This action has been taken because the site plan has not been revised to include required revisions of the Site Review Committee. Those items that have not been addressed are: 1. The applicant needs to provide a "letter of intent" from the adjoining property owners where the proposed grading extends onto TMP 78 -07. Otherwise, the proposed grading needs to be shown within the site's boundaries on the preliminary site plan. [18- 32.5.6k] Rev. #1: Applicant states, in letter dated 15 July 2005, "The owner will submit a letter of intent under separate cover. " The owner /applicant has not provided a letter of intent for proposed grading shown on TMP 78 -07. The proposed grading is not shown completely within the parcel's boundaries. 2. The proposed biofilter addresses SWM quality but not SWM quantity. SWM quantity needs to be addressed with the preliminary site plan. [18- 32.5.6k] Rev. #1: Applicant replies, in letter dated 15 July 2005, "Volume control for SWM runoff is provided by the Luxor Stormwater Management Facility, SWM -1. " The Luxor SWM facility is currently being reviewed by Engineering. The drainage area to the Luxor SWM facility does not include the section of TMP 78 -09, containing this preliminary site plan. The runoff from this site plan is not captured by the Luxor SWM facility. It is released uncontained to the existing creek located along the northern property line of TMP 78 -09. 3. The engineering review recommends that the applicant show minimal road improvements to the site, only the needed entrance and travelway to Route 250. Otherwise, the final site plan cannot be recommended for approval until the final road plans are approved by the County and VDOT. Rev. #1: Applicant states, in letter date 15 July 2005, "The Owner intends to build the road as shown on the plans. Road plans have been submitted for review. " Engineering and VDOT approval of the public road plans associated with this plan will be required before Engineering can approve the final site plan. 4. The applicant has submitted a critical slope waiver request. It is under review. [18 -4.2] Rev. #1: Engineering reviewed the critical slope waiver requestfor this project. Engineering recommended denial to this critical slope waiver request. The applicant met with engineering staff to discuss the critical slope waiver request on Wednesday, 27 July 2005. At the time of this review, the applicant has not resubmitted additional information to perform another review of the critical slope waiver request. The applicant has submitted a waiver request with the most recent submittal. The applicant requests a waiver of the requirements of County Code section 18- 32.7.4 for this project. The applicant asks to allow an off -site SWM Facility, Luxor SWM -1, to provide stormwater detention for this site. The drainage area to the Luxor SWM facility does not include the section of TMP 78 -09, containing this preliminary site plan. The runoff from this site plan is not captured by the Luxor SWM facility. It is released uncontained to the existing creek located along the northern property line of TMP 78 -09. Engineering does not support this waiver. The engineering review for current development needs to review and approve all applicable items as specified in the Design Standards Manual, section 902, before recommending tentative approval to the final site plan. You may resubmit the plan, containing all required revisions, within 15 days of the mailing of this notice of denial along with a fee of $50. If a revised plan and fee are not received within 15 days the preliminary site plan shall be deemed to be denied and a new application and fee shall be required for submittal of the preliminary site plan. In accord with Section 32.4.2.7 of the Albemarle County Code, this decision may be appealed to the Board of Supervisors by filing a written request with the Director of Planning and Community Development within ten calendar days of the decision, Please contact me at your earliest convenience if you have any questions or require additional information.
