All neighbors opposed to having their street connect to Jarmins Gap currently take advantage of our road to access Jarmins gap, waiving to us as i they drive by when we are visiting our lot. They add traffic to our street and .. . would prefer they stick to the original plans of having a more convenient access road closer to them. We may be the only owners on our street aware of their plan to increase traffic and I wanted to ensure that we represent current/future owners on this issue. The Department of Community Development received your email question regarding the construction of a connector street between Birchwood Hill Road and Jarmans Gap Road. I believe you were referencing a conversation that took place during the Site Review Committee (SRC) meeting for this project last Thursday,July 20th, 2017. The SRC meeting is where County staff and representatives from outside agencies such as VDOT and the Albemarle County Service Authority(ACSA) meet with the applicant and discuss some preliminary review comments based on the project being reviewed. Projects that are classified as by-right developments go before the SRC to ensure that all applicable County and State regulations are met through the project design. The SRC is a technical review committee, it is not a committee that votes to approve or deny a project during a public hearing. That being said, the Department of Community Development issued a denial letter to the Creekside V applicant prior to the SRC meeting. The subdivision plat has significant issues with its design in terms of meeting some standards contained in the County's zoning ordinance. As proposed, the plat was going to construct a new street,Jackson Lane, that would connect Jarmans Gap Road to Birchwood Hill Road.This was not an issue, and staff supports that road connection. Some neighbors within Creekside came out to the SRC meeting and expressed opposition to the preliminary plat for Creekside V.The developer and his engineer were present at the meeting and a discussion took place between both parties.The neighbors explained that they opposed to construction of Jackson Lane because it would bring more traffic into the neighborhood. The neighbors said that they would be much less opposed to a cul-de-sac being installed as opposed to a through street with access onto Jarmans Gap Road. It was at this point that County Staff explained that the developer could ask for a waiver in order to not construct a full through street. However, this is not something that Staff can approve administratively, and it would require approval by the Planning Commission. At this point, the applicant has not submitted a new application to move forward with this project and correct the deficiencies that led to the denial of the original application. Phase V Good Afternoon Chris, Yes, I received the email you sent earlier this week. I apologize for the delayed response, it's been a hectic week. I only saw one question within the email—specifically when you asked if I will keep you and the other residents informed about this project moving forward should the developer re-submit the plan with a different design.To answer that—yes I will. My plan is to respond to the your first email directly when/if any updates occur. I will keep everyone CC'd so that there aren't dozens of individual email chains going. In terms of a timeline, I can't really provide you with one unless the developer submits a new application. They have until next Monday to officially appeal the disapproval letter, in accordance with County Code Section 14-233(A). I haven't heard from the developer or their engineer as to whether they intend to file an official appeal. In terms of neighbors working with the developer to come up with an alternative design that is acceptable to all parties, that should occur privately between your group and the developer. The County does not mediate those types of discussions for private development. You should ask the developer directly if you'd like to obtain a copy of any plans that they are working on before they officially submit it to the County for review. I can give you the developers contact info so that you can contact them.The engineer is Scott Collins with Collins Engineering. We have been receiving many calls from neighbors in Creekside and there seems to be some confusion about how the approval process works for by-right developments. The proposal is a by-right subdivision proposing twelve (12) single-family lots in the R-1 Zoning District. By-right developments do not require review and approval of any rezonings or special use permits in order to be approved. Additionally,the applicant has not requested any waivers from County zoning standards that would go before the Planning Commission or Board of Supervisors during a public hearing in order to be approved. The SRC serves as a technical review committee to ensure that the subdivision design meets all applicable County and state regulations. The SRC meeting is not a public hearing, which means the SRC and staff members do not vote on whether to approve or deny a project. If the plan meets the applicable County standards, we are obligated by State law to approve the project.The SRC meeting will provide you and other members of the public with an opportunity to speak with the applicant or their engineers to express any concerns related to the