Both parcels are currently zoned C-1 but are embedded Albemarle County's Rural Area in the iconic "crossroads community" of Ivy. See Image 1. Image 1. Anticipated potential hours of operation are from 7:00 am to 7:00 pm seven days per week. The SUP is required under the C-1 zoning and additional subject to Sec. 5.1.11.b because the proposed structure is closer than 200 feet to residential lots lines. However, to the south the residential lot lines are separated from the Property by other parcels zoned C-1 and U.S. Route 250 and to the north by Buckingham Branch Railroad. The closest residentially zoned dwelling is over 300 feet from the proposed structure separated by 16 feet of elevation and the railroad, both of which will mitigate noise. Applicant acknowledges the rest of Section 5.1.11, including but limited to, the requirement for soundproofing such that sounds measured at the property line shall not exceed 55 decibels. There is a residential use on parcel 58A2-21; however, that parcel is also zoned C-1 with a service station and garage also on the property. This current use is arguably more disruptive to the co -located, residential use than the proposed veterinary office. See Image 2. 11Page Image 2. i yy,1 v. We proposed to add 6,500 sf of light medical office space to the community anchored by a small -animal veterinary office. Currently, the closet veterinary services are at least five miles in either direction. A new office in this location would service potentially 24.6 square miles of Albemarle County. The following map shows existing veterinary services with red pins and the proposed location as a green and gold star. See Image 3. The site has been used for illegal dumping and parking and unkempt for quite some time. In its current state it is a blight on the Ivy entrance corridor. We are working with the adjacent property owner, and the respective tenants, on an updated, shared entrance that benefits both properties. • Character of the Nearby Area is Unchanged Our development team, including the architecture firm of Design Develop, studied all of the existing commercial building in Ivy. Our intention is to add a structure that acknowledges its context while adding more contemporary adaptation of these designs. The veterinary use does not adversely change the character of the proximate uses, which include a service station, a post office, a nursery and garden center, offices, a convenience store, and others. The ARB review process will ensure that the aesthetic of the building is appropriate. • Harmony A veterinary office is harmonious with other uses designated on the Comprehensive plan as rural areas, especially considering the C-1 zoning. Consider VCA Albemarle Veterinary Health Care on Westfield Road, Pantops Veterinary Hospital on Winding River Lane, and Animal Medical Center of Charlottesville on S. Pantops Drive as precedent examples. • Consistency with Albemarle County's Comprehensive Plan The Comprehensive Plan recognizes that "traditional crossroads communities" are an essential and vibrant part of our unique fabric. These crossroads are supposed to "provide support services and opportunities to engage in community life" (Comprehensive Plan, Rural Areas, 7.3). For many of our friends and neighbors, their pets are members of their families. Having local care for these family members is an ideal support service and a truly viable aspect of community life. The size and scale of the project will ultimately be determined during site plan and ARB review and are not specific to the requested use. For reference, however, the proposed 6,500 sf building is one-story, which is consistent with all the other commercial properties in the community. The old Toddsbury building is +/- 2,338 sf. The post office and Ivy Garden building is +/- 3,360 sf. Ivy Exxon is +/- 2,628 sf. The proposed building intentionally picks up this scale by repeating 2 or 3 modules of similar size. Impacts on Public Facilities and Infrastructure The proposed commercial building located on parcels TMP 58A2-14 and TMP 58A2-20 seeks to demonstrate substantial conformance with County zoning requirements for commercial developments, as well as meeting State, Albemarle County, and VDOT engineering standards for proposed infrastructure. The proposed commercial building includes approximately 2,500 square feet of Veterinary Clinic use, and approximately 4,000 square feet of General Office Space. The project proposes one entrance into the parking facility from Ivy Road. The proposed entrance will be shared by the proposed development as well the existing building located on the adjacent parcel at 4282 Ivy Road. VDOT engineers have expressed its support of the proposed shared entrance in lieu of individual site entrances. The proposed uses will generate an additional 93 vehicular trips per day based on the ITE Trip Generation Manual. No adverse impacts are anticipated to the adjacent road system given the relatively low amount of traffic volume generated. Stormwater will be captured on site with drainage inlets and directed underground to a proposed underground stormwater management facility. The proposed facility will detain and release stormwater at a rate this less than the runoff generated in the site's pre -developed condition. All state and local Stormwater Quantity regulations will be met. 3 1 P a g e No impacts to the public sanitary sewer or water infrastructure are proposed. This project will utilize a private well and private septic system. Impacts on Environmental Features The applicant desires to develop the land in an environmentally conscious way. The site in its currently condition is partially