BACKGROUND: The preliminary plat for this project was approved by the Planning Commission on 2/3/04.
At that time the Commission indicated that they would like to see the final plat come before them for review.
Applicant's Proposal: Request for final plat approval to create to create 8 (eight) lots, averaging 16.69 acres,
on 139.30 acres. The property, described as Tax Map 103, Parcel 3 is located in the Scottsville Magisterial
District on Carters Mountain Road [Route #627] just north of its intersection with Blenheim Road [Route
#727]. It is zoned RA (Rural Areas) and the Comprehensive Plan designates this property as Rural Areas in
Rural Area 4, (Attachment A).
A significant portion of the property is also located in the Lanark Agricultural and Forestal District.
Agricultural - Forestal District provisions of the County Code allow for the creation of new lots as long as they
are at least 21 acres in size. Approximately 130 acres of this property is within the Lanark Agricultural - Forestal
District, which expires in 2008. Section 3- 202.A(2)(a) of the Code relating to agricultural and forestal districts
states that if the development is permitted by right in the rural areas (RA) zoning district, it shall not be deemed
to be developed to a more intensive use. This proposed development is not deemed to be a more intensive use
of the property because the subdivision of the land is allowed by right in the RA zoning district and all of the
proposed lots located in the Agricultural- Forestal District are at least 21 acres in size.
It is important to note that three of the lots being created, (Lots 3, 4 and 8), contain land, (0.37, 1.66, and 2.20
acres respectively), which lies outside of the Agricultural- Forestal District, however, the County Attorney's
office has determined that this kind of `boundary adjustment' meets the County Code requirements for
Agricultural - Forestal Districts, as these three lots will be at least 21 acres in size.
DISCUSSION: The final plat has been reviewed by the Site Review Committee and was found to comply with
Chapter 14, the Subdivision Ordinance, Chapter 18, the Zoning Ordinance and the following conditions of
preliminary plat approval.
Staff will comment on whether these conditions have been satisfied.
1. The Final Plat shall be reviewed and approved by the Planning Commission.
The final plat is before the Commission.
2. Engineering Department approval of erosion control plans. A narrative, application and fee are
required with plans.
The erosion and sediment control plan has been reviewed and approved. The bond needs to be posted.
3. Engineering Department approval of stormwater management and mitigation plans if necessary. A

narrative, application and fee are required with plans.
In lieu of a stormwater management plan, Engineering has accepted a riparian buffer easement to be held
by the Thomas Jefferson Soil and Water Conservation District.
4. Engineering Department (and VDOT) approval of road and drainage plans.
The road and drainage plans have been reviewed and approved. The bond needs to be posted.
S. All improvements are to be bonded or built before final plat approval. Bond estimate and construction
schedule forms can be obtained from the Engineering office.
All bonds have been estimated. The final plat cannot be signed until those bonds have been posted.
6 Health Department approval of all drainfield locations.
On October 25, 2004 the Health Department provided the County with written approval of all proposed
drainfield locations.
Additionally, during review of the preliminary plat, the Commission instructed Engineering staff to "take
extreme care in making sure there is an appropriate buffer provided to the greatest extent possible..."
In addition to the regulations in the Water Protection Ordinance and in lieu of a stormwater management plan,
the applicant has consented to additional buffer restrictions by providing a riparian buffer easement to be held
in perpetuity by the Thomas Jefferson Soil and Water Conservation District. Engineering staff recommends that
the Commission approve the final plat with a condition that ensures the plat will not be signed until written
authorization from the Conservation District has been received.
RECOMMENDATION: Staff finds the proposal in compliance with the provisions of the subdivision and
zoning ordinances and recommends approval, with conditions, of the Meadow Estates Final Plat SUB 04 -286.
RECOMMENDED CONDITIONS OF APPROVAL:
The final subdivision plat shall not be signed until the following conditions have been met:
1. All improvements shall be built or bonded.
2. Written documentation from the Thomas Jefferson Soil and Water Conservation District that the applicant
has submitted the required documentation and paid the appropriate fees to begin the recordation process
for the riparian buffer easement.
