RE: SUB201700091 Old Trail Creekside V — Preliminary Plat
Dear Mr. Collins:
Pursuant to Albemarle County Code § 14-222(D), the above referenced subdivision plat has
been disapproved. The specific reason for disapproval is provided with references to specific
duly adopted ordinances, regulations or policies. Required modifications or corrections that will
permit approval of the subdivision plat are included as well. The reason for disapproval is as
follows:
1. Albemarle County Code § 18-2.2 allows for land to be subdivided as cluster
developments in accordance with the density and area and bulk regulations of the
specific zoning district. County Code § 18-3.1 defines cluster developments as "A
type of development design that concentrates lots in specific areas, does not
exceed the gross density allowed within the zoning district, and allows the
remaining land to be used for common open space." As stated in County Code §
18-2.2.3, a minimum of twenty-five (25%) of the total land area of the cluster
development shall be in common open space.
The preliminary plat proposes to subdivide three (3) separate parcels within the
R-1 Zoning District as a cluster development. The tax map parcel numbers of the
properties proposed to be subdivided are as follows:
I. TMP 05500-00-00-078A0;
II. TMP 05500-00-00-078CO and;
III. TMP 05500-00-00-079AO (1.85 acre portion).
The applicable area and bulk regulations in County Code § 18-13.3 apply to cluster
developments within the R-1 Zoning District. The bonus provisions which may be

used to gain density increases for R-1 cluster developments are outlined in
Albemarle County Code § 18-13.4. The preliminary plat proposes to use the
following bonus factors in order to gain an overall 30% bonus density increase and
qualify as a bonus level cluster development:
IV. A 5% density increase under County Code § 18-13.4.1 for providing
significant landscaping in the form of street trees;
V. A 10% density increase under County Code § 18-13.4.2 for
providing an internal road system as the sole access to the existing
state maintained road system and;
VI. A 15% density increase under County Code § 18-13.4.2 for the
dedication of land to public use as open space not otherwise
required by law.
County Code §18-13.5 states "use of cluster provisions shall be subject to other
requirements of this ordinance, applicable health requirements and the provisions
of Chapter 14 of the Code of Albemarle."
County Code §18-3.1 defines open space as "An open tract or parcel of land not
devoted to residential uses or structures but directly related and adjunct to a
cluster development." The regulations pertaining to lot shape in § 14-402 apply to
each portion of the development. County Code § 14-402 states "No lot shall
contain peculiarly shaped elongations designed solely to provide the required
square footage of area or frontage on a street. All portions of each lot shall be
contiguous."
The preliminary plat does not meet Albemarle County Code standards for lot
shape and contiguity required for cluster developments. The preliminary plat
proposes to dedicate three pieces of open space, measuring a total of 2.65 acres,
that are each separately located on one of the three aforementioned tax map
parcels, in order to meet the minimum 25% dedication of open space. Because
the parent parcels in the development do not share a common border, the
proposed open space areas are not adjunct or contiguous to the overall
development in accordance with §18-3.1 and § 14-402.
In order for TMP 05500-00-00-078AO and TMP 05500-00-00-078CO to be
subdivided as cluster developments, a minimum of twenty-five (25%) open space
must be contained within the original borders of each parent parcel and be
adjunct to the new residential lots.
Two (2) separate applications must be submitted for any proposed cluster
development subdivision of either TMP 05500-00-00-078AO and TMP 05500-00-
00-078CO3 in accordance with County Code § 14-206. Each application must meet
the minimum standards for density bonuses separately based on the acreage of
each parent tract.

In accord with Albemarle County Code § 14-223(A), this decision may be appealed. The appeal
shall be in writing and be filed with the agent within ten (10) days after the date of the decision
by the agent.
