This action has been taken because the site plan has not been revised to include required revisions of the Site Review Committee. Those items that have not been addressed are: The proposed SWM facilities in Phase I and II do not include the entire drainage area for Phase IV. Please provide conceptual SWM quantity and quality for the entire area for Phase IV. This includes showing the proposed drainage areas for Phase IV on a preliminary plan sheet. [18- 32.5.6k, 17 -312] Rev. 1: The applicant stated that the computations and routing for the entire drainage area will be addressed with the final site plan submittal. These computations will show how the existing drainage area currently flowing away from SWM Facility B gets to Facility B for treatment. This statement is insufficient to meet the criteria for showing conceptual SWMfor the entire drainage area with the preliminary site plan. The applicant needs to show conceptually, with the preliminary site plan, how the entire site plan is being addressed for SWM. 2. A portion of the proposed stormwater management facility for this site plan, TMP 56 -46 &47, is a proposed pond located offsite on TMP 56 -35. Therefore, with this preliminary site plan review, the engineering review is requiring the applicant to provide a letter of "intent to dedicate" signed by the owner of the property from who an offsite easement will need to be acquired. This letter demonstrates to the County Engineer that the acquirement of the offsite easement is potentially feasible. This letter must, at a minimum, contain the information shown in the Design Manual, Section 1102. [18- 32.5.6k] Rev. 1: The applicant has stated that the Westhall HOA documents for all phases of Westhall will include ownership and maintenance responsibilities for the SWMfacilities. The proposed SWMfacilities are on TMP 56 -46 while the majority of this site plan is located on TMP 56 -45. Therefore, the SWMfacilities are considered offsite. Even if both parcels are owned by the same entity, the letter of intent is needed to ensure that the SWMfacilities are available to the ownership of TMP 56 -45 if the ownership of TMP 56 -46 changes. You may resubmit the plan, containing all required revisions, within 15 days of the mailing of this notice of denial along with a fee of $65. If a revised plan and fee are not received within 15 days the preliminary site plan shall be deemed to be denied and a new application and fee shall be required for submittal of the preliminary site plan. In accord with Section 32.4.2.7 of the Albemarle County Code, this decision may be appealed to the Board of Supervisors by filing a written request with the Director of Planning and Community Development within ten calendar days of the decision, Please contact me at your earliest convenience if you have any questions or require additional information.
