Subject: SUB201900176 Property of Bella Signature Homes, LLC - Final Subdivision Plat
The County of Albemarle Planning Division will approve the plat referenced above once the following comments have
been satisfactorily addressed (The following comments are those that have been identified at this time. Additional
comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by the
applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
Comments to be addressed with the Final Subdivision Plat Approval:
[14-302(A)(14) & 14-3141 Land to be dedicated in fee or reserved; Identification of all interests of the County in
property. Revise the label for the area to be dedicated for Route 743 to include the wording "to be dedicated to the
County for public use." Also, revise note #10 to include the same wording. Final. Throughout note #10 remove the
portion of the note that reads "to the Comm. Of Va" for the various easements being dedicated, as these
easements are only being dedicated to the County not to the Commonwealth of Virginia. Additionally,
throughout note #10 omit the wording "to be dedicated to the County for public use", and instead replace it
with "is hereby dedicated to the County for public use". Additionally, ensure the note provided on sheet 2 is
revised utilizing "25' from the Ctr is hereby dedicated to the County for public use."

[14-302(A)(5) & 14-303(L)] Public easements; Public utility, drainage and sight distance easements. Address the
following:
a) Since sight distance easements are proposed across the adjoining parcels, then the following must be addressed:
ii. If it will be a public street do both of the following:
a. Add a label to the proposed site distance easements that states "Dedicated to the County for
Public Use"
UPDATE: Comment partially addressed. Revise the label for the proposed public street to
include the wording "Dedicated to the County for Public Use". Final. Replace the wording
with "54' public right-of-way is hereby dedicated to the County for public use."

b) Show any proposed drainage easements on plat and label them as either public or private. The drainage for the
private street appears to impact the adjoining lot.
UPDATE: Comment revised. Show the public drainage easements on the plat and submit the proposed deed of
easement for the drainage easements. Please note: A template for this deed will be provided to you during the
final plat review process. Final. Comment partially addressed. Submit a draft deed of easement for the public
drainage easements (attached is a template). County Attorney review/approval is required prior to final
subdivision plat approval.

13. 114-303(N)1 Statement pertaining to private streets. If a private street is not approved note #11 must be edited
appropriately. Final. Remove note #11 as it is no longer necessary nor applicable because the road is a public
road.

15. 114-303(R)1 Parent parcel access. Provide the following note: `All subsequent division of the residue shall enter only
onto such street(s) shown on the approved final plat and shall have no immediate access onto to any public street. "
Final. Comment not addressed. The ordinance requires the note regardless of future development potential.

18. [14-308.1, 17-10031 Groundwater assessment information. Final Tier 3 groundwater management plan must be
approved prior to approval of final plat. Final. Comment still relevant. A Tier 3 groundwater management plan
was not submitted with the final subdivision plat. Please submit the plan for review and approval.
Rev. 1: Comment not vet fully addressed. Continue to work with John Anderson towards getting
approval of the Tier 3 Groundwater management plan. The plan must be approved prior to final plat
approval.
19. 114-309 & 14-3101 Soil evaluations & Health director approval of well and septic systems. Address the following:
b) Prior to final subdivision plat approval each lot shall have a primary and reserve drainfield location and individual
well approved by the Health Department. Final. Soil work was received and has been distributed to VDH,
pending approval by VDH.

c) The final plat will not be approved until VDH approves the drainfield locations for all 5 lots. Final. Soil work was
received and has been distributed to VDH, pending approval by VDH.

20. [14-311, 14-434 & 14-4351 Infrastructure improvement plans; Completion of on -site improvements required prior to
plat approval; Agreement and surety. Road Plan and WPO Plan must be approved, all required improvements must be
built or bonded, and all required Deeds and Declarations must be reviewed and approved prior to Final Plat approval.
Final. Comment still relevant. Road Plan and WPO Plan have been approved. All required Deeds and
Declarations must be reviewed and approved prior to final subdivision plat approval. Please provide the draft
deed of dedication for the sight distance easement (attached is a template). County Attorney review/approval is
required prior to final subdivision plat approval.

21. 114-316] Approval of entrance onto public streets. The subdivider shall submit, prior to or with the final plat, evidence
satisfactory to the agent that the entrance of the principal means of access for each lot onto any existing or proposed
public street complies with Virginia Department of Transportation standards. Final. Comment still relevant.

26. [147-303(G)] Ownership of Common Areas. On the plat label the ownership of the Forest & Open Space Easement
Area.

27. 114-302(A)21 Vicinity Map. Revise the vicinity map to depict the property and its relationship with adjoining land and
streets.

28. [14-317] Instrument evidencing maintenance of certain improvements. Prior to final subdivision plat approval submit
the maintenance agreement ensuring the perpetual maintenance of the stormwater management facilities, the open
space areas, and any other improvements that are to be maintained by the HOA in perpetuity. County Attorney
approval is required prior to final subdivision plat approval.
Rev. 1: Comment not vet addressed. Prior to final subdivision plat approval submit the maintenance agreement
ensuring the perpetual maintenance of the stormwater management facilities, the open space areas, and any
other improvements that are to be maintained by the HOA in perpetuity. County Attorney approval is required

Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept up to
date by the County Attorney's office. The Code may be found on the County Attorney's website which may be found under
"Departments and Services" at Albemarle.org. In accord with the provisions of Section 14-229(B) of Chapter 14 of the
Code if the developer fails to submit a revised final subdivision plat to address all of the requirements within six (6) months
after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
