subject to approval by the County agent. Any action causing such removal, not shown on subsequent amendments to the site plan, shall be a violation of Section 32.7.9 of the Zoning Ordinance.