covered by asphalt and gravel surface. This project aims to make improvements to the management of stormwater runoff. The site's runoff is currently directed towards Ivy Road, where the runoff follows an undefined shallow channel just outside of the pavement. Sediment and gravel generated from the erosive runoff appears to be carried to a nearby inlet, before out -falling directly into Ivy Creek. The proposed stormwater management approach is to capture the site's stormwater in drainage inlets onsite, pipe it to an underground storage facility, and eventually pipe the water to the existing drainage inlet adjacent to Ivy Road. This approach will greatly reduce the volume of stormwater runoff directed over land towards Ivy Road, and thus mitigate the sediment laden water which currently spills into Ivy Creek. Water quality impacts will be achieved via onsite stormwater treatment, or though the stormwater nutrient credit purchasing program. Applicable Erosion and Sediment Control measures will be provided per State and local regulations in order to ensure adjacent waterways and properties are protected during construction. Groundwater quality has also been considered with this project. This site has been identified as being within 2,000' of a Leaking Tank Site. As such, a "BTEX" water quality test will be prepared by the applicant for review by Albemarle County Service Authority, DEQ, and/or County Engineer in order to demonstrate the availability of safe drinking water. Disturbance of critical slopes are proposed with this project. The slopes in question appear to be engineered slopes that are the result of the adjacent railroad construction. Efforts will be made to minimize impacts to the slopes, and to minimize the height of proposed retaining walls. Your application for a permit was submitted pursuant to §32.1-163.6 of the Code of Virginia, which requires the Virginia Department of Health (VDH) to accept designs for onsite sewage systems from individuals licensed as Professional Engineers (PEs). This law allows PEs to design onsite sewage systems that do not fully comply with the Sewage Handling and Disposal Regulations (12 VAC 5-610-10 et seq) and requires VDH to accept such designs provided they comply with standard engineering practices, performance requirements set by the Board of Health, and certain horizontal setback requirements necessary to protect public health and the environment. VDH hereby recognizes that the design submitted by Michael Craun, P.E. complies with the requirements of the Code of Virginia and the applicable regulations and grants permission to install the system as designed in the area shown on the attached plans and specifications. If modifications or revisions are necessary between now and when the system is constructed, please contact the PE who designed the system upon which this permit is based. Should revisions be necessary during construction, your contractor should consult with the PE. The PE is authorized to make minor adjustments in the location or design of the system provided that adequate documentation is provided to the Albemarle County Health Department. The PE that submitted the design for this permit is required by the Sewage Handling and Disposal Regulations to conduct a final inspection of this sewage system when it is installed and to submit an inspection report and completion statement to the Albemarle County Health Department. The health department is not required to inspect the installation, but may do so at its sole discretion. The sewage system may not be placed into operation until you have obtained an Operation Permit from the Albemarle County Health Department. There may be other local, state, or federal laws or regulations that apply to the proposed construction of this onsite sewage system. The owner is responsible at all times for complying with all applicable local, state, and federal laws and regulations. This construction permit is transferrable until expired or deemed null and void. This will be done by the designer of your permitted system, a private OSE or PE. Your OSE or PE must submit a copy of the inspection results, complete with an as -built diagram, to the Health Department. • Please ensure that your contractor turns in a Completion Statement to the local Health Department after installation. • If your permit is for an alternative system, you must sign, have notarized, and record the attached Notice of Recordation in your locality's land records. Please bring proof of this recordation to the local Health Department IF YOUR PERMIT IS FOR BOTH A SEPTIC SYSTEM AND WELL YOU WILL ALSO NEED • Your well must have satisfactory inspection results after installation. Please give the Health Department several days notice to schedule this inspection before your Operation Permit will be requested. • The Health Department must receive a copy of your water sample test result being negative/satisfactory for coliform bacteria. You are responsible for performing this test and ensuring the results are received at the Health Department • Please ensure that your Well Driller submits, a Uniform Water Well Completion Statement or GW -2 to the Health Department, including documentation, of a proper well abandonment if required by permit Allow 5 business days after the last piece of documentation is received for the Operation Permit to be issued. To avoid delays, clearly label each piece of documentation with the property Tax Map number and HDID number shown above and on your construction permit. Please note that due to the individual circumstances of your permit there may be additional required items not covered by this checklist.