proposal. They are supposed to attend the meeting. In closing, the SRC meeting is an informational session for the public to see the plan and ask questions of staff and the developer. I understand your concerns about the road connection between Birchwood Hill Road and Jarman's Gap Road.To give you some background: the County approved the overall preliminary plat for Creekside Phases 1-3 back in 2005, and Jackson Lane was shown as a public street that would stub northward from Birchwood Hill Road up to the undeveloped property, Tax Map Parcel 05500-00-00-078CO3 that is one of the sites for this proposed Creekside Phase V. The intention was for that street connection to be made at some point in the future, and that has been in the plans prior to the first homes in Creekside Phases 1-3 being built. I just checked the final plat for Creekside III, Phase 3B and it shows Jackson Lane as a public street right-of-way that extends north from Birchwood Hill Road and touches the southern property line of TMP 05500-00-00-078C0. The final plat showing this information is recorded in Deed Book 4560, pages 231-238 that is on record with the Albemarle County Clerk's Office.This was the final plat that created lots 40-49 in Creekside Phase III. You can contact the County Clerk and obtain a copy of the deed book pages if you wish. My point in bringing the road up is that even if the County denies the Creekside V application, another development may come through that requires the connection to be made in order to meet County and VDOT standards. Jackson Lane, the proposed connector road that extends from Birchwood Hill Road to Jarmans Gap Road should not be built because it endangers the families, their children and the community that currently exists on this quiet end of Old Trail. This expansion will allow two entrances off of Jarmans Gap Road that are 5 houses apart on Birchwood Hill Road. This means that children who have been free to move from home to home for play, bike riding and to explore the creeks and natural areas of this street will now have to cope with traffic flowing in two different directions. Young children are incapable of processing traffic in this flow pattern without an adult. As an educator, I feel you are removing the educational exploration, social interaction, and community that shares in their upbringing, from the life of these children. These are children who walk to the creek and sit and watch frogs, play in the water and explore the nature of their world. These are children who have built a clubhouse with my husband and I, both in our 60s, who have moved freely from their yards and houses to ours to play, paint and build something that they initiated, helped build and use it together developing their social and community skills. This freedom of movement will be removed. The children will be confined to their backyard with mowed lawns and swing sets. Children learn from their world by being out in it, not sitting on a mowed lawn or playing video games because mom and dad cannot watch them or fear for their safety. These are families who were informed that the route of this road had been changed and that a road would never be built where it is now proposed, and never to Jarmans Gap as a connector. These are families who chose the location of their homes because of the quiet nature of the street and the freedom of their children to move, bike, walk and play outside from home to home . This is a community that would welcome 7 more houses built on a cul-de-sac that are filled with families , children and others to the cul-de-sac picnics, birthday parties, movie nights, end of school parties on Birchwood Hill Road but to add a connector route to Jarmans Gap Road would destroy all of this. This is an amazing street of families who connect in many ways,through children, as friends, and supporting each other's families and participating in celebrations together. I have lived in Albemarle County for 50 years. I have seen the changes that have occurred and the growth that has ensued. What I believe we need to be very careful of is protecting the educational experiences of the children who grow up in this county. We cannot continue to remove the natural world from children's lives and expect them to respect it, we cannot remove the social world from children and expect them to understand and communicate with others, we cannot remove the connection of community from each other and expect people to respect one another. That is what is being threatened here for these families and for the children. These are children who are learning all of these things and more, and I implore you to protect this small but important space for these children. In fact I ask that you begin here to create more neighborhoods with quiet streets for the movement, exploration, socialization, communication and educational growth of the children. Children do not learn much in a mowed lawn, swing set, video game world. We must protect their freedoms to learn and grow in a world that is free to explore. I implore you to keep this street closed for the community of families that live on it and the children that move and learn about the world on it. Please only permit a cul-de-sac at the end of Jackson Lane and not a connector road to Jarmans Gap allowing two connector roads to Jarmans Gap 5 houses apart and a crossing traffic pattern.
