Phase V Hi Chris, The developer has not submitted any new plans to us as of today. I believe they are intending to submit two new applications to subdivide the two properties on Jarman's Gap Road. But they haven't sent us any electronic drawings to preview, and no official paper submissions have come in. I will keep you posted. Moving forward, the old subdivision number, SUB201700091, will not be used. That application will show up as "Denied" in our County View system, which you can access through the County website to view all development applications that have officially been submitted. If/when the new applications come in, they will each be assigned an individual application number. Please let me know if you have any questions! Phase V Good Afternoon Chris, Yes, I received the email you sent earlier this week. I apologize for the delayed response, it's been a hectic week. I only saw one question within the email — specifically when you asked if I will keep you and the other residents informed about this project moving forward should the developer re -submit the plan with a different design. To answer that — yes I will. My plan is to respond to the your first email directly when/if any updates occur. I will keep everyone CC'd so that there aren't dozens of individual email chains going. In terms of a timeline, I can't really provide you with one unless the developer submits a new application. They have until next Monday to officially appeal the disapproval letter, in accordance with County Code Section 14-233(A). I haven't heard from the developer or their engineer as to whether they intend to file an official appeal. In terms of neighbors working with the developer to come up with an alternative design that is acceptable to all parties, that should occur privately between your group and the developer. The County does not mediate those types of discussions for private development. You should ask the developer directly if you'd like to obtain a copy of any plans that they are working on before they officially submit it to the County for review. I can give you the developers contact info so that you can contact them. The engineer is Scott Collins with Collins Engineering. I spoke with the owner yesterday and again this morning, and we are going to resubmit the plan, with only the (2) original parcels, and the (2) original parcels will meet the open space cluster requirements within the limits of each of the property lines. With means we will have (4) lots on the parcel at the intersection of Jarman's Gap and Birmingham Drive and (5) lots at the end of Jackson Lane. We are still seeking a dedication of the open space and will also submit a waiver request to remove the Jackson Lane/Jarman's Gap connection, as suggested by the neighbhorhood. My question is should we/can we still show these two parcels on the same plan, or do they need to be each a separate preliminary plat. Also, attached is the agenda, exhibits, and other information that was submitted prior to the pre -application meeting for the discussions at the pre -application meeting, highlighting the items that we wanted to discuss with staff for this project. As you can see from the provided agenda, the combination of the parcels into the overall Creekside development was the first topic of conversation. We discussed this very issue during the pre -application meeting for this project. The ruling from staff is that these (3) parcels could be "added into" Creekside, making them an overall extension of the Creekside development. There is some additional open space within Creekside that we are utilizing as well. These parcels are not irregularly shaped but continuous with the overall Creekside subdivision and contiguous with the adjacent open spaces that they will be added onto. Therefore, this comment letter that you just sent out does not apply to this development. If it was not an extension of Creekside, but a different development, then yes, what you have laid out in the attachment is correct. But this is not the case with this development, because the ownership is the same and it's a continuation of the development, as discussed during the pre -application meeting. Thx. All neighbors opposed to having their street connect to Jarmins Gap currently take advantage of our road to access Jarmins gap, waiving to us as they drive by when we are visiting our lot. They add traffic to our street and we would prefer they stick to the original plans of having a more convenient access road closer to them. We may be the only owners on our street aware of their plan to increase traffic and I wanted to ensure that we represent current/future owners on this issue. Some neighbors within Creekside came out to the SRC meeting and expressed opposition to the preliminary plat for Creekside V. The developer and his engineer were present at the meeting and a discussion took place between both parties. The neighbors explained that they opposed to construction of Jackson Lane because it would bring more traffic into the neighborhood. The neighbors said that they would be much less opposed to a cul-de-sac being installed as opposed to a through street with access onto Jarmans Gap Road. It was at this point that County Staff explained that the developer could ask for a waiver in order to not construct a full through street. However, this is not something that Staff can approve administratively, and it would require approval by the Planning Commission. They're claiming a 5% density bonus for street trees, 10% density bonus for internal streets, and 15% density bonus for open space they want to dedicate to the County. The proposed density calculation says "0.97 units/acre x 1.30 = 1.261 units/acre." This is my first cluster development so I don't really know what all that means or how we calculate the true density when they use the bonus factors yet, but I included their proposed density calculation in the legal ad.
