We have a number of questions and comments which we believe should be addressed before we can recommend favorably on your SP request. We would be glad to meet with you to discuss these issues. Review comments are provided below, organized by Department, Division, or agency. Our comments are provided below: Planning — General Application Comments 1. At the beginning of the project narrative, provide the following site data information: a. The application number, SP2020-00001. b. The address of the property. c. The zoning of the property, including any overlay district(s), which are for this property: i. Zoning: R-2, Residential ii. Overlay District: Steep Slopes — Managed 2. In the project narrative, provide the following additional information: a. Proposed number of employees. b. Proposed number of spots for each group of children. You do mention briefly that after -school spots are expected to increase by only 5-10 students, but not the other groups. c. Proposed number of children outside at one time, including both pre-school age children and the older children. Will there be groups of both ages outside at the same time? d. Rough estimate of the number of children who walk or bike to the Little Explorers Discovery School. e. In the "Impacts on Public Facilities and Public Infrastructure" section, include potential impacts, if any, on fire and police services from this proposed use. 3. Is the entire backyard area fenced? With the increase in the number of students present, it may be appropriate to utilize a larger part of the backyard, or the whole backyard, of the church during outdoor play time to ensure activity, and any resulting noise, is spread across the property. 4. The project narrative mentions that additional playground features may be added over time. Is there a proposed timeline for adding these features? What types of features may there be? Where are they proposed to be located? Near the existing playground? Or spread throughout the churchyard to minimize the impact on any one spot and any specific neighboring property? (See comment #3 above.) 5. Advisory Comment: This use, if approved by the Board of Supervisors, will have to be in compliance with the supplementary regulations found in Section 5.1.06, Child Day Centers, of Chapter 18, the Zoning Ordinance, of the Albemarle County Code (hit2s:Hlibrary.municode.com/va/albemarte_county/codes/code_of ordinances?nodeld=COALCOVI_CH18Z0_S 5SURE S5.ISURE S5.1.06CHDACE). 6. Advisory Comment: Conditions for this special use permit have not been written by staff at this time; however, they will be provided for review by the applicant prior to the first public hearing with the Planning Commission. It is likely that, at a minimum, all existing conditions from SP2018-00006 will continue with this proposed special use permit, although they may be modified to be consistent with this new SP request, such as hours of operation and enrollment limitations. Conditions are provided to the Planning Commission and the Board of Supervisors as recommendations from staff to mitigate possible impacts of the use if the Board of Supervisors chooses to approve this special use permit request. 7. Advisory Comment: Additional comments or questions may be provided to you after the Community Meeting is held at the Crozet CAC meeting on Wed., March 11', at the Crozet Library. These additional comments or questions will be based upon the discussion and any concerns or issues that are raised by nearby residents and property owners and the CAC members at this meeting. Comprehensive Plan Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below. Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and Board of Supervisors as part of the staff report. The 2010 Crozet Master Plan identifies Tax Map Parcel (TMP) 056A1-01-00-08200 as Neighborhood Density Residential, recommending residential uses at a density of 3-6 units per acre, along with certain non-residential uses that serve the surrounding neighborhood. These uses include institutional uses, such as places of worship and early childhood education centers, and retail/commercial/office uses of less than 5,000 square feet. The St. George Ave. corridor is composed mostly of single-family residential houses, along with a few of the above -mentioned non-residential uses, including two churches and a funeral home. The expansion of the existing child day center proposed with this special use permit request appears to be consistent with the recommended land uses of the Neighborhood Density Residential designation, as it is an early childhood education center sharing space with a place of worship. Neighborhood Model This project was not reviewed at this time for consistency with the Neighborhood Model Principles found in the Comprehensive Plan. This application is a request for an amendment to an existing special use permit, for a use that is located in an existing building with existing parking, and this request does not propose any new structures, parking, or other infrastructure. State Code requires a 90-day review by the Planning Commission unless the applicant requests deferral. As you will read in this comment letter, staff recommends changes to your project to help you achieve approval. Without these changes, staff cannot recommend approval to the Planning Commission. If you would like to address the comments, you must request deferral by March 27, 2020. If you choose not to request deferral, staff will take your project to the Commission as originally submitted, but without a recommendation of approval. Instructions for requesting a deferral are outlined below. Please note that you can submit revisions even if you defer your application. Resubmittals As stated above, a deferral does not preclude you from resubmitting the application to address changes based upon the comments. If you would like to resubmit after you defer, you may do so following the resubmittal schedule. Be sure to include the resubmittal form on the last page of your comment letter with vour submittal. The application fee which you paid covers staff review of the initial submittal and one resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.) Failure to Respond An application shall be deemed to be voluntarily withdrawn if the applicant requests deferral pursuant to subsection 33.52(A), and fails to provide within 120 days before the end of the deferral period all of the information required to allow the Board to act on the application. (See Section 18-33.53 (C) of the Albemarle County Code). Fee Payment Fees paid in cash or by check must be paid at the Community Development Intake Counter.
