The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once
the following comments have been addressed: [Each comment is preceded by the applicable reference, which is
to the Subdivision/Zoning Ordinances unless otherwise specified.]
[General Comment] In order to locate improvements inside of public easements on private lots that are
supposed to be part of a public street right-of-way, a maintenance agreement must be reviewed and approved
by the developer, VDOT and the Albemarle County Board of Supervisors. Albemarle County generally
does not accept such public easements on private lots. Upon discussions with VDOT, the County Engineer,
and the County Attorney, it does not appear that this would be a case that would be supported/approved.
See comments from Engineering, transportation Planning, and VDOT staff below for additional
information.
a. Staff suggests doing a boundary line adjustment application instead so that all sidewalks will be
located inside of the public street right-of-way. Please provide evidence for each parcel that would
preclude adjusting the lot boundary lines. For example, if the lot boundaries are adjusted to put
the sidewalks within the right-of-way, will some (or all) lots no longer comply with setbacks or
minimum lot size regulations?
b. The proposed public access easement on TMP 062GO-00-07-20200 overlaps with an existing 20'
ACSA sanitary sewer easement and cannot be approved as shown. See comment #13a below.
c. The proposed public access easement on TMP 062GO-00-07-21200 overlaps with an existing 20'
ACSA sanitary sewer easement and may not be approved as shown unless confirmation is
obtained from ACSA. See comment #13d below.
d. The proposed public easement on TMP 062GO-00-07-23500 overlaps with an existing 20' ACSA
sanitary sewer easement and may not be approved as shown unless confirmation is obtained from
ACSA. See comment #13g below.
e. The proposed public access easement on TMP 062GO-00-07-24400 overlaps with an existing
variable width private storm drain easement. See comment #13i below.
2. [14-302 (A)(3)] Please state the instrument that created each public street, private street, and private alley
shown on the plat.
a. Belvedere Boulevard was created by plat of record recorded in DB 5169, pg. 566, per notes on
plat in DB 5193, pages 462-471.
b. Farrow Drive was created by plat of record recorded in DB 5169, pg. 566, per notes on plat in
DB 5193, pages 462-471.
c. Winn Alley was created by plat of record recorded in DB 5169, pg. 566, per notes on plat in DB
5193, pages 462-471.
d. Fowler Street was created by plat of record recorded in DB 5169, pg. 566, per notes on plat in
DB 5193, pages 462-471.
e. Barnett Street was created by two plats of record: plat recorded in DB 4583, pg. 375-390, and plat
recorded in DB 5169, pg. 566, per notes on plat in DB 5193, pages 462-471.
f. Shelton Street was created by two plats of record: plat recorded in DB 4583, pg. 375-390, and
plat recorded in DB 5169, pg. 566.
g. Phillips Alley was created by plat of record recorded in DB 4583, pg. 375-390.
h. Miles Alley was created by plat of record recorded in DB 4583, pg. 375-390.
[14-302 (A)(4)] Please identify the location and dimensions of all existing private easements. Existing
easements shall be labeled with the deed book and page number and the name of the owner of record. See
comment #13 below.
4. [14-302 (A)(5)] Please identify the location and dimensions of all existing and proposed public easements
outside of a street right-of-way. Existing easements shall be labeled with the deed book and page number
and the name of the public owner of record. See comment #13 below.
a. On Sheet V2, revise the proposed easements labels so they include "dedicated to public use."
5. [14-302 (A)(15)] Please provide the names and addresses of each owner of record and holders of any
easements affecting each property. Staff suggests providing separate notes for each TMP stating the
easements and easement holders which apply to each parcel.
6. [14-302 (B)(1)] Please add a date of last revision to each sheet.
7. [14-302 (B)(5)] Please revise Note 6 on Sheet 1 so that it states that Lots 235, 236, and 244 are zoned R4
Standard Level Cluster Development, Refer to Note 5 on plat recorded in DB 5193, pages 462-471.
8. [14-302 (B)(5)] Revise Note 6 on Sheet V2 so that it does not state the last revision date of the Code of
Development.
9. [14-302 (B)(5)] Please state all overlay zoning districts that apply to each property subject to this plat.
a. According to Albemarle County GIS, TMPs 062G0-00-07-21100, 062G0-00-07-21200, 062G0-
00-07-21500, and 062GO-00-07-21600 are located within the (AIA) Airport Impact Area
Overlay Zoning District.
10. 114-303 (A)] Please revise each statement of consent to division so that they clearly explain that the plat is
platting new public easements.
11. [14-303 (B) and 14-303 (F)] Please state the section, block, or phase numbers for each parcel.
a. TMPs 062G0-00-07-20200, 062G0-00-07-20800, 062G0-00-07-21100, 062G0-00-07-21200,
062G0-00-07-21500, and 062GO-00-07-21600 are in Belvedere Phase IIB, per plat recorded in
DB 5169, pages 566-591.
b. TMPs 062G0-00-07-23500, 062G0-00-07-23600, and 062GO-00-07-24400 are in Belvedere
Phase IVA-1, per plat recorded in DB 5193, pages 462-471.
12. [14-303 (L)] Please identify the location and dimensions of each public utility, drainage and sight distance
easement outside of a street right-of-way; for each existing easement, include a note stating the deed book
and page number.
a. TMP 062GO-00-07-20200 is subject to a maintenance easement recorded in DB 5169, page 583;
a 20' ACSA sanitary easement recorded in DB 5169, page 583; and a variable width private
storm drain easement recorded in DB 5169, pages 587-588.
b. TMP 062GO-00-07-20800 is subject to a maintenance easement recorded in DB 5169, page 583;
a 20' ACSA sanitary easement recorded in DB 5169, page 583; and a variable width private
storm drain easement recorded in DB 5169, page 587.
c. TMP 062GO-00-07-21100 is subject to a maintenance easement recorded in DB 5169, page 583;
a 20' ACSA sanitary easement recorded in DB 5169, page 582-583.
d. TMP 062GO-00-07-21200 is subject to a maintenance easement recorded in DB 5169, page 581;

13. [14-312] Please show the location of all existing buildings for each lot subject to this plat. This only needs
to be done for parcels where new easements are proposed, not all lots that are visible on the plat.

changes:
1. Board of Supervisor approval of a maintenance agreement for the sidewalks within public easements
located on private lots is required prior to plat approval. As stated in Planning Division comments
above, transportation planning staff agree that all efforts should be made to revise parcel boundaries so
that sidewalks are located within the ROW instead of putting public easements containing sidewalks on
private lots. Otherwise, please provide evidence that revising parcel boundaries is not possible (due to
zoning regulations, Code of Development standards, etc.) and the proposed easements are the only
solution.

If sidewalks are not inside the right of way then a maintenance agreement is required. VDOT must have
assurances from the county that the sidewalk will be maintained.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced Belvedere Easement Plat, as submitted by Roudabush
Gale & Associates, Inc., dated March 09, 2020 and find it to be generally acceptable.
A VDOT Land Use Permit will be required prior to any work within the right of way. The
owner/developer must contact the Charlottesville Residency land Use Section at (434) 422-9399
for information pertaining to this process.
