SDP 2004 — 71 Mechums River Trestle
The above referenced plan was an application for a wayside stand. The site plan was approved but not as requested
by the applicant. Staff found that a portion of the proposed parking to serve the use would be within the required
buffer from Lickinghole Creek. The applicant has appealed the decision. Attached please find the site plan file for
Mechums River Trestle and the applicant's appeal letters.
As you are aware the Water Protection Ordinance, Program Authority responsibilities have been delegated by Mark
Graham (the Program Authority), to you and Glenn Brooks. Glenn has made a determination which led to the denial
of some use of the property. I am requesting that you in conjunction with Mark Graham review the appeal request
and provide a final determination. Should a decision be made to uphold the denial that decision should be in writing
and should come from Mark Graham as he is the Program Authority and it is he that will need to represent the
findings to the Board of Supervisors on appeal.
The applicant is eager to move forward with an appeal of this decision. As soon as you have made a preliminary
review of the information please let me know an approximate time frame for the decision making process so that a
Board of Supervisors date may be set. If you have any questions about this project please feel free to contact myself
