Hello again Valerie, Courtney, Justin, and Kelsey ---
Please find attached the staff report update that was sent to the Planning Commissioners a few moments ago.
Although we didn't and couldn't provide the Commission with a written update last week, David did think it would be
best to give them an opportunity to begin learning about the ongoing staff analysis (and updated staff
recommendations) prior to the public hearing — even if it only reached their inbox a few hours before the meeting
begins.
I hope this info is helpful and reflective of our extensive coordination over the past several weeks. Please contact me
with any questions or concerns you may have prior to the public hearing this evening.
One final issue is how to handle the special exception request to waive the full cutoff requirements. If we're still in
agreement that the outdoor athletic lighting will be selected and installed/operated in a way that complies with the full
cutoff requirements, which would make that special exception request unnecessary, then you may want to consider
withdrawing that particular special exception request. Without withdrawing that special exception request, the PC may
have to evaluate that request and take a vote to provide a formal recommendation to the BOS. Alternately, if you
withdraw that one request, the PC's evaluation would presumably be focused on the remaining special exception
request (relating to the proposed 70' max height of the poles). Just something to consider before the hearing tonight, if
possible (and if not, we'll simply discuss it during the hearing).

Hello Planning Commissioners,
Please find attached an important supplemental update to the August 20 staff report for The Regents School —
Reservoir Road SP application (SP201800011).
I apologize for the timing of this new information; however, this update is a function of some extenuating
circumstances, including a staff error in the notification process. We've been working diligently on this updated analysis
and recommendations for the past two weeks, right up until this "11th hour."
I hope this staff update, and the updated recommendations contained within, are both clear and helpful. I will endeavor
to provide an updated staff report tonight as clearly and concisely as possible; and I/we welcome any and all of your
questions during the agenda item. I will also try to provide assistance this afternoon as best I can, upon request.

Potential (Draft) Updates to Staff Recommendations
UPDATED RECOMMENDED ACTION — SP201800011:
Based on the findings described in this report and factors identified as favorable, inclusive of additional
staff analysis conducted during the unanticipated period of postponement between August 20 and
September 3, staff recommends approval of the special use permit amendment SP201800011 with
the following conditions:

Special Use Permit Concept Plan and Engineering Study for Regents Schoo Charlottesville" -", vtm•k�,
prepared by Justin Shimp, P.E. of Shimp Engineering, dated July 16, 201 .and revised July 1, 2019,
which includes sheets C1 — C6 (the "Concept Plan"), attached hereto, as etermined by the Director
of Planning and Zoning Administrator. To be in general accord with the Co eptual Plan, / SQL r
development and use shall reflect the following major elements within the deve opment-essentrarto iN
the design of the development, as shown on the Conceptual Plan:
a. containment of the "School Facilities Area," "School Recreation Area," and other major
school improvements to the 13.12-acre area designated "School Campus Site" on Sheet
C3;
b. location of the "Lighted Ball Field" within the%`Zchool;Recreation Area" can Sheet C3;
c. location and configuration of 5.99-acre area designated "Undeveloped Residue" on Sheet
C3;
d. adherence to the land use chart on Sheets C4 and C5 specifying "Prohibited Uses" and
"Permitted Uses" for each different "Land Use" area;
1. Development of the subject property shall be in general accord with the concept

Minor modifications to the plan which do not conflict with the elements above may be made to ensure
compliance with the Zoning Ordinance.
Except as otherwise provided herein, initial student enrollment shall be limited to 280 students, and the
start time of the school shall be no later than 7:45 A.M. Notwithstanding the foregoing, student enrollment
may exceed 280 students up to a maximum of 468 students and/or the start time may be shifted to a time
later than 7:45 A.M. (together, "operational changes"), if the Applicant demonstrates to the satisfaction of
the Director of Community Development and his/her designees...

3. The applicants must plan, fund, and implement the transportation improvements to Reservoir Road
shown on the special use permit application materials titled "Reservoir Ro ey for Regents
School," prepared by Justin M. Shimp, P.E. of Shimp Engineering, date 7/1/2019 prior to the
issuance of a Certificate of Occupancy. The proposed improvements are subject to r
approval by VDOT, the County Engineer, and other applicable Site Review Committee members,
and are subject to required County approvals of Road Plans, a Water Protection Ordinance Plan,
and all other applicable permitting requirements.
4. If the use, structure or activity authorized by this special use permit does not commence within a
period of five years,.after the date of approval, the special use permit shall be deemed abandoned
and the authority granted hereunder shall terminate. For the purposes of this condition, the term
"commence" means starting the lawful physical construction of any structure shown on the
Conceptual Plan referenced in Condition 1 above, and this construction shall commence by
September 18, 2024.
