Commonwealth Land Surveying, LLC (melodybahkaol.com) From: Andrew Reitelbach, Senior Planner Division: Planning Date: April 10, 2020 Subject: SUB2020-00037 Knicely — BLA Fax 434-972-4126 The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [14-302(A)3; 14-302(A)4; 14-303(E)] Provide the deed book and page number(s) for the legal instrument(s) creating the 35' right-of-way, as well as the name of the holder of the easement. Identify if this right-of-way is new or existing. Rename the right-of-way to a "private road easement." Clarify on which side of the dotted line the private road easement extends (whether the easement is between the dotted line and TMP 45-59C or the dotted line and TMP 45-59M. 2. [14-302(A)9] Revise the building site note on the cover sheet to read as follows: "TMP 45-59E and 59E1 each contain..." 3. [14-302(A)10] Revise the note on development rights on the cover sheet to read as follows, with the appropriate information added in: "Revised Parcel [TMP number] is assigned [number] of development rights and may/may not be further divided and when further divided these rights shall not comprise more than [number] acres. The residue of Tax Map/Parcel [number] is retaining [number] development rights and when further divided it shall not consist of more than [number] acres." The assignation of development rights with the proposed new plat is currently unclear. 4. [14-302(A)11] TMP 45-59E appears to be owned by someone other than Rodney and Nancy Knicely. Provide the correct legal instrument information, including deed book and page number, for this parcel and its owners. 5. [14-302(A)15] TMP 45-59E appears to be owned by someone other than Rodney and Nancy Knicely. Provide the name(s) and address(es) of the owner(s) of this parcel. 6. [14-302(B)1] Provide the date of the last revision when the plat is re -submitted. 7. [14-302(B)5] On the cover sheet of the plat, include that these parcels are located in the Airport Impact Area zoning overlay district. 8. [14-302(B)7] Revise the note on the cover sheet, as these parcels are not located within a water supply watershed. 9. [14-303(0)] Provide an additional signature panel for the owner(s) of TMP 45-59E. 10. [14-303(P)] Provide an additional notary panel to acknowledge the owner(s) of TMP 45-59E. 11. [14-309, 14-310, 14-416] Provide information, including soils evaluations, for review by the Health Department for both of these parcels. Both of these lots are proposed to be less than five acres in size, so the plat cannot be approved until the Health Director has approved a soils evaluation report demonstrating that the properties have adequate soils for subsurface drainfields and reserve drainfields for septic systems and private wells. Submit three copies of a soils evaluation report for these parcels to the County so that these can be forwarded to the Virginia Department of Health for review and approval. 12. [General Comment] The correspondence with Francis MacCall that was submitted with this application indicates that the new parcel acreages were originally intended to be different, with Parcel B increasing to 2.24 acres and Parcel A decreasing to 4.02 acres. Is there a reason why the parcel sizes on the submitted plat are different from what was originally proposed? 13. [Advisory Comment] It is my understanding that the property owner(s) of TMP 45-59E1 intend to eventually submit a proposed family division plat. Please be aware that additional soils reports for review by the Health Department will be required at the time of proposed subdivision to ensure that the new lot also has sufficient soils for drainfields. 14. [Advisory Comment] It is my understanding that the property owner(s) of TMP 45-59E1 intend to eventually submit a proposed family division plat. Please be aware that the private road will need to be upgraded to the standards of a private road that serves three to five lots before a subdivision can be approved, as the private road would be serving TMPs 45-59E, 45- 59E1, and the proposed new lot. See 14-412 of the subdivision ordinance for requirements. 15. [Advisory Comment] It is my understanding that the property owner(s) of TMP 45-59E1 intend to eventually submit a proposed family division plat. Please be aware that if that plat were to be approved, the private street would be serving at least three residences. County policy requires that any street that serves three or more addressable structures requires a name, so an additional lot will likely trigger the need for a change in addresses of the existing residences on TMPs 45-59E and 45-59E1.
